WORK SESSION

9:30 A.M. - Board of Appeals Chairman Gerard Goehringer met with the Board to
request the 'hiring of former Board stenographer Linda Kowalski. Mr. Goehringer said
he is concerned with the upcoming summer season and office staffing. Further, with
the elimination of vacant land certificates of occupancy he anticipates numerous
ditional applications to his board. He said he would like to hire 'Mrs. Kowalski for
o days'a week for the next two months, and anticipates she would be willing to
return full time after that (see resolution no. 31).
9:45 A.M. Herbert Mandel and Richard Israel, along with Community Development
Administrator James McMahon, met with the Board to discuss the Certificates of
Eligibility for the affordable housing applicants. Mr. Mandel, who is the developer
of Highpoint Meadows affordable housing project, said he wants the certificates issued
immediately. Mr. McMahon said that although the Code says the certific~ates must be
issued as .the applications come in, some of the Town Boar~l members had indicated
they wanted a lottery, and that is why he was holding off. The Board directed Mr.
McMahon to begin issuing the c~rtificates 'to those applicants who live, and work in
Southold Town.
10:35 A.M. - For Discussion Items: (1) Proposed policy resolution limiting the time
individuals may address the Board at public hearings to a maximum of ter~ minutes (see
resolution no. 28).' (2) Decision on appointments to fill two vacancies on the
'Conservation Advisory Council Board agreed to the appointment of Cynthia C.
Sturner (see resolution no. 33), and will discuss the other vacancy at a later ,;date~
(3) Decision On the Southold Villas, Inc. change of zone petition will be
another two weeks upon written approval by the applicant. (4) The terms of
Cybulski, Jr., Robert A. Villa and Norman C. Boos, members of the Open
Committee, expired on May 4th. All three members advised the Town Clerk
wished to be reappointed. The matter will be discussed later in the day during
Executive Session (see resolutions 34 and 35). (5) Appointment to the Board of
Appeals to be 'discussed during Executive Session (see resolution no. 36). (6)
Determine the amount to be deposited with the Town in lieu of land for Park and
Playground purposes in the major subdivision of Thornton Estates, Section I (see
resolution no. 30). (7) Discussed a letter being sent to property owners who have
never obtained their Certificate of Occupancy. Board agreed the Town Attorney
should reword the letter for future transmittals. (8) Letter from Hahn Realty asking
the Town to sell two small vacant parcels in Gardiners Bay Estates to a client.--It has
been determined these parcels do not belong to the Town, but are owned by the
Gardine~'s Bay Estates Property Owners Association. (9) Set date to interview
applicants for Beach Attendant, Lifeguard, Water Safety Instructors - tentatively set
for June 8th. (10) Appointment of two Police Sergeants (see resolution no. 37) to
be held for Executive Session. (11) Councilman Wickham brought the Town Board
up to date on the progress of the Task Force. The Task Force recommends to the
Town Board that they adopt the draft hydrogeological study of the landfill prepared
by Dvirka and Bartilucci, and transmit same to the DEC. The Task Force also
recommends to the Town Board that they begin looking for land to purchase around
the Landfill area. Supe'rvisor Harris will personally contact property owners in that
area. Mr. Wicl~ham stated that the recycling program must move ahead; there must ~-~
be intensive publicity, and a deadline established to begin the program in earnest.
The projected date is May 21st. Lastly, Mr. Wickham advised the Board 'that the
Planning and Zoning Committee recommends the appointment of three summer'interns.
One would be Scott Dobriner who would work on the Local Waterfront Revitalization
Program; a second would prepare a planning survey of the Town, and the third to
assist the Planning'& Zoning Committee by preparing specific materials on topk:s taken
up by that committee. Project salary would be $300 per week per intern for
approximately ten weeks this summer. Supervisor Harris said he would have to look
at the budget, which tight at the present time, but does not think there would be
sufficient funds for three interns. Lastly Mr. Wickham discussed the Proposed
retraining session for the computer's Building Permit and Parcel System. He
concurred with,a memorandum from Planning Board Chairman Orlowski that there
should be a meeting of Town departments that would use the program to determine
how the data base management system should be designed and implemented.
Supervisor Harris advised that that is the purpose of the retaining session, to get
the program started so the employees would have an opportunity to see what changes

would be needed for their particular departments. (~) Receipt of a memorandum
from Board of Town Tru'stees' President John Bredemeyer stating they had completed
interviews of the applicants for the Environmental Consultant position, and recommends
the appointment of Bruce Anderson (see resolution no. 32).

