SUFFOLK COUNTY ADMINISTRATIVE CODE: This application was not required to be referred to the Suffolk County Department of Planning under the Suffolk County Administrative Code Sections A 14-14 to 23. LWRP DETERMINATION: The relief, permit, or interpretation requested in this application is listed under the Minor Actions exempt list and is not subject to review under Chapter 268. PROPERTY FACTS/DESCRIPTION: The subject property is a nonconforming 32,730 square foot parcel located in the Residential R-40 Zoning District. The northerly property line measures 165.00 feet and is adjacent to a vacant parcel that is heavily treed, the easterly property line measures 167.83 feet. The property then makes a southwest slant of 36.95 feet and is adjacent to Youngs Road to the east. The southerly property line measures 147.03 feet and the westerly property lines measures 200.11 feet. The property is improved with a single family one- and one-half story framed dwelling with an attached two car garage on the south side of the residence and an attached wood deck at the rear of the home. The property has many large boulders scattered throughout, and the existing residence is not sited parallel to the road or property lines, but rather it is located in a catty-cornered position to the northerly end of the property as shown on the topographical survey map prepared by Barrett, Bonacci and Van Weele,PC, and last revised June 25, 2019.. BASIS OF APPLICATION: Request for Variances from Article XXIII, Section 280-124 and the Building Inspector's October 17, 2019,Notice of Disapproval based on an application for a permit to construct additions and alterations to an existing single family dwelling; at, 1) located less than the code required rear yard setback of 50 feet; 2) located less than the code required side yard setback of 15 feet; located at 925 Youngs Road, Orient, NY. SCTM No. 1000-18-1-4. RELIEF REQUESTED: The applicant requests variances to construct additions and alterations to an existing single-family dwelling and to expand a wood deck attached to the dwelling, which will surround an accessory semi-in ground swimming pool. These improvements will have a rear yard setback of 36.8 feet where code requires a minimum of 50 feet, and a single side yard setback of 11.9 feet where code requires a minimum of 15 feet Page 2,June 25,2020 #7378, 95 Youngs Road LLC SCTM No. 1,000-18-1-4 ADDITIONAL INFORMATION: During the Public hearing a neighbor to the west addressed the Board to express his opposition to the applicant's proposal. He explained that because his property slopes uphill to about 40 feet, he does not want to look down on the pool and deck. It was explained to him that if the applicant were to detach,the deck and pool from the house, move to measure only 10 feet from the property line, he would not be before this Board for the variances. The applicant has applied to the Suffolk County Department of Health Services to update and relocate the current septic system and has hired a landscape architect to make aesthetic improvements to the property. FINDINGS OF FACT/REASONS FOR BOARD ACTION: The Zoning Board of Appeals held a public hearing on this application on March 5, 2020 at which time written and oral evidence were presented. Based upon all testimony, documentation, personal inspection of the property and surrounding neighborhood, and other evidence,the Zoning Board finds the following facts to be true and relevant and makes the following findings: 1. Town Law &267-b(3)(b)(1). Grant of the variances will not produce an undesirable change in the character of the neighborhood or a detriment to nearby properties. The addition will be added to the rear of the home and not visible from the street. Many of the homes in this community have non-conforming setbacks and there are other in-ground swimming pools in'the area. 2. Town Law X267-b(30)(2). The benefit sought by the applicant cannot be achieved by some method, feasible for the applicant to pursue, other than area variances. The irregular positioning of the existing house and the location of many large glacial boulders on the subject property limits where a deck and pool can logically be located 3. Town Law 4267-b(3)(b)(3). The variances granted herein are mathematically substantial, representing 26;4% relief from the code for the rear yard setback and 20.6 relief from the code for the side yard setback. However, because the location of the residence and the proposed deck and pool are not parallel to the property lines, the non-conforming setbacks occur in a small triangular section of the small rear yard in the northerly corner of the subject property and will have no adverse environmental impacts and will be blocked from view for the most part by existing woods and evergreen screening and by the conforming residence. 