SUFFOLK COUNTY ADMINISTRATIVE CODE: This application was referred as required under the Suffolk County Administrative Code Sections A 14-14 to 23, and the Suffolk County Department of Planning issued its reply dated February 24, 2020 stating that this application is considered a matter for local determination as there appears to be no significant county-wide or inter-community impact. LWRP DETERMINATION: The relief, permit, or interpretation requested in this application is listed under the Minor Actions exempt list and is not subject to review under Chapter 268. PROPERTY FACTS/DESCRIPTION: The subject, conforming, +-925,214.4 square feet, 21.24 acre, irregularly shaped lot located in the Hamlet Density (HD) District measures 217.51 feet (deed) 216.51 feet (actual) from the southeast corner site entrance at Griffing Street, then runs north 400.00 feet along lands owned by the Roman Catholic Church of the Sacred Heart, then turn west 407.11 feet along the same neighbor and turns north 2009.51 feet (deed) 2009.22 feet (actual) along nine residentially developed lots then turns east 521.03 feet and continues 145.28 feet after a slight bend along two residences, then turns south 221.47 feet before running east 563.41 feet (deed) 562.84 feet(actual) along two residences, then returns south 1901.44 feet(deed) 1904.80 feet(actual) along farm fields,then runs southwest on a slight diagonal 210.23 feet(deed) 208.04 feet(actual)then turns south 273.68 feet (deed) 269.77 feet (actual) then runs west 170 feet (deed) 167.99 feet (actual) then returning 95 feet to the southeast corner of the site. The property is improved (currently under construction) with 124 condominium units, a road network including parking areas, a community center and pool, and a tennis court with fencing subject of this application as shown on the Overall Layout and Materials Plan, labeled C-2.0, for Harvest Pointe At Cutchogue by VHB Engineering, Surveying & Landscape Architecture, PC signed by Angelo V. Laino, Licensed Professional Engineer and dated July 10, 2015 and approved by the Southold Town Planning Board dated September 26,2017. BASIS OF APPLICATION: Request for a Variance from Article XXII, Section 280-105A and the Building Inspector's January 23, 2020 Notice of Disapproval based on an application for a permit to construct a 10 foot high Page 2,July 16,2020 #7398, Rimor Development LLC SCTM NO 1000-102-1-33.8 fence surrounding a tennis court; at 1) more than the code permitted four(4)feet in height when located in the front yard; located at: 51 Millstone Lane(Harvest Point Lane), Cutchogue,NY. SCTM No. 1000-102-1-33.8. RELIEF REQUESTED: The applicant requests a variance to install a 10-foot-high fence around a previously approved tennis court in the front yard where the code limits such installations to a height of 4 feet. ADDITIONAL INFORMATION: No member of the public or immediate neighbor spoke for or against this application during the hearing, however, a written letter was received from the adjacent property owner to the south requesting that landscape screening be planted to hide the tennis court fence from their view. The Southold Town Planning Board previously approved a landscaping plan, as part of site plan approval, submitted by VHB Engineering, Surveying&Landscape Architecture,PC, labeled L-1 approved September 26, 2017 which includes a 50-foot-wide `natural buffer area' immediately behind the proposed tennis court and fence location. The proposed fence, black vinyl coated chain-link, surrounding the previously approved tennis court is to be located in the `reserve' open space area. Based upon visual inspection of the site and a site plan approved by the Southold Town Planning Board, it is confirmed that the 50-foot natural buffer exists and therefore no further landscaping is required by the Board of Appeals with regard to this application. FINDINGS OF FACT/REASONS FOR BOARD ACTION: The Zoning Board of Appeals held a public hearing on this application on July 9, 2020 at which time written and oral evidence were presented. Based upon all testimony, documentation, personal inspection of the property and surrounding neighborhood, and other evidence,the Zoning Board finds the following facts to be true and relevant and makes the following findings: 1. Town Law &267-b(3)(b)(I). Grant of the variance will not produce an undesirable change in the character of the neighborhood or a detriment to nearby properties. The subject property is part of a larger development approved by the Southold Town Planning Board, which also approved the location of the tennis court, with a four feet high fence, in the front yard of a 124-unit condominium complex as part of the site plan review process. Furthermore, given the nature of the project in the Hamlet Density zone, with commercial uses to the south and a religious institution and school to the west, the increased height in fencing will hardly be noticeable to the general public and residents of the Harvest Pointe condominium neighborhood. 2. Town Law §267-b(3)(b)(2). The benefit sought by the applicant cannot be achieved by some method, feasible for the applicant to pursue, other than an area variance. The tennis court has been approved by the Town of Southold Planning Board in its current non-conforming front yard location where only a 4 feet high fence/backstop. Is permitted by code. However, a 4 feet high fence is unreasonably low to contain the sport in its designated area and in order to safely `play' tennis a higher fence is required which will require variance relief. 3. Town Law 4267-b(3)(b)(3). The variance granted herein is mathematically substantial, representing 60%relief from the code. However, the applicant proposes to install a black vinyl-coated chain-link fence which is less visually intrusive than other fencing. Furthermore, as part of the site plan approval process the applicant has left a `natural' buffer of 50 feet surrounding the perimeter of the site, including the area adjacent to and immediately behind the tennis court fencing. 