The proposed action has been reviewed to Chapter 268, Waterfront Consistency Review of the Town of Southold Town Code and the Local Waterfront Revitalization Program(LWRP)Policy Standards. Based upon the information provided on the LWRP Consistency Assessment Form submitted to this department, as well as the records available to me, it is my recommendation that the actions are INCONSISTENT with the below denoted Policy Standards and therefore are INCONSISTENT with the LWRP. In 2009,the Board of Trustees issued a permit(7178)for replacement the seawall and stone armoring due to wash-outs and erosion of the bluff as result of storm damage. 4.1 Minimize losses of human life and structures from flooding and erosion hazards. A. Minimize potential loss and damage by locating development and structures away from,flooding and erosion hazards. 1. Avoid development other than water-dependent uses in coastal hazard areas. Locate new development which is not water-dependent as far away from coastal hazard areas as practical. b. Avoid hazards by siting structures to maximize the distance from Coastal Erosion Hazard Areas. The single family use(pool) is not a water dependent use. The proposed setback from the top of bluff to the swimming pool is proposed at 65 feet where 100 feet is required. Historical storm events have even eroded land areas in this stretch of coastline at accelerated rates resulting in repeated property damage. The house conformed to the zoning setbacks which were measured from the bulkhead. The bluff is a low bank which is protected by a new steel bulkhead.A previous vinyl bulkhead failed in 3/2018. The bulkhead and bank have been restored. The proposed detached in-ground swimming pool is proposed between the existing patio and the existing above grade wood deck. The proposed pool will be set back no closer than 63 feet from the top of bluff. The placement of the pool west of the existing wood deck creates a "side yard" location. The proposed pool will be on grade and be no closer to the top of the bank than the existing deck and existing patio. The neighboring properties are all much closer to the top of the bluff. The house and pool will be set back farther from the top of the bluff then the development of the neighboring waterfront homes. An in-ground pool on Sound-front lots is a common amenity desired by many waterfront property owners. The Board has considered applications for in-ground swimming pools adjacent to the bluff has been considered by the Board in the following variances: Appeal #4976 in 2001,Appeal #6237 in 2009,Appeal #6750 in 2014-all these appeals were granted along Soundview Avenue. (2) The benefit sought by the applicant CANNOT be achieved by some method feasible for the applicant to pursue,other than an area variance, because: The pool is proposed between two existing accessor structures (patio and deck). The sanitary system is in the frontyard. The only other alternative location for the pool would be in the side of the house which is also a non-conforming location. The family would prefer to place the pool behind the house between the two outdoor seating areas of the patio and deck. (3) The amount of relief requested is not substantial because: The house and accessory structures were constructed prior to the change to the code. The pool would have been conforming if measured from the bulkhead. The existing bluff is low and protected by a steel bulkhead and natural vegetation. Water weighs less than soil and the pool is a detached accessory structure, any catastrophic event to the bulkhead will not impact the home. (4) The variance will NOT have an adverse effect or impact on the physical or environmental conditions in the neighborhood or district because: The proposed pool is set back a safe distance from the top of the bluff and @100' from the steel bulkhead. (5) Has the alleged difficulty been self-created? ( )Yes, or ( X)No. the code has changed requiring a variance from the top of the bank/bluff rather than the protective structure,the bulkhead.
