Main Rd. &Youngs Ave.) u> >r � � �O� Telephone: 631 765-1938 Southold, NY 11971 O Fax: 631 765-3136 �ycoUM`l,�c LOCAL WATERFRONT REVITALIZATION PROGRAM MEMORANOLMOLD To: Michael Domino, President Town of Southold Board of Trustees From: Mark Terry, AICP LWRP Coordinator Date: December 9, 2019 Re: LWRP Coastal Consistency Review CLAUDIA PURITA SCTM# 1000-51-4-6 Costello Marine Contracting Corp. on behalf of CLAUDIA PURITA requests an Amendment to Wetland Permit#9276 and Coastal Erosion Permit#9276C to allow for the "as-built" installation of 1.5 to 3 ton rock armoring in front of the newly constructed bulkhead, ±1,260 cubic foot(60.5 tons) of rock to be placed below spring high water level; as-built two 11 foot high concrete terracing block retaining walls in lieu of the previously approved 5 foot high retaining walls on face of bluff; install a pervious gravel splash curtain landward of bulkhead. It is my recommendation that the above actions are INCONSISTENT with the below listed Policy Standard and therefore is INCONSISTENT with LWRP. 6.3. Protect and restore tidal and freshwater wetlands. A. Comply with statutory and regulatory requirements of the Southold Town Board of Trustees laws and regulations for all Andros Patent and other lands under their jurisdiction. 1. Comply with Trustee regulations and recommendations as set forth in Trustee permit conditions. According to Town records, the structures were completed without obtaining Board of Trustee review or regulatory permits. The proposal to construct a revised stairway and walkway consisting of a 4' wide terraced walkway from top of bluff towards top retaining wall; construct 3'wide by 147' long stairs off top retaining wall to area between two retaining walls; construct a 5'x4' cantilevered platform with 3' wide by 147' long set of steps to area in between lower retaining wall and bulkhead; construct a 5'x4' cantilevered platform off bulkhead with 3'x9'2"seasonal aluminum stairway and to revegetate the bank with native plantings is recommended as CONSISTENT with the LWRP. Pursuant to Chapter 268, the Board of Trustees shall consider this recommendation in preparing its written determination regarding the consistency of the proposed action. This assessment is intended to supplement other information used by a Town of Southold agency in making a determination of consistency. *Except minor exempt actions including Building Permits and other ministerial permits not located within the Coastal Erosion Hazard Area. 2. Before answering the questions in Section C, the preparer of this form should review the exempt minor action list, policies and explanations of each policy contained in the Town of Southold Local Waterfront Revitalization Program. A proposed action will be evaluated. as to its significant beneficial and adverse effects upon the coastal area(which includes all of Southold Tom 3:. Provide all proposed Best Management Practices that will further each policy. Incomplete answers will require that the form be returned for completion. DEVELOPED COAST POLICY Policy 1. Foster a pattern of development in the Town of Southold that enhances community character, preserves open space,makes efficient use of infrastructure,makes beneficial use of a coastal location,and minimizes adverse effects of development. See LWRP Section III—Policies; Page 2 for evaluation criteria. ❑Yes © No ❑ Not Applicable The focus of ourproposal is to stabilize a severely eroded bluff with a house situated very close to the bluff crest. The bulkhead had completely failed and the bluff face completely eroded. The neighboringproperties which have bulkheads and retaining walls were beginning to be undermined and compromised Previously approved was the bulkhead reconstruction with two five foot retaining walls. The best defense for the bulkhead is to armor the bulkhead with stone which is similar to other properties along this shoreline. The retaining walls are higher than the approved 5'(now 119 and made of concrete. The main concern was protecting our client's property and the neighboring properties from further erosion. Policy 2. Protect and preserve historic and archaeological resources of the Town of Southold. See LWRP Section III e Policies Pages 3 through 6 for evaluation criteria ❑ Yes ❑ No ® Not Applicable Our proposal will have no influence on the historic and archaeological resources of the Town of Southold. The bulkhead and rock armoring is consistent with structures protecting adjacent properties. Many of the properties along this shoreline also have retaining walls The retaining walls support the material on the bluff face and maintain a slope to,limit further slumping. Theproposal is reasonable in nature and consistent with the adjoining properties. The additional support of the rock armoring will help disperse the reflective wave energy. The upper retaining walls will completely stabilize this bluff to minimize further erosion. We do not anticipate our proposal will have an adverse effects on the surrounding properties. Previously all access was cut off when the bulkhead and staircase collapsed Securing the bluff andproviding the retaining walls will allow vegetation to root and stabilize the bluff from further slumping. Once the bluff restoration is complete,the property owners will gain access to the water and be able to resume their normal water-dependent activities such as kayaking.
