(256sq.ft.); construct right angle fixed dock section 4' in width and 32' in length with four(4) sets of 8" diameter pressure treated pilings (128sq.ft.); install a 3'x8' aluminum removable ramp (24sq.ft.); construct and install a 6'x20' floating dock with two (2) 10" diameter pressure treated pilings and one (1) batter piling with (2) 10" diameter pressure treated pilings (120sq.ft.); install four(4) batter pilings consisting of(2) 10" diameter pressure treating pilings; remove wood decking from existing fixed dock and reframe deck beams to fasten new 5/4" thick by 6" wide IPE wood decking with stainless steel screw fasteners; decking for new fixed dock sections and floating dock to be 5/4" thick by 6"' wide IPE wood with stainless steel screw fasteners; total new fixed dock, ramp and floating dock: 432sq.ft., and overall total dock: 625sq.ft.; remove 562.5sq.ft. of existing wood decks with staircases and replace with pressure treated wood framing and IPE wood decking with stainless steel screw fasteners; remove 396.3sq.ft. of remaining walkways and staircases and replace with pressure treated wood framing and IPE wood treads with stainless steel screw fasteners; remove 436sq.ft. of existing wood walkway/deck with existing wood retaining wall and piers and replace with 223 linear feet of±8 concrete retaining walls with footings, filled with gravel and topped with 1 '/2" —2" peastone o/e for pervious walkway/deck area; for the existing 44' long by 4' wide dock (176sq.ft.) with a 2'x8.5' (17sq.ft.) wood bench for a total of 193sq.ft.; the connecting staircase is proposed to be ------removed-arid-replaced as--part-of-the wood-decksrwalkways-and_staircase_replacements_(p rt..of — 396sq.ft. above); and reframe deck beams to fasten replacement decking of 5/4" x 6' IPE wood with stainless steel screw fasteners. SCTM# 1000-36-2-24 The proposal to remove approximately 130' of existing wood sheathed bulkhead, whalers, top cap, tie rods and 8" diameter pilings and dispose of off-site; install approximately 130 linear feet of new vinyl bulkhead consisting of two (2) 6"x6" whalers, one (1) 4"x6" back board, IPE top cap, 8" diameter pressure treated pilings @ 6' o.c. with 3/" galvanized steel tie rods connected to 8" thick retaining wall with 3/8"x6" square steel back plate is CONSISTENT with the LWRP policies: No permits were found for the below listed structures in Town records. The proposed actions to remove wood decking from existing fixed dock and reframe deck beams to fasten new 5/4" thick by 6" wide IPE wood decking with stainless steel screw fasteners; decking for new fixed dock sections and floating dock to be 5/4" thick by 6"' wide IPE wood with stainless steel screw fasteners; total new fixed dock, ramp and floating dock: 432sq.ft., and overall total dock: 625sq.ft.; remove 562.5sq.ft. of existing wood decks with staircases and replace with pressure treated wood framing and IPE wood decking with stainless steel screw fasteners; remove 396.3sq.ft. of remaining walkways and staircases and replace with pressure treated wood framing and IPE wood treads with stainless steel screw fasteners; remove 436sq.ft. of existing wood walkway/deck with existing wood retaining wall and piers.and replace with 223 linear feet of±8" concrete retaining walls with footings, filled with gravel and topped with 1 Y2" —2" peastone o/e for pervious walkway/deck area; for the existing 44' long by 4' wide dock (176sq.ft.) with a 2'x8.5' (17sq.ft.) wood bench for a total of 193sq.ft.; the connecting staircase is proposed to be removed and replaced as part of the wood decks, walkways and staircase replacements (part of 396sq.ft. above); and reframe deck beams to fasten replacement decking of 5/4" x 6' IPE wood with stainless steel screw fasteners is recommended as INCONSISTENT with the LWRP. Further, it is my recommednation that the proposed action to construct new 4' wide dock seaward from existing 193sq.ft. fixed dock (includes bench) with a two-tread staircase a distance of 64', with nine (9) sets of 8" diameter pressure treated pilings @ 8' o.c. (256sq.ft.); construct right angle fixed dock section 4' in width and 32' in length with four(4) sets of 8" diameter pressure treated pilings (128sq.ft.); install a 3'x8' aluminum removable ramp (24sq.ft.); construct and install a 6'x20' floating dock with two (2) 10" diameter pressure treated pilings and one (1) batter piling with (2) 10" diameter pressure treated pilings (120sq.ft.); install four (4) batter pilings consisting of(2) 10" diameter pressure treating pilings are INCONSISTENT with the below listed LWRP policy standards; 6; 9.1 (B), 9.2 (A.1 and A.3), 9.3 (A, B, D, E and F) and 9.4 (A and E) and therefore is INCONSISTENT with the LWRP. Policy 6. Protect and restore the quality and function of the Town of Southold ecosystems 6.3 Protect and restore tidal and