Narrative Addressing Chapter 275, Chapter 111, and Local Waterfront Revitalization Program Policy No. 4 for KEVIN GALLAGHER 17975 SOUNDVIEW AVENUE SOUTHOLD,NY SCTM#1000-51-1-7 The subject property is located along'a stretch of Long Island Sound shoreline running parallel with Soundview Avenue that has been impacted by shoreline recession and increasing bluff erosion during the more frequent and increasingly severe storm events experienced during the last decade,'including the Christmas 2010 Blizzard, Super Storm Sandy in October 2012, and four major nor'easter events that occurred more recently in March 2018 alone. As a result,properties in this geologic cell have experienced accelerated and severe erosion of the vegetation and soils on their protective bluffs and the landward recession of those bluffs. In response, both the Town of Southold and owners of privately owned properties have been forced to seek approvals for the construction and reconstruction of shoreline stabilization structures, such as rock revetments approved by the Trustees at the property located three to the west of the subject parcel in 2011 (Wetlands and Coastal Erosion Management Permits 7692/7692C, 17665 Soundview Avenue); the property located four to the west of the subject parcel in 2015 (Wetlands and Coastal Erosion Management Permits 8682/8682C, 17555 Soundview Avenue); and the adjacent property to the east in 2016 (Wetlands and Coastal Erosion Management Permits 8762/8762C, 18075 Soundview Avenue). Also located less than a mile to the east of the subject property is the rock revetment that was installed by the Town of Southold in 2011 to prevent the collapse of Soundview Avenue itself. Severe bottom-up erosion of the subject bluff is evidenced by a landward receding bluff toe; a steepening bluff face; and the loss of substantial soil material and vegetation on the bottom two-thirds of the bluff face. Therefore, in 2015,to remediate this process of erosional loss and the potential damage to and loss of residential structures located landward of the bluff, an erosion control project was designed for the applicant in accordance with the'generally accepted bluff stabilization design recommended by the USDA Natural Resources Conservation Service, which is to simultaneously stabilize the toe, top, and face of the bluff by implementing a combination of"hard" stabilization at the bluff toe and both hard and "soft" solutions on the bluff face. Specifically, an engineering plan was designed and- submitted to the Trustees, which called for installation of a stone revetment to first stabilize the bluff toe; construction of terrace walls to stabilize the bluff face; and placement of sand renourishment and native plantings to complete the restoration of the bluff face. A 10' wide non-turf buffer planted with native vegetation was also to be established adjacent to the bluff crest to provide improved soil retention and'increased absorption capacity for runoff landward of the bluff during heavy rain events.-,This design plan anticipated construction of the revetment and implementation of the bluff restoration plan in conjunction with the adjacent property to the east, whose permits are referenced above. Page 1 of 2 However, after Wetlands Permit No. 8620 and Coastal Erosion Management Permit No. 8620C were issued for the project by the Trustees following a public hearing held on June 17, 2015, the permits expired prior to the owner's ability to install the revetment, thus necessitating submission of applications for new permits. As the permits for the revetment to be installed along the adjoining property to the east expire in April 2020, plans to install both revetments area scheduled to commence as soon as possible following issuance of new permits to the applicant. As described in the originally submitted applications, pursuant to the principles set forth, by Section 275-11(B)(1)(b), the proposed stone revetment,is proposed in an area suffering from extreme erosion, as,described above and noted in a May 2014 memorandum to the Board of Trustees from the Town's Local Waterfront Revitalization Program (LWRP) Coordinator, who provided an aerial photograph as evidence that the subject bluff was "actively eroding" at the time the above noted stairway application was submitted last year. Consistent with Section 275-11(B)(1)(b), Section 111-15, and Policy 4 of the LWRP, the revetment will be installed with a sloped face and angled returns and will be placed along the existing bluff toe to avoid encroachment on the beach surface seaward of the existing bluff and to avoid causing a measurable increase in erosion at the site or adjacent properties or result in any other adverse impacts on adjacent properties or natural coastal processes and resources. Further pursuant to Section 111-15, the purpose of the proposed structure and integrated erosion control remediation plan as described above is designed specifically to stem the continued denuding and loss of the bluff, the ' property's natural protective feature; and the design has been engineered in accordance with generally accepted engineering principles and is likely to control long-term bluff erosion at the