KELLY SCTM# 1000-70-4-13 DANIEL F. & KATHLEEN M. KELLY request a Wetland Permit to demolish existing 68'x70' two- story dwelling along with footings and foundation; using fill that is excavated for the new foundation, fill a 21'x27' area to the seaward side of existing foundation and return to existing grade; abandon existing sanitary system and install new landward of dwelling, as approved by SCDHS requirements; construct a new 68'x41' single-family, two-story dwelling with attached garage further landward than existing and will be no closer than 1 01' from bulkhead; construct anew 16'x28' masonry patio/deck on seaward side of new dwelling; install gutters to leaders to drywells to contain roof runoff; install new underground utilities, water, natural gas and electric; excavate for a 16'x34' concrete pool with a 3' wide paving stone patio on all four sides of the pool for a total pool area of 22'x40'; install pool equipment area and pool backwash drywell off the north west corner of pool; install 4' high pool enclosure fencing with gates,to be installed along side yard property lines, and across the property approximately 20' landward of bulkhead; replace windows, roofing and siding on existing 14'8"x35'4" boat house; return property to existing grade when construction began; install a line of hay bales and/or silt fencing prior to and during construction; and to reutilize existing entry and driveway and to install drywells to contain storm-water runoff in driveway. SCTM# 1000-70-4-13 The proposed action has been reviewed to Chapter 268, Waterfront Consistency Review of the Town of Southold Town Code and the Local Waterfront Revitalization Program (LWRP) Policy Standards. Based upon the information provided on the LWRP Consistency Assessment Form submitted to this department, as well as the records available to me, it is my recommendation that the proposed action is CONSISTENT with the LWRP policies and therefore CONSISTENT with the LWRP provided the following is considered to further policies 5 and 6. 1. Require an I/A,OWTS. Pursuant to Chapter 268, the Board of Trustees shall consider this recommendation in preparing its written determination regarding the consistency of the proposed action. Foster a pattern of development in the Town of Southold that enhances community character, preserves open space, Makes efficient use of infrastructure, makes beneficial use of a coastal location, and minimizes effects of development. While the proposed neve residential home increases the overall footprint by approximately 76 square feet (present square footage footprint of 2,820 to a proposed 2,896 square feet ), by utilizing the already excavated basement area forward of the 100 foot trustee line, it removes 579 square feet of coverage of the 2-story section of the existing residence from the sensitive trustee area. In addition, by utilizing the existing excavated foundation area, it will then only require approximately an additional 81 cubic yards removed for the new foundation but this will be on the front side of the home well forward to the 100- foot line trustee buffer. This will minimize the impact on the overall site disturbance. Policy 2 Protect and preserve historic and archaeological resources of the Town of Southold. This is not applicable to this project. There are no archaeological or history features or resources on this property. Policy 3 Enhance visuality quality and protect scenic resources throughout the Town of Southold. The construction of the new residence is in keeping in style and sizing of other residences within the community. The present structure on the property is starting to show signs of neglect and the proposed new structure will enhance the property. Policy 4 Minimize loss of life , structures, and natural resources due to flooding and erosion. r All rainwater from the new residence and site improvements will be retained with the use of new drywells as indicated on the plan. Policy 5 Protect and improve water quality and supply in the Town of Supply. Rainwater runoff from the new residence and site improvements will be contained in new drywells-as indicated on surveys. In addition, the new septic system will be moved forward of present system on the street side of the residence and be a minimum of 150 forward of the existing the bulkhead. Policy 6 Protect and restore the quality and function of the Town of Southold ecosystems including significant Coastal Fish and wildlife Habitats and wetlands. No construction will take place in protected or natural indigenous environmental areas. Policy 7 Protect and improve air quality in the Town of Southold® The development will not add pollutants to the air. All construction equipment will comply with current federal standards. The new HVAC systems in the new residence will comply with the new are more stringent environment regulations. Policy S Minimize environmental degradation in the Town of Southold from solid waste and hazardous substances