Mary DeMaio predeceased Frank having died on November 14, 2008. On August 13, 2009 Frank DeMaio executed a Disclaimer and Renunciation of Interest wherein he renounced, disclaimed and refused to accept the 50% undivided interest of Mary DeMaio in the subject premises. That Disclaimer and Renunciation was duly filed in the Surrogate's Court Queens County on August 13, 2009. Accordingly the subject premises was then owned undivided 50% interest by Frank DeMaio and 25% undivided interest by Pamela Wonder and 25% undivided interest by Laura Geoghegan. Frank DeMaio died on July 13, 2011. Grantor covenants that Grantor has not done or suffered anything whereby said premises have been encumbered in any way whatever, except as set forth herein. Grantor, in compliance with Section 13 of the Lien Law, covenants that Grantor will receive the consideration for this conveyance and will hold the right to receive such consideration as a trust fund to be applied first for the purpose of paying the cost of the improvement before using any part of the total of the same for any other purpose.