All. Town Attorney Arnoff discussed several pending lawsuits with the Board, after
which 'the Board discussed appointments to the Conservation Advisory Council, Open
Space Committee, Board of Appeals, and two Police Sergeants.

the 7:30 P.M. Regular Mee. ting.

SUPERVISOR HARRIS: At this time, before we entertain resolutions, are there
any members of the audience who would like to address the Town Board on any
matter, that we have entertaining tonight? (No response.) Hearing none, we
will proceed on the regularly scheduled resolutions. Resolution number one is
to grant trailer permit renewal to Ange and Barbara Boursiquot. I'll make that
motion.

RESOLVED that the application of Anqe & Barbara Boursicluot for renewal of their
sin~lle family house trailer permit, for trailer located on a private road, off of
the north side of the Main Road, Mattituck, which permit expired on May 4, 1990,

SUPERVISOR HARRIS: This motion is for a crossing guard. We had one that

RESOLVED that the Town Board of the Town of Southold hereby appoints Marilyn
Troise to the position of Scale Operator, from the Suffolk County Department
of Civil Service Certification of Eligibles List, effective April 26, 1990, at a salary
of $10.61 per hour.

grant, for the following eligible activities under the Act, all in accordance with

RESOLVED that the Town Board of the Town of Southold hereby cjrants permission
to Assessor Robert I. Scott, Jr. to attend an orientation seminar, "Understanding
The Real Property Tax", to be conducted at Hauppauge, New York, on June
26, 1990, and the use of a Town vehicle, and necessary expenses for registration
and meal shall be a legal charge against the Assessors' 1990 Budget.

subdivision of Howard Rosenstone, all in accordance with the recommendation
of the Southold Town Planning Board and Sidney B. Bowne & Son, Consulting
Engineers.

release of the $44,350.00 Letter of Credit deposited with the Town as a bond
for roads and improvements in the major subdivision of Hicjhpoint at East Marion,
Section II1, all in accordance with the recommendation of the Southold Town Planning
Board, Superintendent of Highways Jacobs and Sidney B. Bowne & Son, Consulting
Engineers; the $10,000.00 Letter of Credit deposited as a bond for the installation
of a fire well in the aforesaid subdivision is not to be released at this time.

of En~ineerincj Inspector, sets a salry of $30,000.00 per annum for said position
and authorizes and directs Supervisor Harris to request a Suffolk County Department
of Civil Service Certification of Eligibles List for said postition.

Martin, Jr., Commissioner of the East Marion Fire District, to be Southold Town's.
representative as a member of the Suffolk County Fire, Rescue, and Emercjenc¥
Services Commission.

directs Supervisor Scott L. Harris to execute an acjreement between the County
of Suffolk Department for the A~lincj and the Town of Southold for the Senior
Day Care Program, for the term of April 1, 1990 through March 31, 1991 unless
extended (but in no event beyond March 31, 1992), at a total cost of $25,604.00;
all in accordance with the agreement as approved by the Town Attorney.

RESOLVED that the Town Board of the Town of Southold hereby authorizes and
directs Supervisor Scott L. Harris to execute an agre'ement between the County
of Suffolk Department for the Acjing and the Town of Southold for the House'keeper/
Chore Servzces Program, for the term of April 1, 1990 through March 31, 1991
unless extended (but in no event beyond March 31, 1992), at a total cost of $26,196.00;
all in accordance with the agreement as approved by the Town Attorney.

16.-Moved by Councilwoman Oliva, seconded by Justice Edwards, it was
RESOLVED that the Town Board of the Town of Southold hereby accepts the
bid of Paul Corazzini & Sons Inc., in the amount of $1.28 per gallon, for furnishing
and applying 150,000 gallons, more or less as may be needed, of Grades RC-2
and MC-2 Aspalt Road Materials, delivered to the Town of Southold and applied,
all in accordance with the bid specifications; and be it further
RESOLVED that Supervisor Scott L. Harris be and he hereby is authorized and
directed to execute a contract between Paul Corazzini & Sons Inc. and the Town
of Southold to provide all the necessary labor, materials, equipment and incidentals
required to furnish and apply 150,000 gallons, more or less as may be needed,
of Grades RC-2 and MC-2 Aspalt Road Materials for the Town of Southold for
$1.28 per gallon, for a period of one (1) year from the 3rd of June, 1990.

