The granting of the requested variance relief necessary to locate the proposed swimming pool and associated raised masonry patio in a side yard will not cause an undesirable change to the character of the neighborhood or cause a detriment to any nearby properties. Swimming pools are a common feature of the surrounding residential community located south of New Suffolk Avenue between the shorelines of the northerly extending arms of Deep Hole Creek located to the west and east of U-shaped Deep Hole Drive. As a 1.2-acre waterfront property, the subject lot is most similar to those located along the east shoreline of the arm of Deep Hole Creek running along the east side of Deep Hole Drive. Like the subject property, these lots should be large enough to locate a swimming pool in the rear yard, but the presence of tidal wetlands and the associated wetland setbacks and vegetated non-disturbance buffers constrain use of the rear yard and effectively preclude such placement. Such wetland constraints thus led to variance relief being granted for the construction of swimming pools in side yards on two lots on Willis Creek Drive (Case Nos. 5239 and 7043), for example, and here the presence of nearly 12,000 square feet of tidal wetlands and a 25' wide non-disturbance buffer landward of wetlands similarly preclude placement of a pool in the rear yard. With respect to any potential impact on the northerly adjacent property associated with placement of the pool and patio in the northerly side yard, it should be noted that the pool is proposed 20 feet from the northerly property line, which is 5 feet farther form the property line than the 15' side yard setback required for swimming pools pursuant to Section 280-15(E). Moreover, the pool and patio, including the`water wall feature that extends two feet above the pool elevation, will be screened from the northerly neighbor by 1) an existing hedgerow and row of substantial evergreen trees located along the northerly property line; and 2) additional vegetation proposed on the north side of the patio and water wall feature in particular (see color renderings enclosed with application). The applicant would also be agreeable to placing the pool equipment in a sound deadening enclosure. The pool will also be largely obscured from view from the property across the street by a proposed detached garage in the front yard, which does not require variance relief and is thus not the subject of this application. 2. As described above, due to the presence of tidal wetlands and associated non-disturbance buffer located to the west of the house, there is no room to place a swimming pool and surrounding patio lkobU E. Due to the orientation of the existing house, the pool would actually be located in the applicant's de facto front yard, but it is deemed to be located in a regulatory side yard because it is not proposed to the roadside of the dwelling. Although there is room to place the pool farther east and in the regulatory front yard, locating the pool closer to the road would result in the pool becoming more visible from the road and to the neighbor across the street but would not result in it being moved any farther from the adjacent neighbor to the north. In fact, since a front yard location would require the pool to be undesirably located to the side of the driveway and parking area, the pool would reasonably be shifted as far from the driveway as possible and thus closer to the northerly property line. Therefore, seeking the requested variance would result in greater benefit to the applicant and lesser potential impact on the neighbors than a pool located in the front yard on this property. 3. The requested relief will be considered substantial because placement of the pool and patio in a side yard will be deemed to require 100 percent relief from the code. However, the relief is not substantial in fact because the pool would be located farther from the side lot line than permitted by code and more than if the pool were relocated to the front yard. Moreover, there would be no potential "crowding" effect caused by the pool on the side yard from the perspective of the public roadway, as the pool will be located farther from the road than it would be in a conforming front yard location and to the rear of the detached garage proposed in a conforming front yard location. 4. As described throughout the application, the need for the requested variance is created by the need and desire to locate the proposed pool so that it does not adversely impact the tidal wetlands or vegetative non-disturbance buffer located to the rear of the house. As proposed, the pool and patio will in fact be located more than 100 feet from wetlands and thus outside the jurisdiction of Chapter 275, Wetlands. (A Letter of Non jurisdiction issued by the Board of Trustees for the pool and patio is enclosed with the application). The pool and patio are also proposed to be elevated approximately 18 inches above grade to avoid the need to dewater the pool during construction and impacting the groundwater table (see construction drawings enclosed with application); and pool discharge will be directed to a proposed drywell. Therefore, granting of the requested variance relief will not have an adverse impact on the physical and environmental conditions of the property or surrounding neighborhood. 5. The difficulty creating the need for area variance is arguably self-created because the property was purchased by the applicant after the zoning limitations creating the need for variance were adopted, and it is therefore presumed that the applicant had actual or constructive knowledge of these limitations at the time of purchase. Therefore, in accordance with the current Wetlands Code (Chapter 275) and the Coastal Erosion Hazard Area (Chapter 111) no permit is required.
