9:25 A.M. - Accountant John Cushman and Elaine Kaldor, C.P.A. met with the Board
to discuss the statement of expenses and questioned costs with relation to the Village
of Greenport's management of the Southold Scavenger Waste Disposal Plant. Supervisor
Harris will schedule a meeting with Greenport Village officials to iron out any differences
with may exist with respect to the accounting.
-10{10 A.M. - Re,tine and Al Tuffs from Two-Bears Construction Co., along with several
families, met with the Town Board to thank them for helping to resolve the problems
with the affordable homes.
10:35 A.M. - Ed Stilwac~en, President of Sorters, Inc., met with the Town Board to
request temporary permits for the location df a watchman trailer and office trailer at the
oyster factory property at the foot of Shipyard Lane, East Marion. Mr. Stilwagen's
business, cleansing polluted clams, is operated under a NYS-DEC permit and the DEC
requires them to have 24 hour supervision at the site. (See resolution no. 27.)
10:50 A.M. - For Discussion Items: (1) Letter from Robert Thompson, Southold, asking
the Board to enact a noise ordinance. There is currently provision in the zoning code
relative to excessive noise, but a noise ordinance itself is very difficult to enforce. (2)
Councilman Penny suggeste~l the Town Board consider a Farmland and/or Open space
funding for a ~lovember referendum. The Board will make a decision by mid-July.
Discussed proposed "Local Law in Relation to Peddling and Soliciting" - public hearir
'was held on June 5th with some opposition. Town Attorney Arnoff will make request~
changes for resubmission at ~the July 3rd work session. (4) Wendy Norris property -
letter from the CAC encouraging Town purchase, and report from Police Department on
their parking survey of the New Suffolk Avenue/Marratook Avenue area. Also
discussion of the restrictions being placed on the deed with respect to possible purchase -
Town Attorney will request the removal of the mowing and maintenance of split rail fence
condition, and Supervisor will ask the Open Space Committee for a recommendation with
respect to maintenance of open space parcels and their economic~impacts. (5) Discussed
combining the Farmland Committee and Open Space Committee - this will be addressed by
the Legislative committee. (6) Appointment to the CAC to fill a vacancy - hold for July
3rd meeting. (7) Rescind policy with respect to board or committee reappointments (see
resolution no. 28). (8) Authorize to building department personnel to attend a
conference in October. Will be discussed again at a later date. (9) Town Board policy
with respect to military training/National Guard - to be discussed in executive session.
(70) Appointment of technicians for the Fishers Island Mosquito Control Program (see
resolution no. 29). (11) Letter from AR Lombardi Associates, ~onsultants for the
Fishers Island Wastewater Disposal System concerning emergency us of'the system for
disposal of sewage from Fishers Island rather than transporting it to the Connecticut
mainland. The Town Attorney will write to the DEC to determine if they will permit
this discharge before engaging Lombardi to provide engineering services to solve the
septage disposal problem on the island.
12:50 P.M. - Recess for lunch.
2:00 P.M. - Work Session reconvened. For Discussion Items (continued): (12) Reques
from the Fishers Island Development Corporation for the assistance of Planner Valerie
Scopaz to gather data for the preparation of a generic environmental impact statement
of the water resources on Fishers Island. Ms. Scopaz will assist. (13) Councilman
Wickham presented the Waste Management Task Force's recommendations regarding waste
reduction. The Town Board will review and discuss at the July 3rd work session. (14)
Receipt of proposal and plan from L. Von K~hen, Ph.D., Vice President of New Century
Corp. of New York, for the development of Southold Villas as an affordable housing
development and request for a Town Board resolution authorizing the preparation of the
application to the New York State Affordable Housing Corporation for subsidy funds (see
resolution no. 34).--Councilman Wickham then submitted his proposal, as Chairman of
the planning and Zoning Committee, for a three-part review of the Town's affordable
housing policy: I) document how it has worked so far; 2) probable impact of what has
been done; 3) recommend any changes, and if so what ones.
EXECUTIVE SESSION
3:20 P.M. - On motion of Councilman Wickham, seconded by Supervisor Harris, it was
RESOLVED that the Town Board enter into Executiver Session. Vote of the Board: Ayes:
All. The Town Board discuss certiorari ~proceedings, litigation - Laoudis law suit (see
resolution no. 40), possible purchase of property (see resolution no. 41), and personnel.