17.-Moved by Supervisor' Harris, seconded by Councilman Penny, it was
RESOLVED that the Town Board of the Town of Southold hereby accepts, with
regret, the resiqnation of Samuel A. Manarel, member of the Southold Town Board
of Assessment Review, effective immediately, and extends to Mr. Manarel their
sincere thanks and appreciation for lending his expertise to the Board of Assessment
Review as a devoted member since January 9, 1979.

RESOLVED taht the Town Board of the Town of Southold hereby authorizes and
directs the Town Clerk to advertise for resumes for one (1) member of the Board
of Assessment Review to fill the vacancy created by the resignation of Samuel
A. Manarel.

19.-Moved by Councilman Wickham, seconded by Supervisor Harris,
WHEREAS, it is essential that the various levels of local government work cooperatively
to promote the efficient and economical provision of local government services
to its consitituents; and
WHEREAS; it is a recommendation of the Local Government Council on the Elimination
of Waste and Duplication that an Intergovernmental Relations Council be established;
and
WHEREAS, the establishment of an Intergovernmental Relations Council provides
a formal structure for developing cooperative arrangements between local governments
which determines the level of government that is best able to address the diverse
needs of Suffolk County, and to identify areas of possible duplication and waste;
and
WHEREAS, in 1983 an Act to amend the general municipal law in relation to the
e-~tablishment of an Intergovernmental Relations Council was adopted, thereby
providing the legislature authority to unite governmental entities and create a
single forum for discussion and problem solving in government; now, therefore,
be it

and is of the opinion that in the interest of safety the speed of boats should
be limited in that area; now, therefore, be it

to transmit this proposed Local Law to the Southold Town Planninq Board and
the Suffolk County Department of Plannincj in accordance with the Code of the
Town of Southold and the Suffolk County Charter. Said proposed Local Law
reads as follows, to wit:
A Local Law in Relation to Nonconforming Lots
Be it enacted by the Town Board of the Town of Southold as follows:
I. § 100-244a. Merger of Lots.
A,. Whenever a single lot which has been excepted from the area,
width and yard requirements of a particular district, by reason
of such lot being in single and separate ownership on a certain
date, is joined by common ownership to an abutting lot, the
greater area width and yard requirements for the particular
district shall apply to the increased lot size. However, the
Zoning Board of Appeals of the Town of Southold may, in its
discretion, grant a set-off of any such lots deemed to merge
by operation of law through this section, if such board shall
be satistied, based upon the record or the proceeding had
before it, that the following conditions have been met:

(1) The owner of the Iots-,;~ed~was unaware that the
taking of such property in the same ownership as an
adjoining parcel would cause a merger by operation
of this section.
(2) That the development of the surrounding neighborhood
is such that the subdivision of such merged lots will
not result in lots of a lesser size than those of the
surrounding neighborhood.
(3) That no such lot for which a subdivision is applied
for pursuant to this section shall result in a lot
area one-half or less of the area permitted in the
zone pursuant to the area requirement schedule
effective in such zone.
B. Whenever two of more parcels of property which are
non-conforming and which abut at a common course of
distance, are held in the same ownership, such parcels
shall be termed "merged" to form (1) lot in conformance
with the lot requirements of the zoning use district in
which the parcel is located, but shall not be deemed
merged if such lots both exceed the lot requirements of
the zoning use district in which they are located.
C. Whenever two or more parcels of property which are
nonconforming, or conforming, which abutted a common
course and distance and which have both been improved by
structures for which certificates of occupancy have been
issued or preexist zoning, come to be held in the same
ownership such parcels shall not be deemed merged.
II. This Local Law shall take effect upon its filing with the Secretary of State.

