Disapproval based on an application to construct an accessory garage; at, 1) located in other than the code
permitted rear yard; 2) located less than the code required front yard setback of 40 feet; 3)located less that the

The proposed action has been reviewed to Chapter 268, Waterfront Consistency Review of the Town of Southold
Town Code and the Local Waterfront Revitalization Program(LWRP)Policy Standards. Based upon the
information provided on the LWRP Consistency Assessment Form submitted to this department, as well as the
records available to me, it is my recommendation that the action is CONSISTENT with the Policy Standards and
therefore is CONSISTENT with the LWRP.
Pursuant to Chapter 268,the Southold Town Zoning Board of,Appeals shall consider this recommendation in
preparing its written determination regarding the consistency of the proposed action.

The proposed accessory garage is not permitted on this non-conforming 30,507 square foot parcel pursuant to
Article III, Section 280-15, which states;
"In the Agricultural-Conservation District and Low-Density Residential R-80 R-120 R-200 and R-400
Districts accessory buildings and structures or other accessory uses shall be located in the required rear
ard."
The proposed garage is partially located in the side and front yards.
Section 280-15F, states,
"In the case of a waterfront parcel accessory buildings and structures may be located in the front yard,
provided that such buildings and structures meet the front-yard setback requirements set forth by this
code and the side yard setback requirements for accessory buildings in Subsection B..."
Pursuant to Article XXIII Section 280-124 a minimum front yard setback of 40 feet is required and Section
280-15B notes a required side/rear yard setback of 22' on a building of this size.
Theproposed garage notes a front yard setback of 12' 8"and a rear yard setback of 9' 10".

REASONS FOR APPEAL
1) An undesirable change will not be produced in the CHARACTER of the neighborhood or a
detriment to nearby properties if granted, because the proposed non-habitable, accessory
garage will be in keeping with the design style and scale of neighboring structures.
Furthermore, the proposed structure will be located against an existing hillside and in an
driveway area that is recessed below surrounding grade by virtue of retaining walls, making
the structure and its proposed height less prominent. Large, mature oak trees screen the
proposed building, and will be supplemented with evergreen screening.
2) The benefit sought by the applicant CANNOT be achieved by some method feasible for
the applicant to pursue, other than an area variance, because the shape of the property, a
long narrow triangle along a curving line of the road, and the dramatic topographic contours of
the site are such that there.is no level, conforming building envelop that could accommodate
the accessory building.
3) The amount of relief is not substantial because there is no other place on the property
which provides a conforming location for this accessory structure. Any other location would
require similar variance, or that the garage be built underground, on the water side of the
house, due to the extreme topographic conditions, or in the location of the sanitary system,
which is enclosed by a required retaining wall, per Health Department standards. Also, the
proposed building will not be served with water or sanitary; and the space will not be
conditioned. Furthermore, by locating structure in an existing 'disturbed' area, at maximum
distance from wetlands, existing topographic site features and vegetation can be preserved.
4) The variance will NOT have an adverse effect or impact on the physical or environmental
conditions in the neighborhood or district because, as stated above, it will be constructed on
existing level ground, nearly surrounded by retaining walls and vegetation. Storm water will
directed to sub-surface drainage rings.
5) The alleged difficulty has NOT been self-created, as the site configuration and natural
features necessitate the positioning of the new accessory building in the location that has
been proposed.
There are NO Covenants nor Restrictions concerning this land.
'This is the MINIMUM that is necessary and adequate, and at the same time preserve and
protect the character of the neighborhood and the health, safety and welfare of the
community.
