RACHEL MURPHY#7295-Request for Variances from Article III, Section 280-15; Article IV, Section 280- 18; Article XXII, Section 280-116A(1); and the Building Inspector's February 14, 2019,Notice of Disapproval based on an application for a building permit to demolish an existing single family dwelling and construct a new single family dwelling and an accessory in-ground swimming pool; at; 1) proposed swimming pool located in other than the code required rear yard; 2) proposed construction is more than the code permitted maximum lot coverage of 20%; 3) proposed construction of the single family dwelling is located less than the code required 100 feet from the top of the bluff; at: 21695 Soundview Avenue, (Adj. to the Long Island Sound), Southold,NY. SCTM#1000-135-1-7. The proposed action has been reviewed to Chapter 268, Waterfront Consistency Review of the Town of Southold Town Code and the Local Waterfront Revitalization Program(LWRP)Policy Standards. Based upon the information provided on the LWRP Consistency Assessment Form submitted to this department, as well as the records available to me, it is my recommendation that the actions are INCONSISTENT with the below denoted Policy Standards and therefore are INCONSISTENT with the LWRP. The proposed single family dwelling exceeds the maximum allowable lot coverage in an area subject to frequent coastal storms. In 2009,the Board of Trustees issued a permit for restoration of the bluff that washed-out and eroded as a result of storm damage. 4.1 Minimize losses of human life and structures from flooding and erosion hazards. A. Minimize potential loss and damage by locating development and structures away from flooding and erosion hazards. 1. Avoid development other than water-dependent uses in coastal hazard areas. Locate new development which is not water-dependent as far away from coastal hazard areas as practical. b. Avoid hazards by siting structures to maximize the distance from Coastal Erosion Hazard Areas. The single family use is not a water dependent use. The construction of a single family residence further landward than the existing structures, furthers this policy, however, it does not mitigate all risks involved with a major storm. The proposed setback from the top of bluff is proposed at 26.1 feet where 100 feet is required. The small size of the buildable area of the parcel and proposed structure placement coupled with the increase in lot coverage to greater that the 20 percent creates a situation in where the structures are still at risk in a highly vulnerable area. The increase in size(percent cover) of structures is not supported. The closest setback to the CEHA is 2' (covered porch). Historical storm events have eroded the bluff seaward of the CEHA line along the Long Island Sound shore even when armored. The proposed location of the structure and increase in structure size in this vulnerable area is highly susceptible to damage and loss over time during times,of major storms events including hurricanes. Subject parcel(center). m It is recommended that the proposed single family structure is modified to meet Chapter 280 lot coverage requirements and maximize the distance from the Coastal Erosion Hazard Area to the extent practicable. In the event that action is approved verify the adequacy of the sanitary system shown on the plan. An UA OWTS is recommended if space is available. The demolishing of the existing single family structure is recommended as CONSISTENT. (1) An undesirable change will not be produced in the CHARACTER of the neighborhood or a detriment to nearby properties if granted, because: The property is presently improved with a large pre-existing non-conforming house located 10' from the top of the bluff and within the Coastal Erosion Hazard Line. The owner has the option of renovating the existing house, however, it would be prudent to increase the setbacks from the top of the bluff and out of the Coastal Erosion Hazard Area The existing house, at 10 feet from the top of the bluff, would be demolished, and the new house is proposed landward of the existing house, 26.1 feet (8' covered porch) from the top of the bluff and landward of the Coastal Erosion Hazard Line. The proposed house has been moved closer to the street in order to increase the setbacks to the top of the bluff. The average front yard setback on Sound View Avenue is 25.2 feet. The house is proposed at 33' from the front yard. The house could be moved towards the street a few feet, if recommended. The proposed house has been moved away from the top of the bluff sufficiently to maintain the character of the neighborhood. The property is protected by a significant sea wall and vegetated bluff. The existing house has been in the same family (Levin Family) for over 55 years. (2) The benefit sought by the applicant CANNOT be achieved by some method feasible for the applicant to pursue, other than an area variance, because: The existing house is only 10 feet from the top of the bluff and within the Coastal Erosion Hazard Line. The existing house is large, two stories and 2,194 square feet with a detached garage. The proposed' house is also two stories but only 2,099 square feet. The additional square footage is outside living areas with covered porches. The garage is connected to the house. The existing garage would also be demolished. A new house would be constructed to energy code and hurricane code standards, have proper drainage, and an updated sanitary system. Overall a benefit to the community and to the applicant. Comparison of the existing house to the proposed is as follows: Existing: Proposed: House 2,228 sq.ft. 2,099 sq.ft. Covered porch 613 sq.ft. 1,356 sq.ft. Garage 717 sq.ft. 576 sq.ft. Shed 101' sq.ft. 0 Pool 0 512 sq.ft. Total sq.ft.,: 3,659sq.ft. 4,543 sq.ft. The house size was reduced in order to increase the outdoor living space under the covered porch. In order to maintain the architectural style and balance of the roof lines and porches the overhangs of the roof is the same on both the east and west side of the house. The garage was also reduced. The pool in the side yard, on grade, is conforming to the required side yard setbacks. In order to maximize the setbacks to the top of the bluff the in-ground pool is proposed in a "side yard" on grade and the patio around the pool is also on grade. (3) The amount of relief requested is not substantial because: The variance numerically is substantial because the requirement is 100', however, the buildable area landward of the top of the bluff is, only 20,462 on a one acre parcel. The alternative is to retain the existing house which is within the Coastal Erosion Area and only 10' from the top of the bluff. The proposed project will be significantly more conforming to zoning setbacks than the existing house. (4) The variance will NOT have an adverse effect or impact on the physical or environmental conditions in the neighborhood or district because: The property is very protected by a sea wall and a low & stable bluff. The house will be constructed with- updated materials and an updated sanitary system. (5) Has the alleged difficulty been self-created?