of Suffolk will protect and enhance the physical and visual environment of a town,
as well as promote the health, safety and general well-being of all persons and
property located in the towns, and
WHEREAS requiring the use of recycled paper in the manufacture and use of
newsprint which is printed, distributed, sold or offered for sale in a town located
in the County of Suffolk will facilitate and encourage the recycling of newspapers,
and
-WHEREAS the adeption of measure requiring the use of recycled paper will:
1) Minimize the adverse effect on the environment of utilizing
landfills for the purpose of disposing of newspapers;
2) Facilitate the process of closing said landfills by years end;
3) Facilitate the implementation of other forms of newspaper disposal;
4) Promote the use of secondary materials in the printing and
distribution of newspapers; and
'~"-5) -'-Facilitate the creation of a market for the recycling of newspapers;
now be it
RESOLVED that the Town Board is in support of I.R. 1941-89 which will extend
the initiatives tl~at have been adopted by the County'of Suffolk to address the
problem of recycling waste products within the County. Specifically, I.R. 1941-89
would seek to prohibit newspaper publishers located and/or doing business in
the County of Suffolk, on a graduated basis, from using non-recycled materials
for the printing of newspapers; be it further
RESOLVED that the Town Board is in support of I.R. 1941-89 in that any person
located and or doing business in a town, which is located with the County of
Suffolk will be prohibited from printing, distributing, selling or offering to sell
any newspaper as follows: '
Unless at least fifteen (15%) percent of the total number of newspapers printed,
distributed, sold, or offered for sale by such persons within these towns, are
made of at least forty (40%) percent of secondary material as of December 31,
1991.
The required percentage of secondary material will remain at the constant
level of forty (40%) percent, however the percentage level on the total amount
of newspapers printed distributed, sold, or offered for sale, shall increase to
one hundred (100%) by December 31, 1995 in yearly increments and be it further
RESOLVED that the Town Board is in support of the penalties which are attached
for each violation of I.R. 1941-89.
SEQRA Determination
This Town Board hereby finds and determines that this measure will constitute
an unlisted action pursuant to §617.2 of the NEW YORK CODE OF RULES AND
REGULATIONS (NYCRR), and will not have a significant impact on the environment

within the meaning of §8-0109(2) of the NEW YORK ENVIRONMENTAL CONSERVATION
LAW for the following reasons:
a) it' will encourage the collection and recycling
of newspapers thereby reducing the envrionmental
hazards and toxicity associated with newsprint
b) it will provide with enhanced groundwater quality
c) it will slow down the rapid filling of landfill space.
Preemption
This measure will be null and void on the day that either I.R. 1941-89 goes
into effect, or there is County-wide legislation which incorporates the same or
substatially similar provisions as are contained in this resolution.

SUPERVISOR HARRIS: At this time, we could do Councilman reports, and then
we'll go out to the audience for anybody who would like to discuss anything,
that they feel is prevalent to today's world. We'll start with Councilman Ray
Edwards. Ray, would you like to say anything?
JUSTICE EDWARDS: We're up to our ears in garbage on Fishers Island, and
we're looking forward to the part of the Town Board coming over for our Civic '
Association meeting the 26th of May, when there will be a lot of question asked.
How many answers is questionable, that they will get, but it proves to be a big
meeting on the Saturday before Memorial Day. The Garbage Commissioners, the
Commissioners of the District and myself, flew over here with our Engineers from
Norwich, Connecticut, flew over here last-week, to sit down with the Town Board
and their engineers to go over the different possible options, that Fishers Island
and the Town of Southold will have to come together with. I guess, that's it.

SUPERVISOR HARRIS: Thank you. Tom?
COUNCILMAN WICKHAM: I'd like to report very briefly on the activities of the
Waste Management Task Force. We met a week ago yesterday, and among the
decisions made at that time, was to recommend that the Supervisor forward to
the DEC the proposed studies for the hydrogeologic monitoring around the Cutchogue
Landfill. These studies have been developed quite extensively and carefully
by our consultants, Dvirka and Bartilucci. They envisage a programed careful
monitoring of the goundwater, both the movement of the plume, as well as the
content and quality of it, in a number of locations around the landfill. The results
of this study will determine the location of where we can continue to landfill,
in the likely event that we will do our landfilling there at the Landfill. Las~
night we had another meeting, and the Regional Director of the DEC, Mr. Harold
Berger, and two of his staff, were with us to. review the various opportunities
and priorities that the State has, and to see how they fit with our priorities.
There was a lot of discussion. It was a very good opportunity to exchange views.
I think they have a better idea, now, of our priorities, and I think we have, also,
a better idea of where they're coming from as they review our applications. I
can't summarize tonight, all of that exchange, but I will mention three points,
that to me seemed particularly important. One of them is, that you may recall
the Board at it's last meeting two weeks ago, endorsed proposed legislation in
Albany, that would make it permissible for towns like Southold to reduce a lot

