SCTM# 1000-97-7-3 The proposed action has been reviewed to Chapter 268, Waterfront Consistency Review of the Town of Southold Town Code and the Local Waterfront Revitalization Program (LWRP) Policy Standards. Based upon the information provided on the LWRP Consistency Assessment Form submitted to this department, as well as the records available to'me, it is my recommendation that the proposed action is CONSISTENT with the LWRP'policies and therefore CONSISTENT with the LWRP provided the following is considered to further Policy 6. 1. The installation of a vegetated, non-turf buffer landward of the wood bulkhead. 2. Request that the applicant install a I/A OWTS. Pursuant to Chapter 268, the Board of Trustees shall consider this recommendation in preparing its written determination regarding the consistency of the proposed action. This assessment is intended to supplement other information used by a Town of Southold agency in making a determination of consistency. *Except minor exempt actions including Building Permits and other ministerial permits not located within the Coastal Erosion Hazard Area. 2. See LWRP Section III - Policies; Pages 22 through 32 for evaluation criteria. ®Yes ❑ No ❑ Not Applicable LWRP CONSISTENCY ASSESSMENT FORM ADDENDUM FOR MATTHEW ZASH & COURTNEY KREMERS 400 BEEBE DRIVE CUTCHOGUE, NY SCTM#1000-97-7-3 Policies 5 & 6 The proposed work includes the replacement of the existing waterside deck with a larger deck located roughly the same distance from wetlands, as the deck will be significantly longer but approximately the same width. The proposed dwelling addition will be constructed on the landward side of the deck, in line with the existing seaward side of the house and 86 feet from wetlands. Therefore, while creating almost no additional encroachment on Eugene's Creek, the project will result in a 1,058 sf net reduction of impervious surface area on the property as a result of the replacement of an existing 1,750 sf asphalt driveway with a pervious gravel driveway. Additional mitigation measures include installation a drainage system of leaders, gutters, and drywells to collect roof runoff from the renovated dwelling structure; use of pervious gravel for the proposed patio surface; installation of a temporary project-limiting fence to control runoff and site disturbance during construction; and establishment of a permanent 10' wide, approximately 1,130 sf non-turf buffer adjacent to the wetland boundary, which can serve both as a sink and filter for stormwater runoff and contaminants. By thus reducing impervious surface and lawn areas and capturing and recharging runoff, the quantity of runoff reaching Eugene's Creek will be decreased; and the quality of runoff will be improved through a reduced concentration of potential fertilizers,pesticides, and insecticides. Additionally, groundwater and ultimately surface water quality will benefit from the removal of the preexisting nonconforming sanitary system located 56 feet from wetlands and installation of a new, upgraded sanitary system more than 100 feet from wetlands and thus outside Chapter 275 jurisdiction. Therefore, the project will have a net beneficial effect on the environmental conditions of the site and the adjacent tidal waters and wetlands. Therefore, the project will be consistent with the goals of Policies 5 and 6 of the LWRP, as both water quality and ecosystem quality and function will be protected and improved as a result of the mitigation measures associated with the project. -SEE ATTACHED ADDENDUM ADDRESSING POLICIES 5&6- Attach additional sheets if necessary Policy 7.
