Main Rd. &Youngs Ave.) cn ac G Q Telephone: 631 765-1938 Southold, NY 11971 � • �O P cou LOCAL WATERFRONT REVITALIZATION PROGRAM TOWN OF SOUTHOLD MEMORANDUM To: Michael Domino, President Town of Southold Board of Trustees From: Mark Terry, AICP LWRP Coordinator Date: September 17, 2019 Re: LWRP Coastal,Consistency Review for 40200 MAIN, LLC (ORIENT BY THE SEA), c/o RWN MANAGEMENT, LLC SCTM# 1000-15-9-8.1 Inter-Science Research Associates, Inc. on behalf of 40200 MAIN, LLC (ORIENT BY THE SEA), c/o RWN MANAGEMENT, LLC requests a Wetland Permit for exterior renovation of the existing restaurant structure that consists of new windows and doors, removing windows, installing windows in new locations, installing doors in new locations; closing window and door openings; repair the roof as necessary; repair and replace the existing siding as necessary; install gutters to leaders to drywells for roof runoff; remove and replace the existing southern deck in-kind and in-place at 1,418sqft with a small raised section at 161 sq.ft. near the restaurant; remove and replace and elevate the existing eastern deck section in-kind and within the existing foot print at 1,093sq.ft.; reconstruct an existing exterior bar in-kind and in-place within the eastern deck footprint; remove the existing north entrance ramp at 305sq.ft. and construct a new entrance ramp in same location at 197sq.ft.; remove a south access ramp at 58sq.ft. and construct access steps at 19.8sq.ft.; construct new access stairs for decking at 20.6sq.ft., new 45.6sq.ft. exit stair and landing; a new fuel area stair at 26.4sq.ft.; remove existing 1,000 gal. fuel tank and surrounding fence and install new duel fuel tank at 4,000 gallons for diesel and gasoline, and install a 6' tall, 55' linear foot long surrounding stockade fence; permanent removal of in-ground 4,000 gal. fuel tank; upgrade, repair or replace existing sidewalks surrounding restaurant; all restaurant work to be conducted from the landward side; and a debris boom will be installed and maintained during construction in the water surrounding the restaurant area in order to contain potential fly-away debris. SCTM# 1000-15-9-8.1 The proposed action has been reviewed to Chapter 268, Waterfront Consistency Review of the Town of Southold Town Code and the Local Waterfront Revitalization Program (LWRP) Policy Standards. Based upon the information provided on the LWRP Consistency Assessment Form submitted to this department, as well as the records available to me, it is my recommendation that the proposed action is EXEMPT from LWRP review pursuant to Chapter 268 Waterfront Consistency Review§ 268-3. Definitions, B and EE: B. Replacement, rehabilitation or reconstruction of a structure or facility, in kind, on the same site (inplace), including upgrading buildings to meet building or fire codes, except for structures in areas designated by the Coastal Erosion Hazard Area (CEHA) law where structures may not be replaced, rehabilitated or reconstructed without a permit and shoreline erosion control structures (including, but not limited to, groins,jetties, bulkheads, filled piers) located within Great Peconic Bay, Cutchogue Harbor, Little Peconic Bay, Hog Neck Bay, Noyack Bay, Southold Bay, Shelter Island Sound, Pipes Cove, Orient Harbor, Gardiners Bay, Long Island Sound, Fishers Island Sound and Block Island Sound (excluding all creeks); EE. Upgrades to existing fuel tanks, provided that erosion control measures are implemented; Pursuant to Chapter 268, the Board of Trustees shall consider this recommendation in preparing its written determination regarding the consistency of the proposed action. All applicants for permits* including Town of Southold agencies, shall complete this CCAF for proposed actions that are subject to the Town of Southold Waterfront Consistency Review Law. This assessment is intended to supplement other information used by a Town of Southold agency in making a determination of consistency. *Except minor exempt actions including Building Permits and other ministerial permits not located within the Coastal Erosion Hazard Area. 2. Before answering the questions in Section C, the preparer of this form should review the exempt minor action list, policies and explanations of each policy contained in the Town of Southold Local Waterfront Revitalization Program. A proposed action will be evaluated as to its significant ® beneficial and adverse effects upon the coastal area(which includes all of Southold Town). 3. If any question in Section C on this form is answered "yes" or"no", then the proposed action will affect the achievement of the LWRP policy standards and conditions contained in the consistency review law. Thus, each answer must be explained in detail. listing both supporting and non- supporting facts. If an action cannot be certified as consistent with the LWRP policy standards and conditions,it shall not be undertaken. Foster a pattern of development in the Town of Southold that enhances community character, preserves open space, makes efficient use of infrastructure,makes beneficial use of a coastal location,and minimizes adverse effects of development. See LWRP Section III—Policies; Page 2 for evaluation criteria. L�1 Yes ❑ No ❑ Not Applicable A primary component of the desired development pattern is to encourage water dependent uses to concentrate in existing locations of maritime activity. As per this recommendation of the LWRP,the applicant is proposing to upgrade the existing restaurant facility to provide safe conditions for its patrons. The continued use of the property as a marina and restaurant will help to further encourage the boating environment which is a historic use on this property and the neighboring lots. This use will help reinforce the traditional land use patter of the Town of Southold which enhances the character of the community. Attach additional sheets it necessary Policy 2. The upland improvements to the property will include the removal of an in-ground fuel tank and the replacement of a new above ground fuel tank. The proposed improvements and upgrades to the facility will help to further enhance the publics enjoyment of the waterfront and water dependent uses in the Town of Southold. The upgrades to the existing restaurant may draw new patrons from the Cross Sound Ferry and draw additional visitors for public relaxation.