site through long-term maintenance and.its intended ability to withstand inundation, wave impacts,weathering and other effects of storm conditions for a minimum of 30 years. The project is further consistent with Policy 4 of the LWRP because the structure is being proposed only where 1) non-structural, vegetative means alone will not be sufficient at stemming the advanced and ongoing bottom-up bluff erosion at this site; 2) the natural protective feature, i.e., the bluff, cannot be effectively enhanced without effective stabilization at its toe, as evidenced by the recent pattern'of severe erosion throughout this geologic cell; 3) a hard structure is the only design consideration that can practicably and effectively provide such toe stabilization; 4) the proposed structure has been limited to the minimal scale necessary to effectively stem the erosional trend and is based on sound engineering practices; 5) vegetative restoration and enhancement is,and will remain part of the long-term remediation plan design; and 6)there will be no significant, direct or indirect costs incurred by the public as a result of the project. Ultimately, the goal of the project is to stabilize,restore, and enhance the natural protective feature of the property for the purpose of minimizing the loss of structures and natural resources from erosion, which is consistent with the relevant permit standards set forth in Chapters 275 and 111 and with the goals of Policy 4 of the LWRP. As a result, properties in this geologic cell have experienced accelerated and severe erosion of the vegetation and soils on their protective bluffs and the landward recession of those bluffs. In response, both the Town of Southold and owners of privately owned properties have been forced to seek approvals for the construction and reconstruction of shoreline stabilization structures, such as rock revetments approved by the Trustees at the property located three to the west of the subject parcel in 2011 (Wetlands and Coastal Erosion Management Permits 7692/7692C, 17665 Soundview Avenue); the property located four to the west of the subject parcel in 2015 (Wetlands and Coastal Erosion Management Permits 8682/8682C, 17555 Soundview Avenue); and the adjacent property to the east in 2016 (Wetlands and Coastal Erosion Management Permits 8762/8762C, 18075 Soundview Avenue). Also located less than a mile to the east of the subject property is the rock revetment that was installed by the Town of Southold in 2011 to prevent the collapse of Soundview Avenue itself. Severe bottom-up erosion of the subject bluff is evidenced by a landward receding bluff toe; a steepening bluff face; and the loss of substantial soil material and vegetation on the bottom two-thirds of the bluff face. Therefore, in 2015, to remediate this process of erosional loss and the potential damage to and loss of residential structures located landward of the bluff, an erosion control project was designed for the applicant in accordance with the generally accepted bluff stabilization design recommended by the USDA Natural Resources Conservation Service, which is to simultaneously stabilize the toe, top, and face of the bluff by implementing a combination of"hard" stabilization at the bluff toe and both hard and "soft" solutions on the bluff face. Specifically, an engineering plan was designed and submitted to the Trustees, which called for installation of a stone revetment to first stabilize the bluff toe; construction of terrace walls to stabilize the bluff face; and placement of sand renourishment and native plantings to complete the restoration of the bluff face. A 10' wide non-turf buffer planted with native vegetation was also to be established adjacent to the bluff crest to provide improved soil retention and increased absorption capacity for runoff landward of the bluff during heavy rain events. This design plan anticipated construction of the revetment and implementation of the bluff restoration plan in conjunction with the adjacent property to the east, whose permits are referenced above. Page 1 of 2 However, after Wetlands Permit No. 8620 and Coastal Erosion Management Permit No. 8620C were issued for the project by the Trustees following a public hearing held on June 17, 2015, the permits expired prior to the owner's ability'to install the revetment, thus necessitating submission of applications for new permits. As the permits for the revetment to be installed along the adjoining property to the east expire in April 2020, plans to,install both revetments area scheduled to commence as soon as possible following issuance of new permits to the applicant. As described in the originally submitted applications,pursuant to the principles set forth by Section 275-11(B)(1)(b), the proposed stone revetment is proposed in an area suffering from extreme erosion, as described above and noted in a May 2014 memorandum to the Board of Trustees from the Town's Local Waterfront Revitalization Program (LWRP) Coordinator, who provided an aerial photograph as evidence that the subject bluff was "actively eroding" at the time the above noted stairway application was submitted last year. Consistent with Section 