FOHRKOLB REASONS FOR APPEAL: The Applicant is seeking a side yard setback variance from the requirements of Town Code Section 280-124 that on lots measuring between 20,000 and 39,999 square feet I total size, the minimum single side yard setback is 15 feet and the minimum combined side yard setback if 35 feet by way of this appeal of the Building Inspector's Notice of Disapproval for a building permit to construct a single family dwelling with a single side yard setback of 11 feet and a total combined side yard setback of+/- 22 feet. For the following reasons, the Applicant submits that a Variance from Section 280-124 is warranted: 1. An undesirable change will not be produced in the CHARACTER of the neighborhood or a detriment to nearby properties if granted, because: The surrounding neighborhood is characterized by similar sized waterfront dwellings constructed on substandard lots. Many of the surrounding dwellings and accessory structures in the Fleet's Neck area were constructed with setback relief and are similarly sited on the properties. 2. The benefit sought by the Applicant CANNOT be achieved by some feasible method for the applicant to pursue other than an area variance, because: Variance relief is necessary to enable the Applicant to construct a modest sized house in a location that is in keeping with the character of the surrounding neighborhood. The triangular shape of the lot makes it difficult to comply with the required setbacks. 3. The amount of requested relief is not substantial because: The Applicant submits that the 27% variance from the single side yard setback and the 37% variance from the combined setback are not significant and the resulting single family dwelling will be consistent with the location and dimensions of the waterfront homes in the surrounding neighborhood. 4. The variance will NOT have an adverse impact on the physical or environmental conditions in the neighborhood or district because: As stated previously, the proposed dwelling is reasonable in size and the proposed location is consistent with similar homes in the Fleet's Neck neighborhood and respectful of the adjoining wetland. There is no perceivable environmental impact from the proposed construction. The proposed construction will also result in the removal of a pre-existing nonconforming accessory structure.
