18th day of August 2020 at 2:05 o'clock p.m. to amend Chapter 301 entitled, "Zoning and
Land Development", Part 3 thereof entitled, "Supplementary Regulations", Article XLV U
thereof entitled, "Supplementary Use Regulations", Section 301-231 thereof entitled, "Off- a

§ 301-231 Off-street parking.

N. Driveways and parking.

(1) Legislative intent. In order to maintain an appropriate visual quality for residential o
properties, preserve property values, protect neighborhood character and
safeguard quality of life, certain standards shall apply as specified herein in the
Residence A-40 (RA-40) Zoning Use District, Residence B-40 (RB-40) Zoning
Use District, Residence A-80 (RA-80) Zoning Use District, and Residence B-80
(RB-80) Zoning Use District.
(a) The amount of front yard area consisting of asphalt, gravel, stone or dirt or
other non-vegetative material, to be used primarily for the parking of vehicles,
shall not exceed 35% of the area of the front yard. °
(b) The parking of vehicles in the front yard area is restricted to that portion
consisting of asphalt, gravel, stone or dirt or other non-vegetative material. The C
parking of vehicles in the front yard area is prohibited when all four tires of a E

vehicle are placed on grass or other vegetative material. This prohibition shall not M
apply if inclement weather conditions (such as flooding or snow accumulation) a
render it impracticable or impossible to comply therewith.

(c) Where applicable, on a parcel with frontage on more than one street, the
portion of the lot comprising a second front yard cannot be used for the area
consisting of asphalt, for the parking of vehicles, except in those cases where 2
said area is less than 35% of the total area for all front yard.

(d) Penalties for the parking of vehicles in front yard areas. Failure to comply a)
with the provisions in this section shall be designated as violations and shall be o
punishable as follows: z
(i) For the first conviction: by a fine of not less than $100.00 nor more o
than $250.00; C
(ii) For the second conviction committed within a period of two (2) years:
by a fine of not less than $250.00 nor more than $500.00; and

(iii) For a third and each subsequent conviction committed within a
period of two (2) years: by a fine of not less than $500.00 nor more
than $1,000.00.

NOW THEREFORE BE IT RESOLVED,the Town Clerk is hereby authorized to publish
the attached public notice to consider a local law to amend Chapter 301 entitled, "Zoning and Land
Development"of the Riverhead Town Code once in the July 30,2020 issue of the News-Review
Newspaper,the newspaper hereby designated as the official newspaper for this purpose,and also
to cause a copy of the proposed amendment to be posted on the sign board of the Town; and

RESOLVED, all Town Hall Departments may review and obtain a copy of this resolution

designed to be used, and no building or structure shall be hereafter erected, reconstructed, or

altered, unless otherwise provided in this chapter, except for the following permitted uses or
specially permitted uses and their customary accessory uses: 0
B. Special permit uses:
(6) New motor vehicle storage as accessory to physical dealerships of new motor vehicle sales
located within the Town of Riverhead,subject to the following additional criteria:
(a)Setbacks to storage area shall be 50'from front, outside perimeter side, and rear lot

lines.
(b) Setback to storage area shall be 50'from interior side lot lines when adiacent to either
Industrial A or Industrial C zoning use districts.
(c) Storage area shall be Physically defined and maintained with adequate fencing.
(d) No fueling,washing, servicing, customization, installation of accessories, display,
showing or sales shall take place on the subiect prope
(e) Minimum twenty-five-foot vegetated perimeter buffer to provide year-round screening
of the storage area from adjacent properties and a minimum fifty-foot vegetative buffer
along roads shall be provided and maintained. ca
