Credit Shelter Trust under the Will of Philip G.Horton for the benefit of Dorothy J.Horton,with
an address at 2795 Arrowhead Lane,Peconic,New York 11958,party of the first part,and
ZUHOSKI LLC,a New York Limited Liability Company,with an address at 27500 County
Road 48,Southold,New York 11971,
party of the second part,
WITNESSETH,that the party of the first part,in consideration of Nine Hundred Twenty-five
Thousand Dollars($925,000.00)and other valuable consideration paid by the party of the second
part,does hereby grant and release unto the party of the second part,the heirs or successors and
assigns of the party of the second part forever,all of the party of the first part's interest in
ALL that certain plot, piece or parcel of land, with the buildings and improvements thereon
erected,situate,lying and being in the Town of Southold,County of Suffolk,and State of New
York,more particularly bounded and described on Schedule A annexed hereto and made a part
hereof.
BEING AND INTENDED TO BE the same premises described in deed made by Dorothy J.
Horton,as Executrix of the Estate of Philip G. Horton, late of Peconic,who died a resident of
Suffolk County on April 15,2013,dated April 29,2015,and recorded on May 21;2015,in Liber
12817 page 824, in the Suffolk County Clerk's Office, the Grantor herein being the same
described as the Grantee in said Deed.
TAX MAP TOGETHER with all right,title and interest,if any,of the party of the first part in and to any
DESIGNATION streets and roads abutting the above described premises to the center lines thereof;TOGETHER
with the appurtenances and all the estate and rights of the party of the first part in and to said
Dist.: 1000 premises;TO HAVE AND TO HOLD the premises herein granted unto the party of the second
part,the heirs or successors and assigns of the party of the second part forever.

AND the party of the first part covenants that the party of the first part has not done or suffered
Blk.:01.00 anything whereby the said premises have been encumbered in any way whatever, except as
aforesaid.

AND the party of the first part,in compliance with Section 13 of the Lien Law,covenants that
the party of the first part will receive the consideration for this conveyance and will hold the
right to receive such consideration as a trust fund to be applied first for the purpose of paying the
cost of the improvement and will apply the same first to the payment of the cost of the
improvement before using any part of the total of the same for any other purpose.
The word"party"shall be construed as if it read"parties"whenever the sense of this indenture so
requires.

BEGINNING at a concrete monument on the southeasterly side of Middle Road where the same is
intersected by the easterly boundary line of land now or formerly of Zuhoski Nursery LLC,said
point being distant 1671 feet more or less northeasterly as measured along the southeasterly side
of Middle Road from the corner formed by the intersection of the northeasterly side of Bridge Lane
with the southeasterly side of Middle Road;
