Located: 3675 Nassau Point Road, Cutchogue. Patricia Moore, Esq. on behalf of SILVIA CAMPO & DAVID HERMER requests a Wetland Permit to replace two (2) existing wood retaining walls perpendicular to top of bluff with new cement retaining walls, first retaining wall to be 26 linear feet length and second retaining wall to be 32 linear feet in length is recommended as CONSISTENT with the LWRP. A Wetlands Permit (9406) was issued in 2019 for the structures. The proposal to replace existing wood platform and beach access stairs consisting of an 8.3'x9.5' landing at top of bluff to 3'x12' steps to a 6.5'x5' upper middle landing to 3'x16' stairs to a 6.5'x5' lower middle landing to 3'x9' stairs to a 9.5'x9.5' lower landing at bottom of bluff to a 3.8'x3.5' cantilevered platform off of bulkhead with 3' wide retractable stairs to beach; and to repair or replace as needed, lower 32' of existing railroad ties adjacent to lower platform is recommended as INCONSISTENT with the LWRP and policy 6.3 below. 6.3. Protect and restore tidal and freshwater wetlands. A. Comply with statutory and regulatory requirements of the Southold Town Board of Trustees laws and regulations for all Andros Patent and other lands under their jurisdiction 1. Comply with Trustee regulations and recommendations as set forth in Trustee permit conditions. According to Town records, the beach access stair was constructed without obtaining Board of Trustee review or regulatory permit. Only a permitted structure can be replaced. In the event that the action is approved it is recommended that existing bluff vegetation be preserved during construction of the beach access stair to further Policy 6. Pursuant to Chapter 268, the Board of Trustees shall consider this recommendation in preparing its written determination regarding the consistency of the proposed action.
