Based upon the information provided on the LWRP Consistency Assessment Form submitted to this department, as well as the records available to me,the proposed"as built fence" is recommended as INCONSISTENT with the below LWRP policies. Policy 1. Foster a pattern of development in the Town of Southold that enhances community character,preserves open space, makes efficient use of infrastructure, makes beneficial use of a coastal location, and minimizes adverse effects of development. The as-built fence was constructed without obtaining required review or permits. As-built development does not minimize adverse effects of development by setting precedent and reinforces a traditional land use pattern of the Town of Southold that is not supported. The proposed action does not meet this policy. The pergola is EXEMPT from review. Pursuant to Chapter 268,the Southold Town Zoning Board of Appeals shall consider this recommendation in preparing its written determination regarding the consistency of the proposed action. The findings of the Board are that the applicant has plenty of area between her house and Soundview Avenue to place a 10 by 12 foot storage shed among the trees. The Board is in agreement with the reasoning 'of the Applicant. FINDINGS OF FACT/REASONS FOR BOARD ACTION: The Zoning Board of Appeals held a public hearing on this application on January 3,2018at which time written and oral evidence were presented. Based upon all testimony,documentation,personal inspection of the property and surrounding neighborhood, and other evidence,the Zoning Board finds the following facts to be true and relevant and makes the following findings: 1. Town Law $267-b(3)(b M. Grant of the variance will not produce an undesirable change in the character of the neighborhood or a detriment to nearby properties. The existing residence has a non-conforming bluff setback and any addition to the existing residence on the seaward side would require the benefit of an area variance. 3. Town Law $267-b(3)(b)(3). The variance granted herein is mathematically substantial,representing 49%relief from the code. Hbwever, the existing residence-is-5-5.8 feet-fturn--tb"lufand-tb"dditional-vw-iance relief is requested to accommodate a small second floor balcony. The applicant stated that the proposed balcony will be cantilevered into the framing of the house; and therefore, will not need any additional excavation or concrete footings disturbing the bluff. 4. No evidence has been submitted to suggest that a variance in this residential community will have an adverse impact on the physical or environmental conditions in the neighborhood. However, the LWRP coordinator recommends that the existing sanitary system be upgraded to an UA OWTS sanitary system, and that a vegetated non-turf buffer be installed along the bluff with planted vegetation native to the area.
