SUFFOLK COUNTY ADMINISTRATIVE CODE: This application was referred as required under the Suffolk County Administrative Code Sections A 14-14 to 23, and the Suffolk County Department of Planning issued its reply dated April 10, 2019 stating that this application is considered a matter for local determination as there appears to be no significant county-wide or inter-community impact. LWRP DETERMINATION: The relief, permit, or interpretation requested in this application is listed under the Minor Actions exempt list and is not subject to review under Chapter 268. PROPERTY FACTS/DESCRIPTION: The subject parcel is a 21,695 sq. ft. non-conforming property in an A-C Zoning District. The property has a Main Road (NYS Route 25) frontage of 186.80 feet which then runs north 121.70 feet to the rear property line, which is 182.1 feet, then returning south 113.9 feet to Main Road. The property is improved with a 2-story frame house, which suffered fire damage in 2015, and is currently under construction with building permit # 42160, issued November 20, 2017. There is also a wood frame garage, and two wood storage sheds in the rear yard of the property. The property also has a one-story building with a previously permitted and now abandoned commercial use, towards the eastern side of the subject parcel. All as shown on the survey prepared by Nathan Taft Corwin, 111, L.S., last revised February 6, 2019. BASIS OF APPLICATION: (Re-opened on December 19, 2019) Request for a Variance from Article XXIII, Section 280-124 and the Building Inspector's March 18, 2019, Amended December 2, 2019 Notice of Disapproval based on an application to construct a front porch addition to an existing single family dwelling currently under construction (BP#42160) and to alter an existing building to an accessory storage building; at, 1) Dwelling is located less than the code required minimum front yard setback of 40 feet; 2) Accessory structure is located in other than the code permitted rear yard, located, at 45805 NYS Route 25, Southold,NY. SCTM No. 1000-75-2-14. RELIEF REQUESTED: The applicant requests variances for the following: Page 2,March 5,2020 #7302,Gorman SCTM No. 1000-75-2-14 1. A front yard setback of 24.1 feet where a minimum of 40 feet is required by code for an"as built"porch addition to an existing single-family dwelling 2. A rear yard setback of 47.7 feet where a minimum 50-foot setback is required for an"as built" second story deck addition to an existing single-family dwelling(under BP#42160) 3. Legalize an "as-built" accessory building proposed as a storage building in a side yard,where the code requires a rear yard location 4. Legalize an "as built"expansion of the foundation of the existing single-family dwelling by 49 percent for an accessory apartment in the principal dwelling where the code permits a maximum of 25 percent. ADDITIONAL INFORMATION: As per testimony of the applicant's attorney and also the applicant, the proposed porches are for entry into the house during inclement weather. The property is currently under construction to have a second floor demolished and reconstructed with building permit # 42160. The original applications were for a front yard setback for a covered porch, and an application for a Special Exception permit from the Board of Appeals to convert the property to a two-family residence, ZBA File#7303SE. This application also required an approval for an upgraded sanitary from the Suffolk County Department of Health which was denied. Subsequently ZBA File# 7303SE was withdrawn by the applicant and this application was amended to include the variances cited above, including an accessory apartment in the principal dwelling. At the hearings, the Board inquired about the current use of the one story building previously used for retail, located on the eastern portion of the lot. The applicant testified that it is currently used for storage only and no improvements are proposed at this time. The applicant also stated that the accessory frame garage located in the rear of the lot is currently used as habitable space which the Board told the applicant must be discontinued, and that the garage must be restored to and used only for storage purposes. The Board then informed the property owner that he would have to meet all the residency requirements for the approval of an accessory apartment, which include being a full-time resident of either the principal dwelling or the accessory apartment. FINDINGS OF FACT/REASONS FOR BOARD ACTION: The Zoning Board of Appeals held a public hearing on this application on August 1, 2019 and also on February 6, 2020 at which time written and oral evidence were presented. Based upon all testimony, documentation, personal inspection of the property and surrounding neighborhood, and other evidence,the Zoning Board finds the following facts to be true and relevant and makes the following findings: 1. Town Law X267-W)(b)(1). Grant of the variances will not produce an undesirable change in the character of the neighborhood or a detriment to nearby properties. The uses along Main Road/Route 25 near the subject property are varied, including commercial, residential and agricultural. The proposed covered wrap around porch is colonnaded and is not enclosed, is largely screened from the street by an existing hedgerow, and front porches are common features on residential structures. The rear yard setback of the"as built" second story deck cannot be seen from the street, and the rear yard is screened from view of the adjacent vineyard. The accessory storage building in the side yard has existed in its current location for many years and was previously used as a commercial building, After this approval, it will be converted to an accessory storage structure, which is typical for residential properties, and the building footprint will not change. The subject property is already screened from the road by a high hedgerow, which will be enlarged to cover the existing storage building so the proposed wrap around porches and storage building will not be seen from the Main Road. As for the "as built" expansion of the foundation, the dwelling has conforming single and combined side yard setbacks, which are conforming, and therefore there will be no detriment to nearby properties. The property is also adjacent to a vineyard tasting room, so the scale of the project is well within the character of the neighborhood. 2. Town Law V67-W)N(2). The benefit sought by the applicant cannot be achieved by some method, feasible for the applicant to pursue, other than an area variance. The existing residence has been there for many years, and is currently under renovation/construction with a valid building permit. Any addition to the front of the house Page 3,March 5,2020 #7302,Gorman SCTM No. 1000-75-2-14 would fall outside of the allowable setbacks therefore requiring a variance. The conversion to apartment space on the second floor is in an existing space but does not change the setbacks. The existing commercial building is located in a side yard and since it is a masonry structure that cannot be practically moved to a conforming rear yard location. There is no way to legalize this structure other than with area variance relief. 