of their waste by diverting, it elsewhei~e,-~.tO,~ecycle it, and then to landfill the
rest without going to, a so-called, resource recovery facility. That means an
incinerator or compost option. Last night the Regional Director said that as long
as we could get the volume of our material down to approximately the proportion,
that it would be reduced to, if it went through an incinerator, or a compost plant,
they could recommend to the Commissioner permittin~c~ us to do that. Now, that
doesn't mean it can be done, but it's a step that shows some flexibility on their
part. The second point, that I though was of significance, was a discussion
on the possibility of an extension. The impression, that we got from them, was
that a six month extension, beyond the date of December of this year, was...they
could recommend to the Commissioner. They can't guarantee what the Commissioner
would do, but a six month extension is something that they could recommend,
provided the Town had made a number of applications, and was making good
progress on it's plans. An extension beyond six months, for say a couple of
years, was more problematic, but it wasn't ruled out. Thirdly, on the question
of the landfill, and how the landfill would be used, and whether we need a double
lined cell at the landfill, which the regulations don't clearly state, but which
the DEC has interpreted. On that question, the DEC expressed considerable
resistance, and skepiticism, but did say that they would welcome us to discuss
the matter further at a technical session with them. I want to conclude by saying
that out of this meeting emerged again, or emphasized again, the importance of
the recycling and the waste reduction strategies for the Town of Southold. If
we can them effectively, we can clearly save a significant amount of money. Some
of you out there, and I know some of people have been calling me up, and talking
to us, are very concerned to know when this recycling operation is going to
begin among those of you, who's garbage is picked up by haulers, carters. We
have finally got a firm date on that, and the effective date by which the carters
are going to begin picking up recycled garbage at our various homes in the Town,
are for those people whose garbage is picked up by Mattituck Santitation, the
first day will be the 24th of May. For those people, who's garbage is going
to be picked up by Roy Schelin and their group, the date is the 1st of June.
These dates have been pushed back a couple of times, because of difficulties
we had in locating markets for the product, for getting the configuration of the
equipment, and trucks, and what not, but we now have firm dates for the 24th
of May for Mattituck Sanitation, and the 1st of June, for Schelin. Finally I want
to say that members of the Town Board frequently wonder whether reporters
an'd what not, don't make life more difficult for us from time to time, but I want
to sa), in regard to the meeting last night, we can thank Mrs. Tortora of the
Mattituck Watchman, who helped put that through. She helped put that meeting
in place, so I'm grateful for that.
SUPERVISOR HARRIS: Thank you. George?
COUNCILMAN PENNY: I don't have a whole lot to report, except that I've been
to the meetings of the Task Force, the meeting with the Fishers Island Garbage
Commissioners, and we have bi-monthly meetings of the Legistative Committee,
which puts some of the most interesting topics on the agenda for these public
hearings here, which keeps everyone sitting on the edge of their seat. I want
to explain why I voted against the recommendation for a local government counsel
on the elimination of waste and duplication. It seems to me, what the government
is doing, is creating another level of bureacracy, and it's streamlining what's
already there. Well, why doesn't all those that are already there do it themselves?
I don't think we have to spend anymore time, and anymore money, and create
legislative forms, and all of this stuff for doing something which should be common
sense, so that is why it was just a.token vote against it. I believe that, it's
probably impossible for government to ever make sense of itself, and especially
by causing a committee to do it, so that was my reason for that. Thank you.
COUNCILWOMAN OLIVA: I've been attending the garbage and the recycling.
I'm delighted that the carters have set a de~nite date to start their recycling.
The people should be getting labels and flyers in the mail, that will explain,
I think, very distinctly what should be put into the recycables and what should
not. I've attended the Legislative Committee meetings, and Planning and Zoning
Committee meetings regularly. I would just like to congratulate Officers Cochran
and Reiter for their promotion to Sergeant, and I wish them much success in
their new positions. Thank you.
COUNCILWOMAN LARSEN: We recently had a meeting of the Parks, Beaches
and Recreation Committee to formulate our summer program, and I'd like to thank
two specific people for quite a bit of work that they do on behalf of the Recreation
Center, and the Town itself. First of all, I'd like to thank Ken Reeves, who
is our Recreation Director, who handles everything from all the various spring,
summer, fall program to the disabled program, overseeing that in a directory capacity,
and all the senior citizen's programs, that are run through the Town. He really
does this as a one man operation. He puts a lot of personnel in place in the
beginning of the summer. I'd, also, like to thank Ray Jacobs, who's been very
cooperative with the committee this year. He's gotten the Rec Center cleaned
up. I spoke with him early this year. There was some definite problems, that
we were looking at down there, as far as maintenance of the building, and overall
daily day to day cleaning chores, and Ray has really gone out to get the Rec
Center cleaned up. He's come through on everything, that he said he would
from straighening that out, as Director of Building and Grounds, to installing
some basketball courts in the back, and he's just been a real help all around.
We are going to hire a 15each manager position this year, a full time beach manager
position, someone who's going to go around and supervise all the beach attendants
and the life guards, and we've got some exciting recreation programs going.
Our youth night is doing well for the younger group, and the kids are having
a lot of fun. We'll be addressing the older group shortly, and I'd like to thank
the committee members, e~cen Tom, who attended the meeting, and were very
supportive in getting things off the ground, it's kind of a fun committee, and
we're moving along nicely. Also, we had a meeting of the Zoning and Planning
Committee, which Tom chaired, and he didn't report on it. To go over the
overall goals of what we'd like to acheive as a Zoning and Planning Committee,
as far as updating and reviewing, the existing zoning and planning in the Town,
keeping the information current, keeping the data current, keeping things up.
to date, and we have put some proposals before the Town Board, the members
of the committee, and it's very hopeful that we will be acting on them in a
positive fashion in the future. The Local Waterfront Revitalization Committee
has been meeting regularly for about the past month and a half. They had met
for two years to help formulate and obtain an inventory and analysis of the Town's
coastal resources. They are at a point now, where we do need definite help
from the Planning Department. We need expertise in the terms of a consultant.
It's my ardent hope that the Town Board will support the completion of this draft
and finalization of these policies, so they can be implemented within the Town.