A Regular Meeting of the Southold Town Board was held on Tuesday, June
19, 1990, at the Southold Town Hall, Main Road, Southold, New York, Supervisor

of June 19, 1990.

SUPERVISOR HARRIS: Tonight we have three public hearings scheduled. The
procedures will be as follows; ten minutes will be allotted to those who want to
address the Town Board on any specific matter, pertaining to that public hearing.
We will entertain resolutions until 8:00 o'clock, at which time we will switch to
the public hearing portion.
1. 8:00 P.M., on a proposed "Local Law in Relation to Vehicles and Traffic"
2. 8:02 P.M., on a proposed "Local Law in Relation to Zoning Definitions".
3. 8:05 P.M., a formal notification of the interest and intent of The WaY
Back, Inc. to establish a community residence for mentally disabled persons at
500 Crown Land Lane in Cutchogue.
V. RESOLUTIONS.
SUPERVISOR HARRIS: We have, as you read in your agenda, you have five minutes
to address the Board on any issue, that deals with resolutions, that we will be
entertaining tonight. Is there any members of the audience, that would like to
speak on any resolution, that we will be acting upon? (No respon'se.) Seeing
none, we'll move on to the first resolution.
-Moved by Councilwoman Latson, seconded by Councilwoman Oliva,
WHEREAS, June 24 - June 30 has been designated NATIONAL SAFETY WEEK by
the American Society of Safety Engineers; and
WHEREAS, the theme for the NATIONAL SAFETY WEEK observance is "Play It
Straight for Safety's Sake"; and
WHEREAS, one in every five workers ages 18-25 and one jn every eight workers
26-34 uses drugs on the job; and
WHEREAS, drug ai~d alcohol abusers ca~se 3.6-times more accidents-than drug
'free workers do; and
WHEREAS, drug abuse constitutes a serious safety and health risk for children,
workers, pregnant woman and the community at large; and
WHEREAS, this endeavor is worthy of our support and cooperation so that we
may greatly reduce drug abuse in the community and in the workplace; now, ther--
fore, be it
RESOLVED, that the Town Board of the Town of Southoid hereby proclaims June
24 - June 30, 1990 as NATIONAL SAFETY WEEK and do hereby urge all citizens
of the Town of Southold to participate in its observance.

RESOLVED that the Town Board of the Town of Southold hereby appoints Judith
Huelle as a part-time Matron for the Southold Town Police Department, effective
immediately at a salary of $7.35 per hour, a minimum of $15.00 per call.

RESOLVED that the Town Board of the Town of Southold hereby authorizes the
closure of Cases Lane, Cutcho~tue, from 9:00 A.M. to 5:00 P.M'., on Saturday,
July 7, 1990, to permit the Cutchogue-New Suffolk Historical Council to utilize
the area for their 26th Annual Antique Flea Market Show, provided they secure
and file with the Town Clerk a One Million Dollar Certificate of Liability Insurance
naming the Town of Southold as an additional insured.

Weaver as a Lifeguard for the 1990 summer season, at a salary of $7.42 per hour
(1st year).

immediately, at a salary of $6.00 per hour.

of $2.00 to Jeanne Lane, which sum represents payment for a duplicate vehicle
permit.

COUNCILWOMAN LATSON: I'd just like to mention, that this permit was first
issued in December, and another one was issued in May, and that our Town Clerk's
Office is so conscientious, and so up-to~date on all their book work, that they
picked up $2.00.

RESOLVED that the Town Board of the Tgwn of Southold hereby accepts the bid
of ChemunEi Supply Corporation, Elmira, New York, for supplyin~l the Hicjhway
Department with 500 - 6 foot studded steel "T" Posts (more or less as may be
needed) at a cost of $2.11 per post, all in accordance with the bid specifications.

of Chemunrj Supply Corporation, Elmira, New York, for supplying the Hi~jhway
Department with 5,000 linear feet of Snow Fence (more or less as may be needed),
in 100 linear foot rolls, at a Cost of $51.24 per roll, all in accordance with the
bid specifications.

