C. 13250 Main Road PO Box 1452 Mattituck, N.Y. 11952 Re: Extension of Approval: Tenedios Agricultural Barn & Greenhouse #3 28410 NYS Route 25, s/w corner of Narrow River Road & Route 25, Orient SCTM#1000-19.-1-1.4 & 1.3 Dear Mr. Finnegan: The following resolution was adopted at a meeting of the Southold Town Planning Board on Monday, September 9, 2024: WHEREAS, this amended agricultural site plan is for the relocation of a one story 8,664 sq. ft. building to house livestock and store feed, supplies and farm equipment; which was granted conditional approval from the Planning Board in 2019 and not constructed. The plan includes a 60' x 24' (1,440 sq. ft.) greenhouse and other accessory agricultural buildings on a 34.5-acre farm, of which 29.5 acres have development rights held by Southold Town and 5 acres have development rights intact (the greenhouse is located in the 5-acre area and the barn is located in the 29.5-acre area) in the R-200 Zoning District; and WHEREAS, on March 9, 2021, the Planning Board determined certain conditions to be met and therefore granted approval to the amended site plan application described above; and WHEREAS, on December 22, 2021, Patricia Moore, authorized agent, submitted a request for Extension of Site Plan Approval for two (2) years to August 9, 2024; and Tenedios Amended #3 Page 2 September 10, 2024 WHEREAS, at a Work Session held on February 7, 2022, the Planning Board reviewed the application and determined that the expired Site Plan was in compliance with current rules and regulations and granted an extension; and WHEREAS, pursuant to §280-132(A) [...all terms and conditions of any approved site plan or approved amendment are immediately enforceable, and compliance is required prior to the commencement of the approved use, unless the Planning Board expressly states an alternative period of time for compliance within the site plan approval; and WHEREAS, on February 7, 2022, the Southold Town Planning Board granted an Extension of Approval with Conditions, listed below, for two years and six months from February 7, 2022 to August 9, 2024 of the site plan entitled "Amended Site Plan for Tenedios Farm", prepared by Jeffrey T. Butler, P.E. dated March 22, 2017 and last revised July 1, 2019; and WHEREAS, on August 9, 2024, the amended site plan approval extension expired; and WHEREAS, on August 26, 2024, Martin Finnegan, agent, submitted a request for Extension of Site Plan Approval for one (1) year to August 9, 2025; and WHEREAS, at a Work Session held on September 9, 2024, the Planning Board reviewed the application and determined that the expired Site Plan was in compliance with current rules and regulations and granted an extension; therefore be it RESOLVED, that the Southold Town Planning Board grants an Extension of Approval with Conditions, listed below, for one year from September 9, 2024 to September 9, 2025, of the site plan entitled "Amended Site Plan for Tenedios Farm", prepared by Jeffrey T. Butler, P.E. dated March 22, 2017 and last revised July 1, 2019. Conditions of approval (ongoing) Tenedios Barn & Greenhouse Amended Site Plan Application 1. The purpose of this amended site plan is to consolidate and replace the plan that received conditional site plan approval on January 14, 2019, entitled "Tenedios Farm", prepared by Jeffrey T. Butler P.E., dated March 22, 2017 and last revised October 16, 2018; and to acknowledge the proposed construction of a 1,440 sq. ft. greenhouse; 2. The public is not permitted to access the barn or greenhouse; 3. The barn and the driveway to the barn shall be used for agricultural purposes only as per the Town's easement; Tenedios Amended #3 Page 3 September 10, 2024 4. Livestock grazing, paddocks, shelters and enclosures shall be located outside the vegetated buffers shown on the site plan; 5. Livestock shall be prevented from entering the vegetated buffers; 6. Buffers: Vegetated Buffers 2 & 3 shall be managed for the following benefits: a. Provide denitrification and nutrient uptake; b. Slow water runoff and enhance infiltration; c. Trap pollutants in surface runoff& subsurface flow; d. Stabilize soils. Vegetated Buffer 1 shall be managed to maintain existing trees, shrubs and groundcover; 7. Signs: Any sign that requires a sign permit must be reviewed and approved by the Planning Board prior to installation; 8. Lighting: No exterior lights were reviewed or approved in connection with this amended site plan. Any exterior lights on or around the outside of this greenhouse must be reviewed and approved by the Planning Board and must meet Town Code §172 Lighting; 9. The Planning Board strongly encourages the property owner to follow the guidelines developed by the USDA for sustainable numbers of animals on pasture. The Board further encourages the farm owner to request a nutrient management plan for the animal husbandry portion of the farm, as well as consulting with the USDA Natural Resource Conservation Service (NRCS). The Board also strongly encourages the property owner to develop a Comprehensive Nutrient Management Plan (CNMP) to address nutrient loading to surface and ground waters by working with the Suffolk County Soil and Water Conservation District and/or USDA NRCS. Please also note the following requirements in the Southold Town Code relating to Site Plans:. 1. Any new lighting fixtures beyond those approved as part of the Lighting Plan must conform to the Code and may require Planning Board approval depending on their number, size, intensity and location. Fixtures shall be shielded so the light source is not visible from adjacent properties and roadways and shall focus and direct the light in such a manner as to contain the light and glare within property boundaries and conform to §172 of the Town Code. Tenedios Amended #3 Page 4 September 10, 2024 2. All storm water run-off from grading, driveways and gravel areas must be contained on site. 3. Proposed storm water run-off containment systems must be inspected by the Town Engineer at the time of installation. Please call the Southold Town Engineer prior to beginning this work. 4. Approved Site Plans are valid for eighteen months from the date of approval, within which time all proposed work must be completed, unless the Planning Board grants an extension. 5. Any changes from the Approved Site Plan shall require Planning Board approval. 