The reasons for Applicant's appeal of these two improper determinations are set forth below. Applicant's Building Plans Properly Include Kitchen Facilities Jack Levin, as the then owner of the subject property, submitted to the Town of Southold Building Department an application, dated April 4, 1973 (copy annexed hereto), for a building permit for construction of a new two-story building on the subject property containing"8 motel units." Such building permit application,which was accompanied by detailed building plans (copies also annexed hereto) clearly showing designated "kitchen" facilities in the "typical unit,"also designated the proposed eight(8)units as "dwelling units." Upon information and belief,under applicable Southold Town zoning code provisions at the time of the aforesaid 1973 building permit application, and thereafter, both"motel" units and"multiple dwellings"were permitted uses on the subject property. Moreover, the Town zoning code that became effective as of July 17, 1973 (copy annexed hereto) defined "motel" simply as: "A building containing guest rooms, each of which, or each pair of which, has a separate entrance leading directly from the outside of the building, with parking spaces conveniently located to each unit, and which is designed,used or intended to be used primarily for the accommodation of motor vehicle transients." As appears from the annexed 1973 building permit application, a site plan for the subject property(copy also annexed hereto)was approved by the Planning Board on May 9, 1973, and the 1973 building permit application was itself approved by issuance of Building Permit No. 6463Z on May 10, 1973. Following construction of the proposed units, and their associated kitchen facilities (see photo of typical existing kitchen facilities included with this appeal), on the subject property, the Town Building Department issued Certificate of Occupancy No.Z6709, dated September 25, 1975 (copy submitted with this appeal), which specifically states that the building constructed on the subject property"conforms substantially to the Application for Building Permit heretofore filed in this office dated April 4, 1973 pursuant to which Building Permit No. 6563Z"was issued and also "conforms to all of the requirements of the applicable provisions of the law." Certificate of Occupancy No. Z6709 also states: "The occupancy for which this certificate is issued is [illegible] (Apartment) Motel units (Multiple Residence)." -1- 6747476.1 The subject"Notice of Disapproval,"dated August 20,2018 and renewed October 17, 2018,was issued in response to an"Application for Building Permit"initially dated December 11,2017 (copy also annexed hereto). As appears from the building plans submitted with this recent building permit application (copies also submitted with this appeal),Applicant has proposed to make only modest alterations (in the nature of renovation)to the existing units on the subject property. However, as appears from the Notice of Disapproval, the Building Department has categorically refused to issue the requested building permit unless Applicant removes its legally-established, long-existing kitchen facilities and otherwise complies with the limited use definition of"Hotel or Motel, Transient"under the current Town Code.' The Building Department's refusal to issue the Applicant's requested building permit is erroneous,unwarranted, arbitrary, and capricious, and should be reversed by the Zoning Board of Appeals,because, among other things: 1. The building on the subject property, and the units therein,were approved, constructed,and issued a Certificate of Occupancy pursuant to a definition of"motel," set forth above,that included no prohibitions on cooking or kitchen facilities, and there is no legal basis for the Building Department to impose subsequently-adopted definitional restrictions to compel removal of legally-established kitchen facilities; and 2. The Building Department's insistence that Applicant comply with the restrictions of the current definition of a"transient"motel by removing the legally- established and long-existing kitchen facilities in its units is completely irrational, arbitrary, and oppressive, for the current definition of a"resort"motel in Town Code ' The current Town Code Section 280-4 defines "hotel or motel,transient,"in relevant part, as: "A building or group of buildings, whether detached or in connected units, containing individual guest units consisting of a room arranged or designed to be available for use as sleeping and living quarters for transients on a daily rental basis,provided that one such unit may connect directly with no more than one other such unit and that no cooking facilities shall be available. Each such unit shall have a door opening on the exterior of the building or on a common hallway leading to the exterior. . ."(emphasis added) -2- 6747476.1 Section 280-4,2 which does not prohibit cooking or kitchen facilities in"resort"motel units, is much more applicable to the units on the subject property, given the fact that the units on the subject property have historically been used for much longer than a"daily rental basis,"which short-term daily occupancy specifically defines"transient"motel units. Applicant's Proposed Work Does Not Require Site Plan Approval Section 280-127 of Article XXIV("Site Plan Approval") of the Southold Town Code provides,in pertinent part: "This article shall apply to every land use that is permitted in the Town of Southold except the single-family home use on a single and separate lot as set forth in Article III, § 280-13A(1), and customary nonagricultural accessory uses to a single-family residential home use as stated in the Town Code. Any change in use or intensity of use which will affect the characteristics of the site in terms of parking, loading, access drainage open space or utilities will require site plan approval. . ." (emphasis added) Insofar as the proposed work on the subject property for which Applicant has sought a building permit--which work is in the nature of renovations to the existing units and their kitchen facilities-- does not involve any change in use or intensity of use from the use that has been continuously conducted on the subject property since the building on the subject property, and the units therein,were first constructed in the 1970's, and no parking, loading, access, drainage, open space, or utilities characteristics of the subject property will be affected by the proposed work, there is no basis, under the plain terms of Town Code Section 280-127, for requiring site plan approval for the proposed work. Requests for Relief For the foregoing reasons,Applicant respectfully requests that the Zoning Board of Appeals: 2 The current Town Code Section 280-4 defines "hotel or motel,resort,"in relevant part, as: "A building or group of buildings,whether detached or in connected units, containing individual guest units consisting of a room arranged or designed to be available for use as sleeping quarters for transients on a daily rental basis or for vacationers or other persons on a weekly rental basis,provided that one such unit may connect directly with not more than one other such unit. Each unit shall have a door opening on the exterior of the building or on a common hallway leading to the exterior. . ." -3- 6747476.1 1. Interpret that Applicant's proposed work at the subject property, for which it sought a building permit, is not governed by the current restrictive definition of"Hotel or Motel, Transient"in Article I, Section 280-4 of the Southold Town Code, such definition does not require Applicant to remove the existing kitchen facilities in its existing units on the subject property, and the Building Department improperly disapproved Applicant's building permit application based on such definition,Applicant may continue to use, maintain, and renovate the existing kitchen facilities in the units on the subject property, and the Building Department may not require Applicant to comply with such restrictive definition of"Hotel or Motel, Transient,"or to remove kitchen facilities from its units in order to obtain a building permit for the proposed renovation and other work on the subject property, 2. Interpret that the Building Department did not properly determine that site plan approval is required for Applicant's proposed work on the building and units at the subject property,pursuant to Town Code Section 280-127; and 3.