Town of $outhold as may be required for a period of one (1) year, from July
1, 1990 through June 30, 1990, at the following prices, all in accordance with
_the bid specifications:

650 - 1,000 tons $33.89
Over 1,000 tons $32.89
AND BE IT FURTHER RESOLVED that Supervisor Harris he and he hereby is

Sherter and Jeff Schultz as Water Safety Instructors (swim lesson instructors),
at a salary of $12.0e-per hour, 3.5 hours per day, Monday through Friday,
effective June 25, 1990 through August 17, 1990.

RESOLVED that the application of William Bauer, President of Bauer Farms, Inc.
for renewal of his sin~]le family caretaker trailer permit, for trailer located off
of the south side of CR 48, 400 west of Peconic Lane, Peconic, which permit expires
on July 4, 1990, be and hereby is c. lranted for a six (6) month period.

received on June 14, 1990 for suppl¥in~ the Highway Department with Sand Mix
Ashalt due to an irregularity in the submi/ssion of the bids.

directs the Town Clerk to readvertise for bids for the purchase of 1,000 Tons,
more or tess as may be needed, of Sand Mix Asphalt, furnished and applied.

RESOLVED that the Town Board of the Town of Southold hereby authorizes and
directs Supervisor Scott L. Harris to execute a lease ac.~reement between the Town
and Rothman's Department Store for the premises located south of Traveler Street,
Southold, and used for municipal parking purposes, for a one (1) year period,
effective June 1, 1990 through May 31, 1991, at an annual rent of $50.00.

RESOLVED that the Town Board of the Town of Southold hereby rejects the bid
of Bouton Services, Inc. with repect to the Obstruction Removal and Li~htin~
Project at Elizabeth Field, Fishers Island, said bid was irregular as defined in
Section 20-08 I'rregular Proposals of the Contract Specifications, it included a total
contract price, but unit prices were not provided for any of the twenty bid items.

22.-Moved by Councilman Penny, seconded by Councilwoman Oliva, it was
RESOLVED that the Town Board of the Town of Southold hereby accepts the bid
of Falve¥ Trucking and Excavation, Killin~worth, Connecticut, in the amount of
$211,542.80 for the Obstruction Removal and Lighting Contract at Elizabeth Field,
Fisher:s Island Airport, subject to approval by the Federal Aviation Administration
and New York State Department of Transportation, and approval of the proposed

THE TOWN BOARD OF THE TOWN OF SOUTHOLD, IN THE COUNTY
OF SUFFOLK, NEW YORK, HEREBY RESOLVED (by the favorable vote of not less
than two-thirds of all the members of said Town Board) AS FOLLOWS:
Section 1. The Town of Southold, in the County of Suffolk, New
York (herein called "Town"), is hereby authorized to partially reconstruct the
fuel distribution system at various Town buildings. The estimated maximum cost
_of said specific object or purpose, including preliminary costs and costs incidental
thereto and the financing thereof, is $50,000 and said amount is hereby appropriated
therefor, The plan of financing includes the issuance of $50,000 serial bonds
of the Town to finance said appropriation, and the levy and collection of taxes
on all the taxable real property in the Town to pay the principal of said bonds
and the interest thereon as the same shall become due and payable.
Section 2. Serial bonds of the Town in the principal amount of $50,000,
are hereby authorized to be issued pursuant to the provisions of the Local Finance
Law, constituting Chapter 33-a of the Consolidated Laws of the State of New York
(herein call "Law") to finance said appropriation.
Section 3. The following additional matters are hereby determined
and declared:
(a) All of the existing Town buildings are of at least Class "C"
construction as defined by Section 11.00 a. 11 (c) of the Law, and the period
of probable usefulness of said specific object or purpose for which said $50,000
serial .bonds authorized pursuant to this resolution are to be issued, within the
limitations of Section 11.00 a. 13 of the Law, is five (5) years.
· (b) Current funds are not required by 'the Law to be provided as
a down payment prior to the issuance of the bonds authorized by this resolution
or any bond anticipation notes issued in anticipation thereof in accordance with
Sction 107.00 d. 5 of the Law. :
(c) The proposed maturity of the bonds authorized by this resolution
will not exceed five (5) years.
Section 4. Each of the bonds authorized by this resolution and any
bond anticipation notes issued in anticipation of the sale of said bonds shall contain
the recital of validity as prescribed by Section 52.00 of the Law and said bonds
and any notes issued in anticipation of said bonds, shall be general obligations
of the Town, payable as to both principal and interest by general tax upon all
the taxable real property within the Town without limitation of rate or amount.
The faith and credit of the Town are hereby irrevocably pledged to the punctual
payment of the principal of and interest on said bonds and any notes issued in
anticipation of the sale of said bonds and provision shall be made annually in the
budget of the Town by appropriation for (a) the amortization and redemption ~of
the bonds and any notes in anticipation thereof to mature in such year and (b)
the payment of interest to be due and payable in such year.
Section ~-. Subject to the provisions of this resolution and of the
Law and pursuant to the provisions of Section 30.00 relative to the authorization
of the issuance of bond anticipation notes and of Section 50.00 and Sections 56.00
to 60.00 of the Law, the powers and duties of the Town Board relative to authorizing
bond anticipation notes and prescribin9 the terms, form and contents and as to
the sale and issuance of the bonds herein authorized and of any bond anticipation
notes issued in anticipation of said bonds, and the renewals of said bond anticipation
notes, are hereby dele~qated to the Supervisor, the chief fiscal officer of the Town.

