En-Consultants on behalf of GENIE ARCIGA &THOMAS JUUL-HANSEN request an
Administrative Permit to conduct construction activity within 100' from crest of bluff to construct on
vacant parcel an approximately 3,411sf, 2-story, single-family dwelling with approximately 1,518sf
waterside deck with steps, 1,632sf pool deck, 61sf spa, and 680 sf swimming pool, all located at
least 100 feet from crest of bluff, install drinking water well and drainage system of leaders, gutters
and drywells; and clear up to 50 feet from crest of bluff. Located: 500 Castle Hill Road, Cutchogue.

The,proposed action has been reviewed to Chapter 268, Waterfront Consistency Review of the
Town of Southold Town Code and the Local Waterfront Revitalization Program (LWRP) Policy
Standards. Based upon the information provided on the LWRP Consistency Assessment Form
submitted to this department, as well as the records available to me, it is my recommendation that
the proposed action is CONSISTENT with the LWRP policies and therefore CONSISTENT with the
LWRP provided the following is considered to further policies 5 and 6.
1. Require the installation of an I/A OWTS.
Note that a 1981 Covenant and Restriction on the property prevents grading and clearing of
vegetation (excluding necessary maintenance) within 50' of the top edge of the bluff.
Pursuant to Chapter 268, the Board of Trustees shall consider this recommendation in preparing its
written determination regarding the consistency of the proposed action.

LWRP CONSISTENCY ASSESSMENT FORM
A. INSTRUCTIONS
1 . All applicants for permits* including Town of Southold agencies, shall complete this CCAF for
proposed actions that are subject to the Town of Southold Waterfront Consistency Review Law. This
assessment is intended to supplement other information used by a Town of Southold agency in
making a determination of consistency. *Except minor exempt actions including Building Permits
and other ministerial permits not located within the Coastal Erosion Hazard Area.
2. Before answering the questions in Section C, the preparer of this form should review the exempt
minor action list, policies and explanations of each policy contained in the Town of Southold Local
Waterfront Revitalization Program. A proposed action will be evaluated as to its significant
beneficial and adverse effects upon the coastal area (which includes all of Southold Town).
If any question in Section C on this form is answered "yes" or "no", then the proposed action will
affect the achievement of the LWRP policy standards and conditions contained in the consistency
review law. Thus, each answer must be explained in detail, listing both supporting and non-
supporting facts. If an action cannot be certified as consistent with the LWRP policy standards and
conditions, it shall not be undertaken.
A copy of the LWRP is available in the following places: online at the Town of Southold's website
(southoldtown.northfork.net), the Board of Trustees Office, the Planning Department, all local
libraries and the Town Clerk's office.

The proposed development of the subject property has been designed to conform to the 100'bluff
setback requirement pursuant to Town Code Sections 280-116(A)(1) and 275-3(D)(1)(b). And
to mitigate the proposed clearing, disturbance, and development of the presently vacant land: 1)
all clearing, grading, and ground disturbance is limited to a distance of 50 feet from the top of
bluff, 2) a drainage system of leaders, gutters, and drywells is proposed to collect and recharge
roof runoff from the new dwelling; 3) additional drywells are provided to contain potential site
runoff associated with the proposed pervious gravel driveway, which shall be located more than
100 feet from the crest of bluff and outside Chapter 275 jurisdiction; 4) a project limiting fencing
will be installed to control and contain site disturbance during construction; and 5) the sanitary
system is proposed on the landward side of the new dwelling and well outside Chapter 275
jurisdiction, at least 175 feet from the top of bluff and 275 feet from the surface waters of Long
Island Sound. And the bluff is protected from erosion by an existing retaining wall constructed
pursuant to Town Wetlands Permit No. 4525 and Coastal Erosion Management Permit No. 72-1-
1.10, issued in September 1995. Thus, as designed with the incorporated mitigation, the project
will protect groundwater quality and supply and will not adversely impact the quality or function
of the surrounding ecosystem, adjacent surface water quality, or integrity of the adjacent bluff.
The project will thus be consistent with Policies 4, 5, and 6 of the LWRP.