4. Town Law §267-b(3)(b)(4). No evidence has been submitted to suggest that a variance in this residential' community will have an adverse impact on the physical or environmental conditions in the neighborhood. The applicant must comply with Chapter 236 of the Town's Storm Water Management Code. 5. Town Law 267-b 3 b 5 : The difficulty has been self-created. The applicant purchased the parcel after the Zoning Code was in effect and it is presumed that the applicant had actual or constructive knowledge of the limitations on the use of the parcel under the Zoning Code in effect prior to or at the time of purchase 6. Town Law§267-b. Grant of or the requested relief is the minimum action necessary and adequate to enable the applicant to enjoy the benefit of a deck addition and semi-in ground pool while preserving and protecting the character of the neighborhood and the health, safety and welfare of the community. RESOLUTION OF THE BOARD: In considering all of the above factors and applying the balancing test under New York Town Law 267-B, motion was offered by Member Acampora, seconded by Member Planamento, and duly carried,to Page 3, June 25,2020 #7378, 95 Youngs Road LLC SCTM No. 1000-18-1-4 GRANT the variances as applied for, and shown on the architectural plan prepared by Meryl Kramer, Architect, last revised November 20, 2019; and the site plan (Residential Sanitary Plan) prepared by Michael Marinis, L.P.E., of Barrett, Bonacci, and Van Weele, PC, last revised February 3, 2020. SUBJECT TO THE FOLLOWING CONDITIONS: 1. Pool mechanicals shall be placed in a sound deadening enclosure. 2. Drywell for pool de-watering shall be installed. 3. The subject decks shall remain open to the sky. That the above conditions be written into the Building Inspector's Certificate of Occupancy, when issued. Any deviation from the survey, site plan and/or architectural drawings cited in this decision will result in delays and/or a possible denial by the Building Department of a building permit, and may require a new application and public hearing before the Zoning Board of Appeals. Any deviation from the variance(s)granted herein as shown on the architectural drawings, site plan and/or survey cited above, such as alterations, extensions, or demolitions, are not authorized under this application when involving nonconformities under the zoning code. This action does not authorize or condone any current or future use, setback or other feature of the subject property that may violate the Zoning Code, other than such uses, setbacks and other features as are expressly addressed in this action. In the event that this is an approval subject to conditions, the approval shall not be deemed effective until such time that the foregoing conditions are met; and failure to comply therewith will render this approval null and void. The Board reserves the right to substitute a similar design that is de minimis in nature for an alteration that does not increase the degree of nonconformity. Pursuant to Chapter 280-146(B) of the Code of the Town of Southold any variance granted by the Board of Appeals shall become null and void where a Certificate of Occupancy has not been procured, and/or a subdivision map has not been filed with the Suffolk County Clerk,within three (3)years from the date such variance was granted. The Board of Appeals may, upon written request prior to the date of expiration, grant an extension not to exceed three (3) consecutive one (1) year terms. Prior to the issuance of my letter, I asked the ZBA Board Assistant to request that your office submit a letter to us from the adjacent homeowner approving the change of location, since they voiced concerns about the pool location at the public hearing. Having received none,the denial was issued. Subsequently, we received a letter of consent on August 18, 2021 from Mr. and Mrs. Hughes of 1025 Petes Hill Road, Orient, indicating their understanding that the new location of the equipment will be within 10 feet of the side and rear yard and housed in a sound deadening enclosure with landscaped screening. I have determined that your request is now de minimus in nature since the change does not further increase the property's nonconformity. Therefore; the property owner has permission to relocate the pool equipment away from the originally proposed to the newly proposed location as indicated in red ink on a copy of the "residential sanitary plan" dated October 30, 2019 that you submitted to this office. Please be advised that the conditions set forth in Appeal No. 7378 will still apply. The granting of the requested relief from Article XXIII,Section 280-124 ill not have an undesirable impact on the character of the neighborhood or detriment t �'� r� e because the surrounding community is characterized by dwellings which are also located closer to property lines than the required setbacks, including those like the applicant's. The proposed deck and swimming pool addition will be located completely behind the existing house and,will not be visible from the road. 2. The benefit sought by the applicant cannot be achieved by some method feasible for the applicant to pursue other than an`area variance, because of the irregular positioning of the existing house on the lot. The house is not located parallel to the property lines and therefore the proposed addition to the rear of the house, which aligns with the dimensions of the existing house, violates the required side and rear yards. Additionally,the lot contains large boulders. Because of the difficulty and expense required to unearth and relocate boulders, it was decided that the most economical way to construct the swimming pool was to construct a raised pool and deck addition attached to the existing deck structure. 