3. Town Law X267-b(3)(b)(3). The variance for the front covered porch granted herein is mathematically substantial, representing 60 % relief from the code. However, any proposed addition to the front of the residence would need variance relief due to the location of the existing house on the property. Additionally, the porches will enhance the architectural style of the dwelling, will not be seen from the street, and are open on the sides thereby reducing the scale and mass of their appearance. The variance for the second-floor apartment is also mathematically substantial, increasing the foundation size from the allowable 25 % to 49% coverage, a 24% increase in the allowable lot coverage. This is mitigated as the existing building already exists, and the apartment is just a change of use on the second floor of the existing house. The variance for the rear yard setback is mathematically minor, as it is only an approximately 4% increase in the setback to the rear yard. The setback is for a second story deck and open stairs. The variance for the proposed storage building in the side yard is 100% relief from the code. However, the removal of the curb cut to Main Road (NYS Route 25) on the eastern portion of the property and the planting of evergreen screening along the front property line, as conditioned herein, will reduce the visual impact to the street and will bring the subject property into compliance with a residential use only 4. Town Law $267-b(3)(b)(4). No evidence has been submitted to suggest that a variance in this residential community will have an adverse impact on the physical or environmental conditions in the neighborhood. The applicant must comply with Chapter 236 of the Town's Storm Water Management Code, the Suffolk County Department of Health Sanitary Code, and the conditions imposed herein by this Board. 5. Town Law §267-b(3)(b)(5). The difficulty has been self-created. The applicant purchased the parcel after the Zoning Code was in effect and it is presumed that the applicant had actual or constructive knowledge of the limitations on the use of the parcel under the Zoning Code in effect prior to or at the time of purchase. The applicant also started renovations without the benefit of permits. 6. Town Law &267-b. Grant of the requested relief is the minimum action necessary and adequate to enable the applicant to enjoy the benefit of a covered front porch, rear steps to the second floor, storage building in the side yard, and second floor accessory apartment while preserving and protecting the character of the neighborhood and the health, safety and welfare of the community. RESOLUTION OF THE BOARD: In considering all of the above factors and applying the balancing test under New York Town Law 267-13, motion was offered by Member Planamento (Vice Chair) , seconded by Member Dantes, and duly carried,to GRANT the variances as applied for, and shown on the survey prepared by Nathan Taft Corwin, III, Land Surveyor, last revised January 7, 2020. SUBJECT TO THE FOLLOWING CONDITIONS: 1. The proposed front porch shall not be enclosed and shall remain unconditioned space. 2. The property owner shall be a legal full-time resident of either the principal dwelling or the accessory apartment located in the principal dwelling on the subject property and must provide this Board all necessary documentation to the Board's satisfaction to demonstrate residency before a certificate of occupancy is issued by the Building Department. Page 4,March 5,2020 #7302, Gorman SCTM No. 1000-75-2-14 3. Only one accessory apartment to be located in the principal dwelling may exist on the subject property. 4. The existing eastern curb cut on NYS Route 25 in front of the proposed accessory storage building shall be removed and landscaped with evergreen screening with a minimum height of five(5) feet and planted four feet on center, so the building will not be seen from the road. 5. The accessory garage and accessory storage buildings on subject property may only be used as storage as accessory to the principal dwelling and the accessory apartment. 6. An approved permit from the Suffolk County Department of Health Services shall be presented to this Board for the onsite septic system serving the principal residence and accessory apartment. 7. The existing garage currently being used as an illegal apartment shall be restored to a garage/storage use only and shall not contain sanitary plumbing or heat or air conditioning. Any Certificate of Occupancy shall be issued only after inspection by a Town Code Enforcement Officer confirming that the garage has been converted to storage use only and has no habitable space. 8. The open stairs and second story deck in the rear yard shall remain open and never be converted to habitable space. Any deviation from the survey, site plan and/or architectural drawings cited in this decision will result in delays and/or a possible denial by the Building Department of a building permit and may require a new application and public hearing before the Zoning Board of Appeals. Any deviation from the variance(s) granted herein as shown on the architectural drawings, site plan and/or survey cited above, such as alterations, extensions, or demolitions, are not authorized under this application when involving nonconformities under the zoning code. This action does not authorize or condone any current or future use, setback or other feature of the subject property that may violate the Zoning Code, other than such uses, setbacks and other features as are expressly addressed in this action. In the event that an approval is granted subject to conditions, the approval shall not be deemed effective until the required conditions have been met; and failure to comply therewith will render this approval null and void. The Board reserves the right to substitute a similar design that is de minimis in nature for an alteration that does not increase the degree of nonconformity. The -depth of the property is 135 feet and the existing house is occupied by Joseph Stepnoski. The proposal is to build a building 301 x 401 on the easterly side ' of the premises, 15 feet from the side line, in which the old electrical shop will be in with a similar business which is repairing. The inventory for this business was bought from Mr. Vincent Kumjian. In the advertising for this hearing it says "in excess Of present capacity" and in the Ordinance it says "50% of fair value of building, etc." THE CHAIRMAN: It is supposed to relate to existing facilities. I don't believe there is any intent under the Ordinance to control how much business there is. Somebody slipped up on that but I don't think it changes the basic meaning of the legal notice. MRS. None of the current codes for affordable housing completely apply to this situation, so I have attached the three sections on this subject for your convenience, highlighted as to the relevant requirements for each A number of variations (variances?) from these code provisions would be required for this property, and those which are appropriate should be included as conditions. This should include that the apartment be affordable in perpetuity(or upon its removal if the house is converted back to a single family dwelling). r 3. We note the complete absence of any compelling reasons for allowing a two family house on a one-half acre parcel in an 80,000 sf minimum lot size district,the precedent for which would be overwhelming. 4.