freshwater wetlands. The applicant has not demonstrated that the following dock standards pursuant to § 275-11. Construction and operation standards have been met. (d) Review and approval of dock applications. Before issuing a permit for a dock structure, the Trustees shall consider whether the dock will have any of the following harmful effects: [2] Whether the dock will unduly interfere with the public use of waterways for swimming, boating, fishing, shellfishing, waterskiing and other water-dependent activities, The applicant fails to show that the proposal would meet the dock line. It appears that the proposed dock would extend farther seaward than the existing, adjacent docks. Private dock structures extending into public waters decreases the public use of bottomlands and the nearshore area. j51 Whether the dock will cause degradation of surface water quality and natural resources, [11] Whether the cumulative impacts of a residential and commercial dock will change the waterway or the environment and whether alternate design, construction, and location of the dock will minimize cumulative impacts; and The alternative use of seasonal moorings in areas of low biological productivity and with adequate water depths is a better option to accommodate vessels requiring greater water depths. Extending permanent dock structures further into public waters to accommodate private vessels is not supported by the LWRP. (12] Whether adequate facilities are available to boat owners andlor operators for fueling, discharge of waste and rubbish, electrical service and water service. This information has not been provided. 9.3 Preserve the public interest in and use of lands and waters held in public trust by the state and the Town of Southold. A. Limit grants, leases, easements, permits or lesser interest in lands underwater in accordance with an assessment of potential adverse impacts of the proposed use, structure, or facility on public interest in public lands under water. Use the following factors in assessing potential adverse impact. 1. environmental impact, The action would result in impacts to benthic organisms in the construction of the dock (piles) and from shading of the substrate. 2. values for natural resource management, public recreation, and commerce, 3. size, character, and effect of the transfer in relation to neighboring uses, 4. potential for interference with navigation, public uses of waterway, and riparian rights, Dock structures impede and interfere with public uses of waterways. The applicant enjoys access to public waters currently. Opportunities to seasonally moor vessels are available. 5. water-dependent nature of use, The parcel is improved with a residential structure and in not water dependent. B. Limit the transfer of interest in public trust lands to the minimum necessary conveyance of public interest. 2. Limit the physical extent of any conveyance to the minimum amount of land necessary. Seasonal open water moorings for vessels are available. D. Retain a public interest in the transfer of interest in underwater lands that, will be adequate to preserve public access, recreation opportunities, and.other public trust purposes. E Private uses, structures, or facilities on underwater lands are limited to those circumstances where ownership of the underwater lands or riparian interest has been legally validated either through proof of ownership of the underwater lands or adjacent riparian parcel, or by assignment of riparian interest by the riparian owner. The dock structure is proposed on public underwater lands. F. Avoid substantial loss of public interest in public trust lands by assessing the cumulative impact of individual conveyances of grants, easements, and leases of public trust lands. Conglomerate dock structures could result in public exclusion areas due to placement, orientation and length from the shoreline. 9.4 Assure public access to public trust lands and navigable waters. A. Provide free and substantially unobstructed passage along public trust shorelands. E Provide access to, and reasonable recreational use of, navigable waters and public trust lands under water. Piers, docking facilities, and catwalks must not result in an unnecessary interference with use of public trust lands. Alternatives to long piers or docks include use of dinghies to reach moored boats and mooring in nearby marinas. The dock structure will result in a net decrease in public access to public underwater lands. The LWRP does-,not support the construction of private, dock structures over/in the public trust lands and waters. The LWRP supports the use of seasonal moorings and the mooring of vessels in nearby marinas. Pursuant to Chapter 268, the Board of Trustees shall consider this recommendation in preparing its written determination regarding the consistency of the proposed actions.
