Main Rd. &Youngs Ave.) 41e Southold, NY 11971 • �O� Telephone: 631765-1938 O Fax: 631 765-3136 UNTY,� LOCAL WATERFRONT REVITALIZATION PROGRAM TOWN OF SOUTHOLD MEMORANDUM To: Michael Domino, President Town of Southold Board of Trustees ' From: Mark Terry, AICP LWRP Coordinator Date: November 7, 2019 ' Re: LWRP Coastal Consistency Review for 40200 MAIN, LLC (ORIENT BY THE SEA), c/o RWN MANAGEMENT, LLC SCTM# 1000-15-9-8.1 Inter-Science Research Associates, Inc. on behalf of 40200 MAIN, LLC (ORIENT BY THE SEA), c/o RWN MANAGEMENT, LLC requests a Wetland Permit and a Coastal Erosion Permit for a Ten (10) Year maintenance and reconstruction permit for work associated with the existing marina facility which includes a potential total of 9 dredging events over the next 10 years each removing up to 600 cubic yards of material, for a total of 5,400 cubic yards of dredged material; the anticipated dredging would be conducted to a depth of-6 feet below the plan of Mean Low Water (- 6' MLW NAVD, 1988 datum) and would not include over depth dredging; removal of approximately 1,690 linear feet of existing timber bulkhead and 290 linear feet of vinyl bulkhead which would be replaced by approximately 2,005 linear feet of new vinyl bulkhead within the basin and removal of approximately 282 linear feet of steel bulkhead and replacement with 282 linear feet of new steel bulkhead along the southern portion of the property directly abutting Gardiners Bay; the new vinyl bulkhead will consist of vinyl sheets, 11" diameter lumber piles, 6"x8" lumber wales, to deadmen and backing pilings; the bulkhead would be expanded in the northeast corner by approximately 13' of the basin to square off the corner which would create approximately 230sq.ft. of new basin area; the bulkhead would be expanded in the southwest corner by approximately 1-7' of the basin to square off the corner which would create approximately 500 sq.ft. of new basin area; removal of the center main "T" shaped fixed pier which is approximately 197 feet long and"1,175sq.ft, in area; removal of eight (8) finger piers in the basin totaling approximately 225sq.ft.; reconstruction of approximately 15 finger piers in the basin totaling approximately 1,250sq.ft.; two proposed finger piers will contain wave protection boards; where existing wave protection boards will be removed from current piers; installation of a new dinghy tie-off floating dock at 4'x60' (±250sq.ft.) located along the south edge of the restaurant deck; installation, removal and replacement of pilings within the basin (approximately 111 existing pilings will be removed, 45 new 11" diameter pilings to be installed and 78 existing pilings to remain or be replaced as necessary with new 11" diameter pilings); repairs to existing boat ramp as necessary; installation of a new pump out facility located along the new expanded area of the bulkhead in the northeast corner of the basin; the pump out facility will consist of an Edson pump (model to be determined) to a 500 gallon holding tank; new electrical and water lines to the boat slips will be installed; the installation of debris booms will be erected across the channel to contain in water construction debris; the immediate areas of construction and dredging will be conducted behind a turbidity curtain; and the proposed pilings will be installed with jetting and/or pile hammers. Located: 40200 Route 25, Orient: SCTM# 1000-15- 9-8.1 The proposed action has been reviewed to Chapter 268, Waterfront Consistency Review of the Town of Southold Town Code and the Local Waterfront Revitalization Program (LWRP) Policy Standards. Based upon the information provided on the LWRP Consistency Assessment Form submitted to this department, as well as the records available to me, it is my recommendation that the proposed action is CONSISTENT with the LWRP policies and therefore CONSISTENT with the LWRP provided the following is required to further Policy 6: 1. An acceptable upland dredge spoil disposal site is secured and identified. The composition of the dredge material has not been identified and it is unknown if the material is suitable for on-site disposal near Gardiners Bay. It is recommended that the applicant have the material identified and analyzed for contaminants. 2. - If the dredge material will be trucked off-site, the impacts of truck traffic transporting material on the quality of life of residents should be considered to further Policy 1. A truck route plan is recommended. If the dredge material is disposed of on-site, it is recommended to further Policy 4 that a planted, low dune be constructed to mitigate hurricane storm surge landward of the bulkhead. Pursuant to Chapter 268, the Board of Trustees shall consider this recommendation in preparing its written determination regarding the consistency of the proposed action. All applicants for permits* including Town of Southold agencies, shall complete this CCAF for proposed actions that are subject to the Town of Southold Waterfront Consistency Review Law. This assessment is intended to supplement other information used by a Town of Southold agency in making a determination of consistency. *Except minor exempt actions including Building Permits and other ministerial permits not located within the Coastal Erosion Hazard Area. 2. Before answering the questions in Section C, the preparer of this form should review the exempt minor action list, policies and explanations of each policy contained in the Town of Southold Local Waterfront Revitalization Program. A proposed action will be evaluated as to its significant beneficial and adverse,effects upon the coastal area(which includes all of Southold Towel 3. If any question in Section C on this form is answered "yes" or "no", then the proposed action will affect the achievement of the LWRP policy standards and conditions contained in the consistency review law. Thus, each answer must be exnlainW in detail, listing both supporting and non- sunnorting facts. 