ADDITIONAL INFORMATION: ZBA Appeal Number 2993, dated May 20, 1982 granted variance relief for the current location of the garage. FINDINGS OF FACT/REASONS FOR BOARD ACTION: The Zoning Board of Appeals held a public hearing on this application on October 10,2019 at which time written and oral evidence were presented. Based upon all testimony, documentation, personal inspection of the property and surrounding neighborhood, and other evidence,the Zoning Board finds the following facts to be true and relevant and makes the following findings: 1. T'-own-Lw*-4267-bP1fb4(1). Grant of the variance will,not produce an undesirable change in the character of the neighborhood or a detriment to nearby properties. The subject accessory garage's non-conforming setback was previously approved by the ZBA in decision 42993 and legalized by certificate of occupancy z23719. The subject accessory garage has not been used to store cars for some time since there is no driveway leading to the garage door and an as built accessory shed currently blocks access to the garage door. The garage's current use as a storage building is permitted by town code and ZBA decision 42993. The "as-built" attached outdoor shower maintains the same non-conforming setback as the "accessory garage". The subject accessory structure-has been improved with a French door entrance and small attached deck and the interior has been improved with uninsulated plywood walls that are painted white. These improvements cannot be seen from the street or adjacent properties. 2. Town Law &267-b(3)(b)(2). The benefit sought by the applicant can be achieved by moving the-garage. However, moving the garage is not a practical solution in order to renovate storage space and add an outdoor shower. Therefore,the benefit sought by the applicant requires variance relief. 3. Town Law $267-b(3)(b)(3). The variance granted herein is mathematically substantial, representing 50% relief from the code. However, the garage has the benefit of a prior area variance for the non-conforming side yard setback which is being maintained by the outdoor shower addition and a certificate of occupancy which allows the current use of the accessory structure for storage purposes. 4. Town Law $267-b(3)(b)(4). No evidence has been submitted to suggest that a variance in this residential community will have an adverse impact on the physical or environmental conditions in the neighborhood. The difficulty has been self-created. Although the garage's non-conforming side yard setback received previous variance relief and a certificate of occupancy, the addition of the as built outdoor shower,which extends along the non-conforming setback, is not permitted without a building permit and additional variance relief. 6. Town Law 6267-b. Grant of the requested relief is the minimum action necessary and adequate to enable the applicant to enjoy the benefit of storage space with an outdoor shower while preserving and protecting the character of the neighborhood and the health, safety and welfare of the community.
