RYAN STORK #7269 - Request for a Use Variance under-Article III, Section 280-13 (C); and the
Building Inspector's November 15, 2018 Notice of Disapproval based on an application for a permit to
alter the second floor of an existing accessory garage into recreational space, at; 1)proposed recreational
space in the accessory building is not a permitted accessory use; at: 1140 Park Avenue, Mattituck (Adj.

The proposed action has been reviewed to Chapter 268, Waterfront Consistency Review of the Town of
Southold Town Code and the Local Waterfront Revitalization Program (LWRP) Policy Standards.
Based upon the information provided on the LWRP Consistency Assessment Form submitted to this
department, as well as the records available to me,the proposed action is EXEMPT from LWRP review
pursuant to:
§ 268-3. Definitions. MINOR ACTIONS item"II"which states:
II.-Additions to an existing building or rebuilt residential structure which results in no net
increase in ground area coverage, except where the parcel is located in a coastal erosion hazard
area;

the zoning regulations for the particular zone district where the property is located, as

While the proposed recreational use is allowed if attached to the primary structure,the
applicant would like,to locate this use near the other existing recreational use (swimming pool)
within an already established space.
2. The alleged hardship relating to the property is unique and does not apply to the majority
of parcels in the same zoning district or neighborhood because:
The property is not unique. However, due to the proximity of the wetlands, the applicant
decided to construct the detached garage further away from the wetlands to protect the wetlands. In
doing so, applicant also seeks to reduce any unnecessary increase in building coverage by adding a
recreation room over the existing garage rather than building an addition onto the main dwelling.
3. The requested variance, if granted,will not alter the essential character of the
neighborhood because:
If granted, the requested variance will not alter the character of the neighborhood. The
surrounding area is comprised of many similarly sized parcels that are residentially developed and
improved with pool houses and other detached accessory structures, which have recreational uses.
Moreover,the proposed use will not result in an over-development of the subject property, nor will
it bring about a significant increase in the residential use of the property. Therefore, the requested
variance will not create an undesirable change in the character of the neighborhood or detriment to
nearby properties. It needs to be noted that the existing structure, as it appears.from the exterior,
will not change if the variance is granted.
4. The alleged hardship has not bee self-created because:
While the applicant purchased the property knowing its limitations,the Board should not
require a homeowner to anticipate all future needs and property uses before one buys a property,
otherwise all subsequent nonconforming desires would be rejected as"self-created". In any event,
this factor alone shall not preclude the granting of the variance requested herein.
5. The requested relief is the minimum relief necessary to avoid unnecessary hardship,while
at the same time preserving and protecting the character,of neighborhood and the health,
safety and welfare of the community because:
The applicant submits that the requested relief would merely allow the applicant to use his
property in a manner similar to neighboring lots and is the minimal variance necessary to allow the
applicant to use his accessory structure and alleviate the applicant's practical difficulty and
hardship.

substantial justice will be done because:

A. INSTRUCTIONS
1. All applicants for permits* including Town of Southold agencies, shall complete this CCAF for
proposed actions that are subject to the Town of Southold Waterfront Consistency Review Law. This
assessment is intended to supplement other information used by a Town of Southold agency in
making a determination of consistency. *Except minor exempt actions including Building Permits
and other ministerial permits not located within the Coastal Erosion Hazard Area.
2. Before answering the questions in Section C, the preparer of this form should review the exempt
minor action list, policies and explanations of each policy contained in the Town of Southold Local
Waterfront Revitalization Program. A proposed action will be evaluated as to its significant
beneficial and adverse effects upon the coastal area(which includes all of Southold Town).
3. If any question in Section C on this form is answered "yes", then the proposed action may affect the
achievement of the LWRP policy standards and conditions contained in the consistency review law.
Thus, the action should be analyzed in more detail and, if necessary, modified prior to making a