3. The relief requested is mathematically substantial but because the house and proposed addition are not parallel to the property lines,the setback violation occurs at small triangular portions located at the corners. Only 140 sf(8.9%) of the proposed 1558 sf deck and pool addition lies within the non-conforming rear yard setback, and only 67 sf(4.3%) lies within the non-conforming side yard setback. The relief applies to a deck and pool which will be visually unobtrusive and mostly concealed by the existing conforming house. 4. The proposed project will not have an adverse effect on the physical or environmental conditions in the neighborhood. This addition will be added to the rear of the home and not be highly visible from the street. This is a modest addition that will not disturb or displace a large amount of the property. As part of the proposed construction project,the applicant will be replacing an existing non-conforming septic system with a new Suffolk County code- conforming septic system. 5. The alleged difficulty was not self-created because the existing, permitted dwelling structure was constructed on the lot in an unconventional orientation (not parallel to the property lines). Books. Bank Accounts All funds of the Company shall be deposited in the Member(s) name in a bank account or accounts as chosen by the Member. Withdrawals from any bank accounts shall be made only in the regular course of business of the Company and shall be made upon such signature or signatures as the Member from time to time may designate. 9. Management of the Company 9.1 Designation of Manager. Sharon Lesser Maguire shall be designated as the Manager. The Manager is authorized to execute and deliver, on behalf of the Company, any and all documents in connection with the Company's investments. 9.2 Day to Day Management. Title to any or all such Company assets may be held in the name of the Company, one or more nominees or in "street name", as the Member may determine. Except as limited by the Statutes, the Member may engage in other business ventures of any nature, including, without limitation by specification, the ownership of another business similar to that operated by the Company. The Company shall not have any right or interest in any such independent ventures or to the income and profits derived therefrom. ❑ - MULTI-MEMBER: Right of First Refusal If a Member desires to sell, transfer or otherwise dispose of all or any part of their interest in the Company, such Member(the "Selling Member") shall first offer to sell and convey such interest to the other Members before selling, transferring or otherwise disposing of such interest to any other person, corporation or other entity. Such offer shall be in writing, shall be given to every other Member, and shall set forth the interest to be sold, the purchase price to be paid, the date on which the closing is to take place (which date shall be not less than thirty 7 nor more than sixty days after the delivery of the offer), the location at which the closing is to take place, and all other material terms and conditions of the sale, transfer or other disposition. Within fifteen days after the delivery of said offer the other Members shall deliver to the Selling Member a written notice either accepting or rejecting the offer. Promptly after the termination of the Company, the Liquidating Agent shall cause to be prepared and furnished to the Members a statement setting forth the assets and liabilities of the Company as of the date of termination. The Liquidating Agent, to the extent practicable, shall liquidate the assets of the Company as promptly as possible, but in an orderly and businesslike manner so as not to involve undue sacrifice. The owner of the property has requested that we relocate the pool equipment away from the deck, as it is an eyesore. We propose to relocate it within a sound deadening enclosure (as per the conditions of the determination),amidst dense evergreen trees in the rear yard as perthe attached marked up ZBA approved plan. We are requesting that the ZBA approve this discrepancy as a de minimus variance as there are no discernable impacts to the neighboring properties or surrounding community.
