35 Second Street,New Suffolk,New York 11956,party of the first part,and
Maria E.Arias,residing at 83-09 Midland Parkway,Jamaica Estates,New York 11432,party of
the second part,
WITNESSETH,that party of the first part,in consideration of Ten Dollars paid by party of the second
part,does hereby grant and release unto the party of the second part,the heirs or successors and assigns
of the party of the second part forever,
ALL that certain plot,piece,or parcel of land,situate,lying and being at New Suffolk,in the Town
of Southold,Suffolk County,New York,bounded and described as follows:

made by Audrey Wetzel,as surviving tenant by the tenants by the entirety who acquired title with her
husband,Edward V.Wetzel,since deceased by deed from Florence P.Grathwohl and James W.Pugsley,
as devisers under the Last Will Testament of Susan V. Pugsley, deceased, File No. 497 P 1969, in
Surrogate's Court in County of Suffolk County, Riverhead, New York. Being the same premises
described in the deed in Liber 8379,Page 462.

TOGETHER with all right,title and interest,if any,of the party of the first part in and to any streets and
roads abutting the above described premises to the center lines thereof, TOGETHER with the
appurtenances and all the estate and rights of the party of the first part in and to said premises;TO
HAVE AND TO HOLD the premises herein granted unto the party of the second part, the heirs or
successors and assigns of the party of the second part forever.
AND the party of the first part covenants that the party of the first part has not done or suffered anything
whereby the said premises have been encumbered in any way whatever,except as aforesaid.
AND the party o f the first part,in compliance with Section 13 of the Lien Law,covenants that the party
of the fust part will receive the consideration for this conveyance and will hold the right to receive such
consideration as a trust fund to be applied first for the purpose of paying the cost of the improvement
and will apply the same first to the payment of the cost of the improvement before using any part of the
total of the same for any purpose. The word"party"shall be construed as if it read"parties"whenever
the sense of this indenture so requires.

LEGAL DESCRIPTION
All that certain plot,piece or parcel of land,with the buildings and improvements thereon erected,
situated,lying and being at New Suffolk,in the Town of Southold,Suffolk County,New York,bounded
and.described as follows:
Beginning at a point on the westerly side of Second Street 209 feet southerly from its intersection with
the southerly line of Jackson Street;running thence along the westerly line of Second Street South 5°05'
West 100 feet to a private beach;running thence along said beach South 87°21'West 55 feet to other land
of the party of the first part;running thence along said land two courses and distances as follows:(1)
North 5°05'East 100 feet;thence(2)North 87°21'East 55 feet to the point or place of beginning.
Together with the use of the beach area for bathing purposes subject to such reasonable rules and
regulations as may be prescribed by the party of the first part,including a maintenance charge not to
exceed$25.00 per year unless agreed upon by the five owners using the same.
Subject to a 10 foot right of way along the northerly boundary for foot passage to the private beach,and
for access to the adjoining lot from Second Street.
