ROBERT AND STEPHANIE SWING#7356 -Request for Variances from Article III, Section 280-15; Article XXIII, Section 280-124; and the.Building Inspector's September 19,2019 Notice of Disapproval based on an application for a permit to construct an accessory swimming pool and to legalize an"as built" second story deck addition to an existing single family dwelling at, 1) swimming pool located in other than the code permitted rear yard; 2)more than the code permitted maximum lot coverage of 20%; located at 1745 Bay Shore Road, (Adj.to Pipe's Cove) Greenport,NY. SCTM# 1000-53-4-7. The proposed action has been reviewed to Chapter 268, Waterfront Consistency Review of the Town of Southold Town Code and the Local Waterfront Revitalization Program(LWRP)Policy Standards. Based upon the information provided on the LWRP Consistency Assessment Form submitted to this department, as well as the records available to me,the proposal is recommended as INCONSISTENT with the below LWRP policies. Policy 1. Foster a pattern of development in the Town of Southold that enhances community character, preserves open space, makes efficient use of infrastructure, makes beneficial use of a coastal location, and minimizes adverse effects of development. The proposed location of the pool does not minimize adverse effects of development by proposing the pool partially located in the side yard with a setback of 10 feet to a tidal wetland and increasing lot coverage to 21.9 percent over the maximum allowable lot coverage of 20 percent. The proposal is not supported and does not meet this policy. It is recommended that the pool is redesigned and relocated to meet this policy. Policy 4 Minimize loss of life, structures, and natural resources from flooding and erosion. Chapter 275 Wetlands and Shorelines administered by the Southold Town Board of Trustees requires a setback of 50' from a tidal wetland to a pool and related structures. The proposed pool is located 10' from the wetland (bulkhead) and within the AE FEMA flood zone. The base flood zone elevation was i l not provided on the survey. It is recommended that the Board require that the applicant provide the base flood elevation. This policy does not support the construction of structures(pools)within areas subject to the risk of flooding and potential loss. Policy 4.1 A. recommends that to minimize potential loss and damage, structures should be located as far from flooding hazards as possible. The proposed action does not meet this policy. It is recommended that the pool is relocated to achieve the greatest setback from the waterbody/wetland as possible. Policy 6.2 Protect and restore Significant Coastal Fish and Wildlife Habitats. Pipes Cove is a Significant Coastal Fish and Wildlife Habitat. These habitats have experienced human disturbance resulting from adverse effects of adjacent land uses. The parcel is within the designation. Policy 6.3 Protect and restore tidal and freshwater wetlands. Wetlands within the Town of Southold are critical natural resources that provide benefits including: open space, habitat for fish and wildlife, water quality enhancement,flooding and erosion protection, scenic value, and opportunities for environmental education. Wetlands and their benefits are also dependent upon the condition of adjacent lands which directly positively or negatively impact the systems. Development in watersheds and in close proximity to wetlands has resulted in loss and impairments to the wetlands and their functions; cumulatively impacting the Town of Southold's ecosystem. Setbacks are required to help mitigate the direct and indirect adverse impacts from development. The proposed action does not meet this policy. It is recommended that the pool is relocated to achieve the greatest setback from the tidal wetland as possible. Pursuant to Chapter 268 the Southold Town Zoning Board of Appeals shall consider this recommendation in preparing its written determination regarding the consistency of the proposed action.
