SUFFOLK COUNTY ADMINISTRATIVE CODE: This application was not required to be referred to the Suffolk County Department of Planning under the Suffolk County Administrative Code Sections A 14-14 to 23. LWRP DETERMINATION: The relief, permit, or interpretation requested in this application is listed under the Minor Actions exempt list and is not subject to review under Chapter 268. PROPERTY FACTS/DESCRIPTION: The subject property is located on a nonconforming 33,779.07 square foot parcel in an R-40 Zoning District. The existing lot(26.1)was created on September 10, 1999, by the merger of lots 23 and 26, according to the Town Assessor's property card. The northerly property line measures 158.80 feet and is adjacent to a 20 foot wide path Right of Way(Hilltop Path); the easterly property line measures 137.39 feet and then moves southwesterly at 46.16 feet then the property lines measures easterly 144.29 feet,the southerly property line measures 100.00 feet and is adjacent to Majors Path, the westerly property line measures 144.10 feet and moves westerly 127.88 feet, then moves northwesterly measuring 34.11 feet to meet the northerly measurement. The property is improved with a two-story framed home with an attached garage. There is an existing 511 sq. ft. wood deck with wood stairs that leads to the Right of Way (Hilltop Path) as shown on the survey map prepared by Angelo Joseph Cecere, L.S. of AJC Land Surveying & Planning, last revised January 3, 2020 along with drawings of the deck and proposed in-ground swimming pool by Nigel Robert Williamson,Architect, dated July 17, 2019. BASIS OF APPLICATION: Request for Variances from Article III, Sections 280-15 and the Building Inspector's December 2, 2019, Notice of Disapproval based on an application for a permit to construct an accessory in-ground pool and to legalize an "as built" accessory deck; at 1) swimming pool located in other than the code required rear yard; 2) "as built" accessory deck located in other than the code required rear yard; located at 275 Majors Path, Southold,NY. SCTM#1000-54-1-26.1. RELIEF REQUESTED: The applicant requests variances to construct an accessory in-ground swimming pool and to legalize an "as built" accessory deck, The proposed accessory swimming pool and the "as built" accessory deck, on this nonconforming 33,779.7 square foot lot in the R-40 District, are not permitted pursuant to Article III, Page 2,June 25,2020 #7381,McDermott,-Agusa SCTM No. 1000-54-1-26.1 Section 280-15, which states accessory buildings and,structures shall be located in the required rear yard. The survey shows the proposed accessory swimming pool'and"as built" accessory deck located in the front yard. ADDITIONAL INFORMATION: In 1999, Lots 23 and 26 were merged to create the.existing lot 26.1. By merging the two lots, two front yards were created with the historical Lot 23 being the location of the existing wood deck. The original residence was destroyed by fire and replaced with the existing two-story residence in 2000. A letter from a neighbor, who did not object to the appeal, did have concerns about a large fallen tree on the property in the vicinity of the proposed swimming pool. Upon inspection of the site it was confirmed by members of the Board that the large tree was down. The neighbors stated in their letter that they have asked the applicants several times to have the large trees on their property checked by an arborist to ensure safety of the property',and surrounding properties. FINDINGS OF FACT/REASONS FOR BOARD ACTION: The Zoning Board of Appeals held a public hearing on this application on March 5, 2020 at which time written and oral evidence were presented. Based upon all testimony, documentation, personal inspection of the property and surrounding neighborhood, and other evidence,the Zoning Board finds the following facts to be true and relevant and makes the following findings: 1. Town Law X267-b(3)(b)(1). Grant of the variances will not produce an undesirable change in the character of the neighborhood ora detriment to nearby properties. Many of homes in this residential neighborhood are of similar size and homes in the area do have swimming pools. The Right of Way (Hilltop Path) is used by the community to gain access to the beach on Long Island Sound. The subject property sits high above,Hilltop Path and the deck, which is a wood platform at grade cannot be seen and the proposed'pool will not be seen from either street frontage. 2. Town Law X267-b(3)(b)(2). The benefit sought by the applicant cannot be achieved by some method, feasible for the-applicant to pursue, other than area variances. Due to the merger of the lots, two front yards were created and there is no conforming rear yard in which to locate a pool or deck. 3. Town Law §267-b(3)(bj(3). The variances granted herein are mathematically substantial, representing 100% relief from the code for both the proposed swimming pool and the as built wood deck. 