TERMS AND CONDITIONS The Permittee,Michael & Susan Cavounis, residing at 3475 Wells Road, Peconic,New York as part of the consideration for the issuance of the Permit does understand and prescribe to the following: 1. That the said Board of Trustees and the Town of Southold are released from any and all damages, or claims for damages, of suits arising directly or indirectly as a result of any operation performed pursuant to this permit, and the said Permittee will, at his or her own expense, defend any and all such suits initiated by third parties, and the said Permittee assumes full liability with respect thereto,to the complete exclusion of the Board of Trustees of the Town of Southold. 2. That this Permit is valid for a period of 24 months,which is considered to be the estimated time required to complete the work involved, but should circumstances warrant,request for an extension may be made to the Board at a later date. 3. That this Permit should be retained indefinitely, or as long as the said Permittee wishes to maintain the structure or project involved,to provide evidence to anyone concerned that authorization was originally obtained. 4. That the work involved will be subject to the inspection and approval of the Board or its agents, and non-compliance with the provisions of the originating application may be cause for revocation of this Permit by resolution of the said Board. 5. That there will be no unreasonable interference with navigation as a result of the work herein authorized. 6. That there shall be no interference with the right of the public to pass and repass along the beach between high and low water marks. 7. Depths for the dock terminus are within Town Trustees, New York State Department of Environmental Conservation and United States Army Corps. of Engineers guidelines and there is no recognized Federal/New York State/Town navigation channel in the immediate vicinity of the proposed structure. • Scope: The proposed dock is comparable to docks on neighboring properties in an area where docks historically are used for commercial and recreational purposes • Scope in relation to the riparian rights of shell fishers: The pian allows a standard ramp to float design that will not impede access for those seeking_shellfish and crustacea in season. • Scope in relation to view shed: The seaward end of the proposed dock'will not extend appreciably beyond existing docks. As such the perspective will not be discernibly different'from the existing view. -Environmental upkeep: The dock design projects a usual lifespan of 30 years with limited pile replacement so as to minimize disturbance of the bottom. WETLANDS ADDENDUM FOR MICHAEL & SUSAN CAVOUNIS 3475 WELLS ROAD PECONIC, NY SCTM#1000-86-2-9 STATEMENT OF EFFECT For the purpose of maintaining the property's historically maintained method of protection against erosion and flooding, the project proposes to construct a vinyl bulkhead in place of an existing bulkhead that has been in place since at least 1950 and was permitted by the Southold Trustees in 1982 (Wetlands Permit 1565). Machinery access and all bulkhead reconstruction work will be staged from the landward side of the bulkhead with no equipment disturbance to existing wetland vegetation. The bulkhead replacement will thus maintain the existing shoreline conditions with the ecological/water quality benefits associated with the replacement of treated timber bulkhead sheathing with untreated vinyl sheathing and the establishment of a 10'wide non-turf buffer in place of existing lawn landward of the bulkhead. The project also includes the replacement and reconfiguration of a nonconforming dock facility that was constructed prior to 2001 and permitted by the Trustees in 2016 pursuant to a plan to maintain the 7' x 8' deck seaward of the bulkhead and replace the existing walk, ramp, and float with a new walk, ramp, and float to be maintained in water less than 30 inches deep with float stops (Wetlands Permit 8756, expires 3-23-20). The current plan instead proposes the removal and replacement of both the nonconforming deck over the intertidal zone and 7' wide wood-decked catwalk with a longer, 4' wide, light-penetrable catwalk elevated at least 4 feet above the grade of marsh; and the replacement of the oversized 8' wide floating dock in shallow water with a 6' wide floating dock situated in water at least 30 inches deep at low tide. As proposed, the dock will extend seaward no farther than the immediately adjacent dock to the south and well less than the allowable one-third width of the waterway. The dock replacement will thus result in the ecological/water quality benefits associated with a net decrease in the dock's overall bottom coverage of Richmond Creek; improved light penetration both through and beneath the dock for potential restoration and increased sustainability of marsh vegetation; replacement of a float with potential for disturbing the benthic environment with one that will be situated in sufficient water depth without impacting navigation; and generally, the replacement of a nonconforming dock facility with one that will be compliant with all "construction and operation standards" for docks set forth by Town Code Section 275-1 l(C)(2).