275-11(B)(1)(b), Section 111-15, and Policy 4 of the LWRP, the revetment will be installed with a sloped face and angled returns and will be placed along the existing bluff toe to avoid encroachment on the beach surface seaward of the existing bluff and to avoid causing a measurable increase in erosion at the site or adjacent properties or result in any other adverse impacts on adjacent properties or natural coastal processes and resources. Further pursuant to Section 111-15, the purpose of the proposed structure and integrated erosion control remediation plan as described above is designed specifically to stem the continued denuding and loss of the bluff, the property's natural protective feature; and the design has been engineered in accordance with generally accepted engineering principles and is likely to control long-term bluff erosion at the site through long-term maintenance and its intended ability to withstand inundation, wave impacts, weathering and other effects of storm conditions for a minimum of 30 years. The project is further consistent with Policy 4 of the LWRP because the structure is being proposed only where 1)non-structural,.vegetative means alone will not be sufficient at stemming the advanced and ongoing bottom-up bluff erosion at this site; 2) the natural protective feature, i.e., the bluff, cannot be effectively enhanced without effective stabilization at its toe, as evidenced by the recent pattern of severe erosion throughout this geologic cell;,3) a hard structure is the only design consideration that can practicably and effectively provide such toe stabilization; 4) the proposed structure has been limited to the minimal scale necessary to effectively stem the erosional trend and is based on sound engineering practices; 5)vegetative restoration and enhancement is and will remain part of the long-term remediation plan design; and 6) there will be no significant direct or indirect costs incurred by the public as a result of the project. Ultimately, the goal of the project is to stabilize,restore, and enhance the natural protective feature of the property for the purpose of minimizing the loss of structures and natural resources from erosion, which is consistent with the relevant permit standards set forth in Chapters 275 and 111 and with the goals of Policy 4 of the LWRP. As described in the originally submitted applications,�pursuant to the principles set forth by Section 275-11(B)(1)(b), the proposed stone revetment is proposed in an area suffering from extreme erosion, as described above and noted in a May 2014 memorandum to the Board of Trustees from the Town's Local Waterfront Revitalization Program (LWRP) Coordinator, who provided an aerial photograph as evidence that the subject bluff was "actively eroding" at the time the above noted stairway application was submitted last year. Consistent with Section 275-11(B)(1)(b), Section 111-15, and Policy 4 of the LWRP, the revetment will be installed with a sloped face and angled returns and will be placed along the existing bluff toe to avoid encroachment on the beach surface seaward of the existing bluff and to avoid causing a measurable increase in erosion at the site or adjacent properties or result in any other adverse impacts on adjacent properties or natural coastal processes and resources. Further pursuant to Section 111-15, the purpose of the proposed structure and integrated erosion control remediation plan as described above is designed specifically to stem the continued denuding and loss of the bluff, the property's natural protective feature; and the design has been engineered in accordance with generally accepted engineering principles and is likely to control long-term bluff erosion at the site through long-term maintenance and its intended ability to withstand inundation, wave impacts, weathering and other effects of storm conditions for a minimum of 30 years. The project is further consistent with Policy 4 of the LWRP because the structure is being proposed only where 1) non-structural, vegetative means alone will not be sufficient at stemming the advanced and ongoing bottom-up bluff erosion at this site; 2) the natural protective feature, i.e., the bluff, cannot be effectively enhanced without effective stabilization at its toe, as evidenced by the recent pattern of severe erosion throughout this geologic cell; 3) a hard structure is the only design consideration that can practicably and effectively provide such toe stabilization; 4) the proposed structure has been limited to the minimal scale necessary to effectively stem the erosional trend and is based on sound engineering practices; 5) vegetative restoration and enhancement is and will remain part of the long-term remediation plan design; and 6) there will be no significant direct or indirect costs incurred by the public as a result of the project. Ultimately, the goal of the project is to stabilize,restore, and enhance the natural protective feature of the property for the purpose of minimizing the loss of structures and natural resources from erosion, which is consistent with the relevant permit standards set forth in Chapters 275 and 111 and with the goals of Policy 4 of the LWRP.