SUPERVISOR HARRIS: Judge?
JUSTICE EDWARDS: As Ellen mentioned, Ken Reeves probably should report
on Saturday. I had four tickets to the Mets game, and the bus left the Senior
Citizen complex down there, had three young children with me, fourteen and
on down to eleven, and there were probably thirty youngsters on the bus, and
maybe ten or twelve adults. I can honestly say, that those children were well,
well under control. There was no screaming, no yell!ng, no jumping, and it
was pleasure to see them come up to the forward part of the bus, where the
garbage pail was, to get rid of their trash. They should really be complimented
on the manners, that they had on that trip. Thank you.
SUPERVISOR HARRIS: Last week, we had, as most of you know, a serious day
that had to do with hostage situation, and I think that at this time, it's appropriate
to publicly thank the Mattituck Fire Department for the fine job that they did in
taking care of the traffic, the Southold Town Police Department for the fine work
they did in executing and their professionalism, that was involved with handling
that crisis situation, the Suffolk County Police Department was very responsive.
They sent out two units to us very quickly, upon the call from the Chief of Police,
the hostage negotiating team was sent out, and the crisis center in Suffolk County
responded out here with helicopters. Within twenty minutes we had personnel
here. I think that shows the type of government, that we have. It shows the
type of rapport, that we have with our western towns, and certainly with the
County of Suffolk. There are those who think that sometimes they don't get
enough for their tax dollars as is warranted, this certainly justified, in my position,
that money that has been expended into the general fund from the east end towns.
We're very appreciative for the professionalism, that has been displayed. We
also would like to thank the wives of the Mattituck fireman, who provided food
afterwards at the Mattituck Fire Department for all personnel, that was involved
in this situation. Thank goodness, there was nobody hurt, and everything turned
out in a positive fashion. Also, I'd like to report that I threw out the first soft
ball, starting the Little League game in Laurel in our beautiful park, that we
finally have finished due to the Town Board from last year, which really put
all it's efforts forth to make sure that this happened, and certainly this park,
those who haven't been up in Laurel off of 25, you should drive in there, and
see two beautiful ballfields. I was informed that Yankee Stadium should be in
as nice of shape, as our local ballfields here. With that, I'd like to turn it over
now to those member of the audience, that have anything they'd like to address
this Board on.
ANDREAS MARKAKIS: I'm Andreas Markakis from Southold. For a long time
I, and I believe many people in the Town, have been confused with the way the
garbage situation was handled. I must say, that I was very impressed with the
performance of the committee, an excellent, capable member, Mr. Wickham. The
impression made on the State authority i~ evident, and I believe that if the
hard work continues and this wise planning, we will reach the goal that we expect
to. We would turn the wheel around. We saw the signs last night. There's
still resistance, but they do appreciate the work done, and find a way, and I
sure we will be able to get what we need, as a transitional market of operation.
Another matter I noticed was the means of pulverizing regarding the asphalt road
material. On occassion I have observed lack of eft~iciency or performance, and