'If an action cannot be certified as consistent with the LWRP policy standards and conditions,it shall not be undertaken. Work to include replacement of existing timber bulkhead sections with new vinyl bulkhead or steel, replacement of existing timber dock sections, removal of timber docks, dredge/excavate the area between the bulkheads to-6 MLW and replacement of pilings. Remove and relocate bulkhead in northeast corner approx. 13'to square out the corner and remove and relocate bulkhead in southwest corner approx. 17'to square out the corner. The property upgrades will include a pump out facility. See attached plans for details. Foster a pattern of development in the Town of Southold that enhances community character, preserves open space, makes efficient use of infrastructure,makes beneficial use of a coastal location,and minimizes adverse effects of development. F,/ I Yes n No n Not Applicable A primary component of the desired development pattern is to encourage water dependent uses to concentrate in existing locations of maritime activity. As per this recommendation of the LWRP,the applicant is proposing to upgrade the existing marina facility to provide safe conditions for the restaurant patrons, commercial and recreational clients at the marina. The continued use of the property as a marina and restaurant will help to further encourage the boating environment which is a historic use on this property and the neighboring lots. This use will help reinforce the traditional land use pattern of the Town of Southold which enhances the character of the community. Attach additional sheets it necessary Policy 2. Historically the marina has contained the charter fleet including the"North Fork Captains Association". The improvements to the property will help to visually improve the visual aspects of the property. Minimize loss of life, structures, and natural resources from flooding and erosion. These shore hardening structures are necessary to maintain the marina facility. As such the continued maintenance of the bulkheads and other marine facilities are necessary for the continued use. The improved and upgraded facilities will provide additional safe conditions for the patrons of the restaurant and the marina. The property is located next to the Plum Island Ferry and the Cross Sound Ferry terminals,the improved shoreline structures are necessary in order to provide additional support and safe conditions for these other properties. The nearest pump out facility is located in Greenport, almost 7 miles away. The installation of the pump out facility at the site will dramatically increase the water quality in the area. See LWRP Section III—Policies;Pages 22 through 32 for evaluation criteria. ❑ ❑ Yes No Not Applicable The proposed project will not impact Gardiner's Bay or its ecosystem, as the proposed work will be confined within the existing man made boat basin. The project will adhere to the required construction and dredging requirements as mandated by the State and Federal Government. The proposed pump out facilities will help to improve the water quality in the area by providing facilities for boat discharge waste. Attach additional sheets if necessary Policy 7. The installation of a pump out system on the property will help to reduce the amount of solid waste disposed of in open waters. PUBLIC COAST POLICIES Policy 9. Provide for public access to, and recreational use of, coastal waters, public lands, and public resources of the Town of Southold. The proposed improvements and upgrades to the facility will help to further enhance the publics enjoyment of the waterfront and water dependent uses in the Town of Southold.The marina and restaurant uses are compatible uses for this property. The continued use of the marina facilities by the local charter fleet will provide public resources for the Town of Southold. Attach additional sheets if necessary WORKING COAST POLICIES Policy 10. Protect Southold's water-dependent uses and promote siting of new water-dependent uses in suitable locations. The charter fleet and recreational boats require a marina for docking and for weathering storm events. The marina improvements will help maintain the current water dependent uses on the property. The property is located within the Marine II district where the permitted uses include: marina, boat docks for charter boats and boat yard for dispensing fuel. The proposed project allows for the continuation of the existing water dependent use within the current concentration of maritime activity associated with the ferry terminals. Policy 11. Promote sustainable use of living marine resources in Long Island Sound, the Peconic Estuary and Town waters. See LWRP Section III—Policies; Pages 57 through 62 for evaluation criteria.