and waste® The construction and use of the residence will make use of the towns waste disposal and recycling center. Policy 9 Provide for public access to, and recreati®nal use of, coastal waters, public lands, and public resources of the Town of Southold. There is no public land is involved with the planned construction: Policy 10 Promote Southold's water-dependent uses and promote siting of new water dependent uses in suitable locations. There are no public or commercial activities conducted on the site. The property is zoned for residential use and shall remain that way. Policy 11 Promote sustainable use of living marine resources in the Long Island Sound,the Peconic Estuary and town waters. The project will help preserve and protect the living marine resources by capturing rainwater discharge and runoff by containing it in the new proposed drywells on the site as indicated on survey. Policy 12 Protect agricultural lands in the Town of Southold. There are no agricultural lands on the site. Policy 13 Promote appropriate use and development of energy and mineral resources. The new residence will feature all energy-star equipment and the structure itself will comply with the more modern and efficient energy as mandated by the NY Energy Conservation and Construction Code. Prepared By 1 Title wdn e r- ®ate 1 Project Description Proposed Kelly Residence 2895 Wells Avenue Southold, New York 11971 June 23rd, 2019 Demolition— 1.)Remove existing 68'X70 2 story residential structure along with footings and foundation. Recycle as much as possible during demolition and remove the remainder to approved and licensed landfill. With fill that is excavated for the new foundation, fill 21' X 27 area to the rear of existing foundation and return to existing grade. 2.)Abandon and remove existing sanitary system as per SCDHS requirements. 3.)reutilize existing entry on to property and existing driveway. 4.)Any staging of material to be removed shall be forward of the existing structure. 5.)Install hay bale berm and silt fencing prior to any demolition and construction on property and maintain throughout construction. Construction— 1.) Construct a new 68' x 41' single-family residential structure with pool as proposed on plans and surveys. 2.)Install hay bale berm and silt fencing prior to any demolition and construction on property. 3.)Excavate additional area for footing and pool. All excavated material shall be located forward of the proposed new structure. Any surplus excavated material after foundation backfilling shall be trucked from site except for grading topsoil which will be stored forward of proposed structure. 4.)Construct new 68' by 41' single family residential structure so that the rear of the new proposed structure will be no closer than 101' from the bulkhead. 5.) Construct new 16' X 28' masonry patio/deck to the rear of the structure as indicated on survey. 6.)Install new sanitary system as approved by SCDHS. 7.)Install 4-foot fencing from the sides of the new structure to the side property lines and then down the side property lines to a point approximately 20' forward of the bulkhead. This would involve appx 85' on the north property line, 120' on the south property line, and appx 115' on the east side forward of the bulkhead staying above the 10' elevation level. 8.) Construct new 16' X 28' masonry deck/patio on the rear of the house as indicated on survey. 9.)Excavate for a 16' X 34' concrete pool with a 3'paving stone patio on all 4 sides of the pool. Pool Equipment and backwash drywell will be located off the north west corner of the pool. Total pool area to be 22' X40'. At no time will the pool or decking around pool be closer than 52' of the bulkhead. 10.) Install new dry wells as required where indicated for roof run off, pool backwash, and stormwater run-off in driveway. 11.) Install new underground utilities, water, natural gas and electric. 12.) Replace windows, roofing, and siding on existing 14'.8" X 35'.4" boat house to match materials use on new residence. 13.) Construction of Pool area not to begin until all exterior construction of house is near completion. (excavation for pool will begin as the grades are restored) 14.) Return property to existing grade when construction began Since the site has already been cleared and elevations have been established during the building of the original structure, it is our intent to disturb as little additional area of the site as possible. The actual area of new excavation for the residence will require the disturbance of approximately 820 square feet in the front of the existing residence in the area by the front door and garage and the pool. The proposed new structure will be forward of the Trustee protected area except for the new patio/deck which will project into the trustee zone less than the deck'that is being demolished. Ultimately, the new building will result in the removal of approximately 1,100 square feet of building from the trustee zone.
