Based on the information you submitted, DEC has determined that the project is listed in the Tidal Wetlands Land Use Regulations (6NYCRR Part 661.5 #26) as a use not requiring a permit. Therefore, no permit is required under the Tidal Wetlands Act (Article 25) of the Environmental Conservation Law. As such, enclosed, we are returning the application fee check (#280).