'However, due to the merger of the two lots, the property is rendered with two front yards and no conforming rear yard and both are and will be located in the"architectural" rear yard behind the front of the existing home. The current"as built"wood deck will be repaired as,it is poor condition and will remain on grade. The proposed in-ground pool will measure 20 foot by 40 foot. The lot coverage will be,increased from 8.2%to 10.6%, an increase of 2.4% lot coverage. 4. Town Law 4267-b(3)(b)(4). No evidence has been submitted to suggest that a variance in this residential community will have an adverse impact on the physical or environmental conditions in the'neighborhood. The applicant must comply with Chapter 236 of the Town's Storm Water Management Code. 5. Town Law &267-b(3)(b)(5). The difficulty has been self-created. The applicant purchased the parcel after the Zoning Code was in effect and it is presumed that the applicant had actual or constructive knowledge of the limitations on the use of the'parcel under the Zoning Code in effect prior to or at the time of purchase. The merger of the two lots created the problem of two front yards to which the code does not allow accessory structures such as in-ground swimming pools in front yards. 6. Town Law &267-b. Grant of the requested relief is the minimum action necessary and adequate to enable the applicant to enjoy the benefit of an in-ground pool and legalizing the existing deck while preserving and protecting the character of the neighborhood.and the health, safety and welfare of the community. Page 3,June 25,2020 #7381,McDermott,Agusa SCTM No. 1000-54-1-26.1 RESOLUTION OF THE BOARD: In considering all of the above factors and applying the balancing test under New York Town Law 267-B, motion was offered by Member Acampora, seconded by Member Dantes, and duly carried,to GRANT the variances as applied for, and shown on the survey map prepared by Angelo Joseph Cecere, L.S. of AJC Land Surveying and PLLC, last revised January 3, 2020 and "as built" deck and in-ground swimming pool drawings prepared by Nigel Robert Williamson, Architect, and dated July 17, 2019. SUBJECT TO THE FOLLOWING CONDITIONS: 1. Pool mechanicals shall be placed in a sound deadening enclosure. 2. Drywell for pool de-watering shall be installed. 3. A Town Code compliant fence surrounding the in-ground swimming pool shall be installed. That the above conditions be written into the Building Inspector's Certificate of Occupancy, when issued. Any deviation from the survey, site plan and/or architectural drawings cited in this decision will result in delays and/or a possible denial by the Building Department of a building permit, and may require a new application and public hearing before the Zoning Board of Appeals. Any deviation from the variance(s) granted herein as shown on the architectural drawings, site plan and/or survey cited above, such as alterations, extensions, or demolitions, are not authorized under this application when involving nonconformities under the zoning code. This action does not authorize or condone any current or future use, setback or other feature of the subject property that may violate the Zoning Code, other than such uses, setbacks and other features as are expressly addressed in this action. In the event that this is an approval subject to conditions, the approval shall not be deemed effective until such time that the foregoing conditions are met; and failure to comply therewith will render this approval null and void. The Board reserves the right to substitute a similar design that is de minimis in nature for an alteration that does not increase the degree of nonconformity. Pursuant to Chapter 280-146(B) of the Code of the Town of Southold any variance granted by the Board of Appeals shall become null and void where a Certificate of Occupancy has not been procured,and/or a subdivision map has not been filed with the Suffolk County Clerk,within three (3)years from the date such variance was granted. The Board of Appeals may, upon written request prior to the date of expiration, grant an extension not to exceed three(3)consecutive one(1)year terms. I've stated to you for the past several years (see the four enclosed letters) that this was a danger and certain trees should be taken down. There is still a high risk that more of the old trees will come down and someone will be injured. If that happens you will probably be hit with a large lawsuit which will be much more expensive than simply removing the trees. The tree that did come down fell approximately where your new swimming pool is proposed. Removing the other trees could help you get approval for the pool which we have no objection to at this point.