I would like to see somebody tell Mr. Corazzi~i,that we want better performance.
I understand there was a'~complaint abO~Ut~,l~k',~!0f materials and personnel, so
there's another example of prompness, I will put it this way, so please keep it
in mind, and we may have better roads. Thank you.
SUPERVISOR HARRIS: Thank you. Is there anybody else, who would like to
speak at this time? Yes?
WILLIAM PELL: A clarification on Local Law Number 9, which you just passed?
What do you consider if a husband works out of town, the wife would have to
have a job, if I understand right, Tom, in town, and they would be on that
first class list? Is that what you said?
COUNCILMAN WICKHAM: The first priority is for people who both live and work
in the Town, or one of the two spouses do both.
WILLIAM PELL: Does it have to be full-time or part-time in town?
COUNCILMAN WICKHAM: Essentially full-time.
WILLIAM PELL: I'm think of a spouse that is a waitress in a seasonal restaurant
She's been in this restaurant for ten years, doing the same thing. How would
they classify?

COUNCILWOMAN LARSEN: That's a full-time waitress, right?
WILLIAM PELL: The restaurant is only open for four months.
SUPERVISOR HARRIS: That's still a full-time position, that she has while she's
working. Right? She works' full-time as a waitress until the establishment closes?
I'll turn it over the Harvey for his interpretation.
TOWN ATTORNEY ARNOFF: I think what, Mr. Pell, with any legislation, you
can not pigeon hole and earmark each individual. What you have to do is have
some degree of flexibility within the definition provided. I think if you have
a full-time, the spirit of the enactment, the spirit of the legislation is to show
priority first to those who live and work in this Town, and that's what it says.
It says full-time employment. Now the problem is, you're asking what do we
mean by full-time employment? Is full-time part-time, or part-time full-time?
I mean we can get into definitive things, and reduce this to where it becomes
a comedy. That's not what I'm seeking to do, now what the Board is. I think
what we have to do is look at each application. If you had a lady, for example
in your example, who's a full-time employee of a local restaurant, I think it would
become clear she's a full-time employee. It so happens that they may be closed
to the winter months. That's not her fault. She's a full-time employee.
WILLIAM PELL: I wanted to know the spirit of the Board, and you answered on
behalf of the Board. Thank you.
TOWN ATTORNY ARNOFF: It's the spirit of the legislation.
SUPERVISOR HARRIS: Is there anybody else, who would like to speak? (No
response.) In closing, it's very rare that the DEC ever get complimented by
any municipality. However, I would be remiss, and last night I did indeed, thank
them and compliment them for expediting yard waste composting facility, that
we have in the landfill. We applied for that on April 10th, and yesterday, actually
on Friday afternoon, in came in May 4th, but it wasn't opened until Monday after-
noon. The point is that within three weeks, the DEC responded to this Town.
They knew that we had just finished spring clean-up. We took in approximatily
a thousand cubic yards of brush and leaves, and in the spirit of cooperation,
we received this letter allowing us to build this facility within the landfill, and
I certainly always believe that you give credit where credit due, and in this
case, the DEC certainly deserves full credit ~or that cooperation, that they
extended not only to myself, but also to this Town. In closing, is there any-
body else that has anything else? (No response.) If not, I'll have a motion.