6. Prior to the issuance of a Certificate of Occupancy, the Planning Board must inspect the site to ensure it is in conformity with the Approved Site Plan, and issue a Final Site Inspection approval letter. Should the site be found not in conformance with the Approved Site Plan, no Certificate of Occupancy may be issued unless the Planning Board approves the changes to the plan. The building has been moved out of the flood zone and the DEC permit has been amended; yet there are items to be addressed regarding existing exterior light glare and enforcement of the site plan farm management conditions on site. ➢ As previously discussed, the greenhouse was not supported for a CO because livestock were grazing within the 50' vegetated buffer #2, not consistent with the site plan conditions. To date, nothing physical has been changed on site to prevent this from happening. The Board should consider whether to require a fence (or other) to be constructed on site to mark the edge of the 50' vegetated n buffer #2 in order to mitigate violation of the site plan farm management conditions. *This can be required as a clarification to the site plan conditions of approval. See proposed wording in bold text below under "Conditions from Previous Approval" ➢ An animal enclosure continues to exist in the southwest corner of the site, within proximity or within both vegetated buffers #1 and #2. This was previously used as a pig enclosure but has not been recently occupied. The applicant has not complied with the explicit conditions of the approved site plan. As explained in the January 13, 2020 staff report (at page 2): "Livestock have not been prevented from entering Vegetated Buffer #2. Livestock were observed along the west/southwest farm area in Vegetated Buffer #2. (see photos)." More than a year later, this has not been corrected, as explained in the January 25, 2021 staff report (at page 3): "livestock were grazing within the 50' vegetated buffer #2, not consistent with the site plan conditions. To date, nothing physical has been changed on site to prevent this from happening." Because there is presently no physical barrier and the applicant has allowed livestock to enter the buffers in violation of the site plan conditions, there is no basis to assume that the applicant will prevent those violations from continuing to occur if no fence is erected. 2. NYS DEC explicitly requires the Tenedios/Fresh&Co Farm to fence all of the vegetated buffers shown on the site plan. Buffers shall be fenced so as to prevent livestock from grazing in them." DEC's conditions are attached for your information. The Town's site plan conditions should not be less stringent than DEC's. 3. The LWRP memorandum to the Planning Board dated April 25, 2018, for the original site plan application (at page 11)recommended that the Board impose a condition or covenant requiring the applicant to "fence vegetated buffer areas to avoid use by animals." 4. It is not sufficient to use an application for a C.O. as the trigger for compliance with site plan conditions. All conditions of the original site plan should have been complied with long ago. The applicant has already built the greenhouse and is not in compliance with the conditions. The Board should not allow an applicant to obtain site plan approval, obtain building permits, construct and occupy the structures, and then flout the site plan conditions imposed by this Board and avoid enforcement merely by not pursuing a C.O. It was more than a year ago (on January 16, 2020)that the Planning Department wrote to the applicant at your direction following the January 13, 2020 Work Session, directing the applicant to comply with Conditions#4 &# 5 in the February 11, 2019 Planning Board approval resolution before the Board could support a C.O. That has obviously not been effective in causing compliance. (If structures are occupied despite the lack of a C.O., that is an additional violation of Town code, whether or not the Town enforces it.)' Your staff recommend that, as to timing, the condition should be worded as follows: "The fence must be constructed within six months of this approval, and prior to a building permit being issued for the new barn." We believe that the fences can and should be erected in less than six months, and certainly before issuance of a building permit. 5. The Board has indicated that it does not want to get too deeply involved in regulating the day-to-day operation of a farm. But that is exactly what a vague condition like the one proposed by the applicant's attorney (i.e., fencing to be required only if the landowner keeps livestock in the areas adjacent to the buffers) would do. Livestock can be in one pasture at times and in other areas at other-times. Does the Board As the Board is also aware,the applicant was issued three summonses in December 2018 for violating the Town code by commencing construction on the greenhouse without site plan approval or building permits and for a stop work order. Planning Board February 4, 2021 Page 3 intend to regularly inspect the farm to determine where the livestock are grazing? A fence condition is a simple, straightforward requirement for structures. In contrast, a condition that depends upon where the applicant may choose to keep livestock at any given time requires more policing and oversight of farm management by the Town, not less. The Planning Board should require all of the vegetated buffers to be fenced immediately as an explicit condition of the amended site plan approval, and before a building permit is issued for the barn. On 1/11 the Board will review the 1st site plan which includes the 8,000 sq.ft. barn and greenhouse (which was built and CO pending). I reminded Steve that the site plan inspection for the issuance of the CO for the greenhouse required correcting 2 issues: 1. the fence (paddock) has not been adjusted (or another/ second fence) to maintain the 50' buffer and prevent grazing within the buffer area. 2. a pig pen in the south/westerly buffer area-„ there 11aye beeq__0 .,., ici5_1n over 2 years (he had pigs only one season). Steve said that the fencing is electrified with deep fence posts, it is very costly and difficult to remove, he is leaving the fence but not using the area as a pen. He will be sure there are no huts in the pen. the pen has not been used for animals- it is just a fenced area. 3. Board inspected for the new site plan- all seemed OK- the only issue are the spot lights on the buildings. Some of the lights (bulbs) dropped below the fixture and would not shield the light...this was a complaint by the neighbors & does not meet town's "dark sky's" lighting code. The spot lights were disabled as soon as he received the complaint after the public hearing. When the weather warms he will remove the fixtures (or whatever fixtures remain he will make sure they conform). The fixtures the Board saw are the old fixtures (disabled-disconnected).
