OFFICE LOCATION: SO MAILING ADDRESS: Town Hall Annex '` P.O. Box 1179 54375 State Route 25 Southold, NY 11971 (cor. ALEXANDER WILMERDING#7259 Request for Variances under Article III, Section 280-15; and the Building Inspector's October 9, 2018, Amended October 29, 2018 Notice of Disapproval based on an application for a permit to construct an accessory gazebo, at; 1) less than the code required minimum side yard setback of 25 feet; 2) less than the code required minimum rear yard setback of 25 feet; at: Reservoir Road, (Adj. to Hay Harbor) Fishers Island,NY. SCTM#1000-9-9-3.1. The proposed action has been reviewed to Chapter 268, Waterfront Consistency Review of the Town of Southold Town Code and the Local Waterfront Revitalization Program (LWRP) Policy Standards. Based upon the information provided on the LWRP Consistency Assessment Form submitted to this department, as well as the records available to me,the proposed action is recommended as - INCONSISTENT with the LWRP. The proposed action is located within the Coastal Erosion Hazard area and is subject to Chapter 111 Coastal Erosion Hazard Area of the Southold Town Code. Policy 4. Minimizes loss of life, structures, and natural resources from flooding and erosion ArcMap indicates that slopes equal to or greater than 20 percent are located on the property(Figures 1 and 2). Further, site elevations on submitted plans indicate that a bluff occurs on property pursuant to Chapter 275 Wetland and Shorelines of the Southold Town Code. Note that the feature is labelled as a "Bank" on the plans. Southold Board of Trustees should be consulted to verify the feature. The accessory gazebo is proposed to be located within a FEMA flood zone AE elevation'11. The LWRP supports relocating non-water dependent structures outside of vulnerable areas (potential from erosion due to storm events) and as far from the natural feature as practicable. 3. Move existing development and structures as far away from flooding and erosion hazards as practical. Maintaining existing development and structures in hazard areas may be warranted for: a. structures which functionally require a location on the coast or in coastal waters. The proposed accessory gazebo does not require a'location on the coast. b. water-dependent uses which cannot avoid exposure to hazards. The use is not water dependent. C. sites where relocation of an existing structure is not practical. The accessory gazebo could be re-located landward of the top of bluff and outside of the Coastal Erosion Hazard Area. - zi• _ .h,;. ^F" -- - - - _,tSk T'+' a:. ;=a :x' rte, + br.q'2' .' •i.-.. ,, ''+. 4.0'` .a xa?,,wt° ,g S 1`_ A ."kV :• .j L' .=-S'n' t ` J`r<, :pt+r. y Y:'..+` y-. Year(s). .(Please be sure to research before completing this question or call our office for assistance) Name of Owner: ZBA File# REASONS FOR APPEAL (Please be specific, additional sheets may be used with preparer's signature notarized): 1.An undesirable change will not be produced in the CHARACTER of the neighbor or a detriment to nearby properties if granted, because: the foundation over which the gazebo will be built has been in the same location for over sixty years and is in disrepair. The addition of the gazebo will actually improve the site, and therefore have a positive impact on the character of the neighborhood. 2.The benefit sought by the applicant CANNOT be achieved by some method feasible for the applicant to pursue, other than an area variance, because: the applicant intends to use the existing foundation whose position is fixed at the pre—existing nonconforming setbacks from the rear and side lot lines. It is not feasible to move the foundation to a conforming location. 3.The amount of relief requested is not substantial because: the rear yard setback requested is 86% of the minimum required. While the side yard setback requested is only 34% of the minimum, there would be little to no impact on the neighboring property owner and other factors at play in this case outweigh the substantiality criterion. 4.The variance will NOT have an adverse effect or impact on the physical or environmental conditions in the neighborhood or district because: the gazebo will be built in a part of the property that has already been disturbed by the existing foundation. The applicant will obtain whatever permits are required and observe whatever conditions are imposed under those permits from the New York State Department of Environmental Conservation and the Board of Southold Town Trustees. 5.Has the alleged difficulty been self-created? { )Yes,or f[}No Why: The applicant is seeking the proper permits and approvals prior to construction and is not trying to legitimize an illegally built structure. He is dealing with the same conditions that have existed on the property for more than sixty years. Are there any Covenants or Restrictions concerning this land? PqNo { )Yes(please furnish a copy) This is the MINIMUM that is necessary and adequate, and at the same time preserve and protect the character of the neighborhood and the health, safety and welfare of the community. ►1 -• 1- , 1AL Signature of Applicant or Authorized Agent (Agent must submit written Authorization from Owner) Sworn to before me this day fit► Stephen L.