4. Town Law §267-b(3)(b)(4). No evidence has been submitted to suggest that a variance in this residential community will have an adverse impact on the physical or environmental conditions in the neighborhood. The applicant must comply with Chapter 236 of the Town's Storm Water Management Code. 5. Town Law &267-b(3)(b)(5). The difficulty has been self-created. The applicant purchased the parcel after the Zoning Code was in effect and it is presumed that the applicant had actual or constructive knowledge of the Page 3,July 16,2020 #7398,Rimor Development LLC SCTM NO. 1000-102-1-33.8 limitations on the use of the parcel under the Zoning Code in effect prior to or at the time of purchase. While the applicant could have placed the tennis court in a rear-yard location of the condominium complex, the Planning Board approved site plan included its location at the front gate area, in a flat area that is conveniently accessible to most of the residents in the complex. 6. Town Law §267-b. Grant of the requested relief is the minimum action necessary and adequate to enable the applicant to enjoy the benefit of a 10 foot high fence (surrounding a previously approved tennis court) while preserving and protecting the character of the neighborhood and the health, safety and welfare of the community. RESOLUTION OF THE BOARD: In considering all of the above factors and applying the balancing test under New York Town Law 267-13, motion was offered by Member Planamento, seconded by Member Lehnert, and duly carried, to GRANT the variance as applied for, and shown on the Overall Layout and Materials Plan, labeled C-2.0, for Harvest Pointe At Cutchogue by VHB Engineering, Surveying&Landscape Architecture, PC signed by Angelo V. Laino, Licensed Professional Engineer and dated July 10, 2015 and approved by the Southold Town Planning Board dated September 26, 2017. , Any deviation from the survey, site plan and/or architectural drawings cited in this decision will result in delays and/or a possible denial by the Building Department of a building permit, and may require a new application and public hearing before the Zoning Board of Appeals. Any deviation from the variance(s)granted herein as shown on the architectural drawings, site plan and/or survey cited above, such as alterations, extensions, or demolitions, are not authorized under this application when involving nonconformities under the zoning code. This action does not authorize or condone any current or future use, setback or other feature of the subject property that may violate the Zoning Code, other than such uses, setbacks and other features as are expressly addressed in this action. In the event that this is an approval subject to conditions, the approval shall not be deemed effective until such time that the foregoing conditions are met; and failure to comply therewith will render this approval null and void. The Board reserves the right to substitute a similar design that is de minimis in nature for an alteration that does not increase the degree of nonconformity. Pursuant to Chapter 280-146(B) of the Code of the Town of Southold any variance granted by the Board of Appeals shall become null and void where a Certificate of Occupancy has not been procured, and/or a subdivision map has not been filed with the Suffolk County Clerk,within three (3) years from the date such variance was granted. All applications of herbicides or pesticides shall be made by a New York State Department of Environmental Conservation Certified Pesticide Applicator. 36.With respect to the use of fertilizer on the Property: a. fertilizer shall be applied only after it has been determined to be necessary by soil test, and only in the smallest amount necessary; b. only organic-based nitrogen fertilizer with a low-Nitrogen nutrient ratio and a minimum 50% of Water-Insoluble Nitrogen (WIN) shall be used; and c. fertilizer shall be applied, in any application, at a maximum rate of one (1) pound of nitrogen per 1,000 square feet of land area, and no more than two (2) pounds of nitrogen per 1,000 square feet of land area shall be applied in any calendar year. 37.Open Space prohibited and Permitted Uses The Open Space area is required to be at least 50% of the land area of the Property, and consists of a total of 23 acres, as shown on Page OS-1 of the Site Plan. Vegetation Removal or Disturbance The mowing, cutting, clearing, removal ordisturba et ti �gp `�' including trees, shrubs, and groundcover, is prohibited, except as permitted below. b. Excavation, grading, removal of materials and mining are prohibited, except where necessary for permitted activities. Mineral exploitation, and extraction by any method, surface or subsurface, is prohibited. The removal from the site of topsoil, sand, or other materials shall not take place. The topography shall not be changed except as approved by the Planning Board on the Site Plan, and there is no grading or excavation permitted in the Natural Buffer, except the minimum amount of digging necessary to create planting holes for evergreens as required to maintain a densely-vegetated screen. d. Motorized vehicles The use of motorized vehicles within the ®pen Space area is prohibited, including, but not limited to, recreational vehicles, dirt bikes, and all-terrain vehicles (ATV's), except for lawn mowers and similar maintenance equipment. e. Soil and Water Any use or activity that causes or is likely to cause soil degradation, compaction or erosion or pollution of any surface or subsurface waters is prohibited. Zl EYV ED f. Utilities The creation or placement of overhead utility transmission lines and utility poles is prohibited. Underground utilities are permitted, except in the Natural Buffer. h. Other Uses The use of the Open Space for any commercial or industrial purpose is prohibited. Other uses not permitted include paintbali, shooting ranges, swimming pools, wireless facilities or cell towers, and all uses that are not consistent with the purposes of these covenants. ii. Development Rights The use of the acreage of this Open Space for purposes of calculating lot yield, on any other property is prohibited.
