The action is for the construction of a 12' wide access road for the farm to Skunk Lane; and WHEREAS, on March 23, 2021, the Planning Board, pursuant to Southold Town Code §280-131 C., distributed the application to the required agencies for their comments; and WHEREAS, the proposed action is exempt from review by the Suffolk County Planning Commission (SCPC); and WHEREAS, on April 5, 2021, the Southold Town Fire Inspector reviewed and determined that there was adequate fire protection and emergency access for the site after requiring revisions to the site plan; and WHEREAS, on April 5, 2021, a Public Hearing was held and closed; and WHEREAS, on April 5, 2021, the Town of Southold LWRP Coordinator reviewed the above-referenced project and has determined the proposed project to be consistent with Southold Town LWRP policies; and WHEREAS, on April 8, 2021, the Southold Town Engineer reviewed the above- referenced application and has determined that the proposed building and site meet the minimum requirements of Chapter 236 for Storm Water Management; and WHEREAS, on April 22, 2021, the Cutchogue Fire District determined there was adequate fire protection for the site with verification of certain parameters (free and clear access, load bearing surface); and WHEREAS, on May 17, 2021, the Southold Town Planning Board determined that all applicable requirements of the Site Plan Regulations, Article XXIV, §280 — Site Plan Approval of the Town of Southold, have been met; therefore be it Indian Neck Lane Farm Access Page 3 July 13, 2021 RESOLVED, that the Southold Town Planning Board hereby waives certain Site Plan Application requirements as noted above; and be it further RESOLVED, that the Southold Town Planning Board has determined that this proposed action is consistent with the policies of the Town of Southold Local Waterfront Revitalization Program; and be it further RESOLVED, that the Southold Town Planning Board grants Approval to the Amended Site Plan entitled "3595 Skunk Lane Cutchogue" prepared by Barrett, Bonacci &Van Weele, PC, dated December 2, 2020 and last revised June 11, 2021 and authorizes the Chairman to endorse the Site Plan, which consists of 2 pages. Relevant farming Code sections include: o § 280-97 Right to farm ® (A) The Town Board of the Town of Southold finds that farming is an essential activity within the Town of Southold. Farmers provide fresh food, clean air, economic diversity and aesthetic open spaces to all the citizens of our Town. In addition, land in agricultural uses requires less tax dollars for services than does land with residential or commercial development. Accordingly, farmers shall have the right to farm in Southold without undue interference from adjacent landowners or users. For the purpose of reducing future conflicts between people residing on tracts adjacent to farmlands and farmers, it is necessary to establish and give notice of the nature of the farming activities to future neighbors of farmland and farming activities. • (B) Agricultural activities conducted on farmland, undertaken in compliance with applicable federal, state, county and Town laws, rules and regulations, are presumed to be good agricultural practices and presumed not to adversely affect the public health safety and welfare. We find that whatever nuisance may be caused to others by such uses and activities, so conducted, is more than offset by the benefits from farming to the community. These activities may occur on holidays, Sundays and weekends, at night and in the day. Such activities are presumed to be reasonable. Such activities do not constitute a nuisance unless the activity has a substantial adverse effect on the public health, safety and welfare. In addition to sight line constraints and existing topography, there is the amount of traffic to consider relative to Skunk Lane and Leslie Road. This section of Skunk Lane is the only access to over 560 homes and one commercial marina. In contrast, Leslie Road provides access to about 200 homes, and all have optional routes (except for the 21 homes located on Leslie Road). Based on these numbers, Skunk Lane has at least three times more traffic than Leslie Road. V: Planning Board items to consider: 1. The company "Indian Neck 11,LIC" I will assume is named after it's present location so let it's road entrance/exit continue to stay on Indian Neck Lane. The traffic on Skunk Lane is already at a max with new construction in Nassau Point and surrounding area. Also the speed limit past my house #3300 Skunk Lane and that of our neighbor's homes who are also concerned over this application is currently 40 mph which we have been trying to get lowered. I sometimes have to run across the street to mailbox because the cars literally fly down the road! I intend on attending the Zoom Public Hearing, Here is a summary of my concerns: 1. 1.The proposed curb cut and ingress/egress road proposed to connect Indian Neck Farm to Skunk Lane will adversely affect the present character of the neighborhood and will disturb the peace and quiet of the properties adjacent to the proposed cut, as well as dramatically increase traffic volume and interrupt traffic flow on the stretch of Skunk Road between the intersection of Leslie Road and the proposed cut. 2. 2. This is underscored by the fact that the proposed cut is requested in connection with the closure of an existing curb cut to the farm on Indian Neck Lane. So we're not talking about creating an additional roadway to the farm, but making the Skunk Lane cut the only roadway to the farm. 3. 3. The installation of deer fencing around the perimeter of the farm has already interrupted the ability of wildlife to move south & north on the eastern side of Skunk Lane, and causes all wildlife to either pass through a narrow access corridor through my yard, or go out onto the Skunk Lane roadway. We're not only talking deer, but wild turkeys, raccoons, etc. The construction of a roadway to connect the farm to Skunk Lane will further disrupt if not totally prevent the movement of wildlife for the entire eastern side of Skunk Lane, spanning from the road all the way to Peconic Bay. 4. 4. The location of the proposed cut on Skunk Lane is on a curve, and is a particularly precarious location to construct an ingress/egress that potentially will have a high traffic volume of cars, trucks and farm equipment braking and turning or pulling out. 5. S. The present situation is that vehicles rarely obey the speed limit on Skunk Lane south of Leslie Road, or for that matter south of Main Road (Rt 25). Vehicles speed past our homes on Skunk Lane on their way to and from Nassau Point, and it gets much worse during the summer when many of the homes on Nassau Point have summer residents or rentals. I don't even know what the speed limit actually is on that portion of the road. There is a 40 MPH speed limit sign posted at the beginning of Skunk Lane as one turns onto Skunk from the Main Road (Rt 25), but there are no other speed limit signs along the road until Nassau Point, where the speed lirnit is posted as 30 MPH. I had submitted a petition to Southold Town signed by over 25 of my neighbors in 2015, to reduce the Skunk Lane speed limit to 30 MPH and to post more speed limit signs along Skunk Lane, but Southold Town never took any action. I was told by Town Attorney Duffy that the petition was forwarded to the County, but he had no information for me as to status or next steps. I called several times to follow up on the petition status, but Mr. Duffy eventually stopped returning my calls. 6. 6. The farm property that borders the eastern side of Skunk Lane is particularly dangerous for the numerous pedestrians, dog_was k.ers, joggers and bicyclists who make use,of.the roadway ..The berm or7 the road heading south is practically non- existent, and the steep embankment makes it virtually impossible for a pedestrian to get out of the roadway when a car is heading north. This gets even more challenging during the summer months when the weeds along the berm grow tall, thereby increasing the tick risk for passersby trying to get out of the way of passing cars 1 7. 7. The approval of the curb cut and the construction of a roadway on the property between my house and the house on the south side of the property in question (the Cottrell residence) will change the character of our properties and introduce commercial vehicle traffic through what was previously a lovely little forest thicket with a vibrant wildlife and bird population. This will adversely affect not only the property value of my home, but the surrounding homes in the neighborhood as well. Personally, it will not only affect my property on the front road and on the side of my property, but also in the back, where I will be in visual and audio range of vehicles traveling to and from the far end of the farm, where all the farm buildings are located, down the mile-plus road to the far end of the farm property on Skunk Lane, to come and go. 8. 8. Based on these numbers, Skunk Lane has at least three times more traffic than Leslie Road. 3.