of the Planning Board, in respect to certain residential property situated in the
Town of Southold commonly referred to as Angel Shores I; and
WHEREAS, the Town Board has reviewed the allegations of the Complaint, has fully
discussed with the Town Attorney's office the allegations of the complaint and the
history of Mr. Laoudis' application to the Town Board and the Planning Board with
- respect to Angel Shores !, and has participated in joint meetings with Mr. Laoudis,
his Attorneys and environmental consultants, which meetings were held upon the
recommendation of the Town Attorney, and with his full participation; and
WHEREAS, the Town Board has concluded that there is merit to plaintiff's claim in
respect to his entitlement to one-acre zoning for Angel Shores I; and
WHEREAS, the Town Board is desirous of settling and disposing of this litigation
for the reasons set forth above, and also for the reasons set forth in the proposed
Stipulation of Settlement and because to do so is in the best interests of the
residents of the Town of $outhold; and

Such owner or person' in charge of the vehicle may redeem the same
upon payment to the Southold Town Police Department of the amount
of all expenses actually and necessarily incurred in effecting such
removal, such removal charges not to exceed seventy-five dollars
($75.00) from 6:00 a.m. to 8:00 p.m. and not to exceed one

no stop work order issued at the present moment. That's up to the Building
Department at this point. The case is presently scheduled for the 29th. I find
that I'm going to be out of the State on the 29th. It'*, a matter that I want to
handle personally. I'm going to try to arrange with Judge Price another more
convenient day, perhaps even before then, so we can end up this matter tried
quickly.
SUPERVISOR HARRIS: Anyone else like to address? Mr. Pell?
WILLIAM PELL: Two things, Scott. One, you didn't act upon the peddler's law,
that you had the hearing last week. When do you anticipate acting upon it?
SUPERVISOR HARRIS: It's probably going to go back to Committee for some
changes.
WILLIAM PELL: The second one, I'd just like to ask the Judge if I could? On
a couple of resolutions tonight, you abstained?
JUSTICE EDWARDS: Yes. Mr. Pelt, we had a invitation to bid on a project on
Fishers Island, being paid for by the FAA, quote, unquote, the United States
government, and the Iow bidder on the project was Bouton Services on Fishers
Island, at a cost of $152,800.00, and the second lowest bidder was Falvey Truc'king
at $211,000.00, so that about a $60,000.00 difference, but the engineers threw
out the Bouton Services bid for the simple reason that when he offered his bid,
he didn't do his homework, and' there was some...see, the Iow bid submitted by
Bouton Services was reviewed, and found to be irregular as defined in Section
20-08, irregular proposals of the contract specifications, and I wanted to try and
keep the business on Fishers Island, but now an off-island'.'contractor got it. It's
the same thing with Corazzini. They threw that bid out the window because there
was something in there, but they're going to put that out to rebid, but apparently
they can't do that with government contracts. So it's going to cost the government
$60,000.00 more to do the job, plus it's going to an off-island contractor.
SUPERVISOR HARRIS: Is there any other questions from anyone else in the

Moved by Justice Edwards, seconded by Councilman Wickham, it was
RESOLVED that the Town Board meeting be and hereby is adjourned at 11:25 P.M.
