FABRIO GRANATO #7305 S CTM#1000-104-13-2.4. FABRIO GRANATO #7305—Request for a Variance from Article XXIII, Section 280-124 and the Building Inspector's March 22, 2019 Notice of Disapproval based on an application to demolish an existing dwelling and construct a new single family dwelling; at, 1) located less than the code required minimum rear yard setback of 50 feet; located, at 1725 Nassau Point Road, (Adj. to Hog Neck Bay) Cutchogue,NY. SCTM No. 1000-104-13-2.4. The proposed action has been reviewed to Chapter 268, Waterfront Consistency Review of the Town of Southold Town Code and the Local Waterfront Revitalization Program(LWRP) Policy Standards. Based upon the information provided on the LWRP Consistency Assessment Form submitted to this department, as well as the records available to me, it is my recommendation that the actions are INCONSISTENT with the below denoted Policy Standards and therefore are INCONSISTENT with the LWRP. 4.1 Minimize losses of human life and structures from flooding and erosion hazards. A. Minimize potential loss and damage by locating development and structures away from flooding and erosion hazards. 3. Move existing development and structures as far away from flooding and erosion hazards as fracticdl.- Mdintdining existing development and structures in hazard areas may be warranted for: a. structures which functionally require a location on the coast or in coastal waters. The single family residence does not require a coastal location b. water-dependent uses which cannot avoid exposure to hazards. The single family use is not a water dependent use. d. sites where relocation of an existing structure is not practical The reduction of the setback does not meet this policy and does not mitigate all risks involved with a major storm. The FEMA flood zone is AO where the structure is proposed to be reconstructed and this creates a situation in where the structure(s) are still at risk from flooding. AO designated areas are: "subject to inundation by 1-percent-annual-chance shallow flooding (usually sheet flow on sloping terrain) where average depths are between one and three feet. Average flood depths derived from detailed hydraulic analyses are shown in this zone Mandatory flood insurance purchase requirements and floodplain management standards apply. " A portion of the structure (wood deck, steps) is located in the VE flood zone. These areas are: "subject to inundation by the 1 percent-annual-chance flood event with additional hazards due to storm-induced velocity wave action. Base Flood Elevations (BFEs) derived from detailed hydraulic analyses are shown. Mandatory flood insurance purchase requirements and floodplain management standards apply. " The proposed location of the structure in this vulnerable area is highly susceptible to damage and loss over time during times of major storms events including hurricanes. There is ability to relocate the deck and steps to outside of the VE flood zone.
