SUFFOLK COUNTY ADMINISTRATIVE CODE: This application was referred as required under the Suffolk County Administrative Code Sections A 14-14 to 23, and the Suffolk County Department of Planning issued its reply dated November 13, 2019 stating that this application is considered a matter for local determination as there appears to be no significant county-wide or inter-community impact. LWRP DETERMINATION: The relief, permit, or interpretation requested in this application is listed under the Minor Actions exempt list and is not subject to review under Chapter 268. PROPERTY FACTS/DESCRIPTION: The subject property is a 10,000 sq. ft. parcel located in an R-40 Zoning District. The parcel has 50.00 ft. of road frontage on Hummel Avenue, then runs north 200.00 ft. to the rear property line,then east for 50.00 ft. before returning 200.00 ft. to Hummel Avenue. The property is improved with an existing two story dwelling, and an accessory building(as built accessory apartment) located in the rear yard as shown on site plan prepared by Anthony Portillo,R.A., dated September 27,2019. BASIS OF APPLICATION: Request for a Variance from Article XXIII, Section 280-124 and the Building Inspector's October 1, 2019, Amended October 3, 2019 Notice of Disapproval based on an application for a permit to construct a porch addition attached to an existing single family dwelling; 1) located less than the code required minimum combined side yard setback of 25 feet; and 2). Request for a variance from Article 111, Section 280-15; based on an application for a permit to legalize"as built"additions and alterrations to an accessory garage converted in to an"as built" accessory apartment at 1) located less than the code required minimum side yard setback of 5 feet located at 1065 Hummel Avenue, Southold,NY. SCTM#1000-63-2-26. RELIEF REQUESTED: The applicant requests variances to construct a porch addition to an existing single-family dwelling with a combined side yard setback of 22.7 ft. where a 25 foot minimum combined side yard setback is required by code; and to legalize as built additions and alterations to an accessory garage converted to an"as built" accessory apartment with a side yard setback of 1.2 feet where the code requires a minimum side yard setback of 5 feet . Page 2, June 25,2020 #7359,Reinckens SCTM No. 1000-63-2-26 ADDITIONAL INFORMATION: The existing dwelling and accessory structure was legalized with pre-co # Z- 24967, dated April 7, 1997. The owner also submitted an application to legalize an "as built" accessory apartment within the existing accessory garage File No. 7361 SE. The main house on the property is occupied by the owner's son, where the owner is living in the as built accessory apartment due to medical issues. During the hearing, the applicants signed a lease agreement and submitted same to the Board. FINDINGS OF FACT/REASONS FOR BOARD ACTION: The Zoning Board of Appeals held a public hearing on this application on March 5, 2020 at which time written and oral evidence were presented. Based upon all testimony, documentation, personal inspection of the property and surrounding neighborhood, and other evidence,the Zoning Board finds the following facts to be true and relevant and makes the following findings: 1. Town Law X267-b(3)(b)(1). Grant of the variances will not produce an undesirable change in the character of the neighborhood or a detriment to nearby properties. The proposed porch addition is in keeping with the character of the existing house, and the other houses in the neighborhood. The non-conforming side yard setback of the as built addition to the existing accessory garage will not produce an undesirable change in the character of the neighborhood or a detriment to nearby properties because it is totally screened from the side yard be a stockade fence and evergreens and the neighboring property also contains a shed on the other side of the fence. 2. Town Law X267-b(3)(b)(2). The benefit sought by the applicant cannot be achieved by some method, feasible for the applicant to pursue, other than an area variance. The proposed covered porch addition complies with the minimum side yard setbacks, but when added to the whole of the house will need relief for the combined side yard. Additionally, the as built accessory garage converted to an accessory apartment cannot be moved to a conforming location without causing unreasonable financial hardship to the applicant because it is on a foundation. 3. Town Law $267-b(3)(b)(3). The combined side yard variance for the proposed covered porch granted herein is mathematically substantial, representing 9.2 % relief from the code. However, the proposed structure will be a covered porch, not enclosed habitable space. The side yard setback for the accessory building is mathematically substantial, representing 76% relief from the code. However, the structure was legal under an existing pre-co and is only requesting variance relief for the side yard setback due to an addition on the west (opposite) side of the structure. 4. Town Law §267-b(3)(b)(4). No evidence has been submitted to suggest that a variance in this residential community will have an adverse impact on the physical or environmental conditions in the neighborhood. The applicant must comply with Chapter 236 of the Town's Storm Water Management Code and the conditions set forth by this board. 5. Town Law X267-b(3)(b)(Q. The difficulty has been self-created. The applicant purchased the parcel after the Zoning Code was in effect and it is presumed that the applicant had actual or constructive knowledge of the limitations on the use of the parcel under the Zoning Code in effect prior to or at the time of purchase. 6. Town Law X267-b. Grant of the requested relief is the minimum action necessary and adequate to enable the applicant to enjoy the benefit of a open porch, and an as built addition to an existing accessory building while preserving and protecting the character of the neighborhood and the health, safety and welfare of the community. New York Town Law 267-B, motion was offered by Member Lehnert, seconded by Member Acampora, and duly carried,to GRANT the variances as applied for, and shown on the site plan prepared by Anthony Portillo,Architect, of AMP Architecture, and dated September 27,2019. SUBJECT TO THE FOLLOWING CONDITIONS: 1. The applicant shall furnish the board with a signed/sealed site plan and affidavit from a licensed professional stating that the existing sanitary system is capable of servicing the existing house and the as built accessory(apartment)structure. 2. The front porch addition shall remain open and not enclosed to form habitable space. 3. This approval shall not be deemed effective until the required conditions have been met; and failure to comply therewith will render this approval null and void That the above conditions be written into the Building Inspector's Certificate of Occupancy, when issued Any deviation from the survey, site plan and/or architectural drawings cited in this decision will result in delays' and/or a possible denial by the Building Department of a building permit, and may require a new application and public hearing before the Zoning Board of Appeals. -Any deviation from the variance(s) granted herein as shown on the architectural drawings, site plan and/or survey, cited above, such as alterations, extensions, or demolitions, are not authorized under this application when involving nonconformities under the zoning code. This action does not authorize or condone any current or future use, setback or other feature of the subject property that may violate the Zoning Code, other than such uses, setbacks and other features as are expressly addressed in this action. In the event that an approval is granted subject to conditions, the approval shall not be deemed effective until the required conditions have been met; and failure to comply therewith will render this approval null and void., The Board reserves the right to substitute a similar design that is de minimis in nature for an alteration that does not increase the degree of nonconformity. Pursuant to Chapter 280-146(B) of the Code of the Town of Southold any variance granted by the Board of Appeals shall become null and void where a Certificate of Occupancy has not been procured,and/or a subdivision map has not been filed with the Suffolk County Clerk,within three(3)years from the date such variance was granted. Being there is a cottage on the property and we don't have c/o yet from the town showing that pending the septic.There is a bit of confusion from the health department not wanting to issues the permit without an updated c/o showing the cottage. The-variances granted herein are mathematically substantial for proposed lot 25, representing 70% relief and proposed lot 26 represents 75% relief from the code for lot area. The request for lot width for proposed lot 25 represents 60% relief and proposed lot 26 represents 67% relief from the code for lot width. However, these are described parcels which have been in existence since prior to zoning and conform substantially to the current neighborhood. Parcel 26 is the last unimproved lot on this block. 4.
