Replace the deteriorating wood sheathing bulkhead and stairs with vinyl sheathing bulkhead to protect the aforementioned property and structures by continuing to prevent erosion as well as prevent the potential for siltation into the Corey Creek and adjacent tidal wetlands. Site conditions: raised wood frame house and out buildings on south of Windy Point Lane. Rear of property includes deteriorated wooden bulkhead of @ 47' with a eastern return of about 10' along Corey Creek., The western return is no longer of functional value and will be left in place, or removed. East of the Kirsch property along the shoreline is a rough rubble revetment, west of the Kirsch property is a relatively new vinyl bulkhead that will butt up against the new proposed bulkhead. Project Action: Landward of the bulkhead excavate (front loader, bobcat etc) the required area and volume of soils to access the existing bulkhead. Place the appropriate silt barrier materials seaward of the bulkhead line. Dismantle and properly dispose of old bulkhead, install 57' (includes east return) of 10' vinyl C -lock sheet pile, wood piles (12'x 10") and two 6"X 6" wood walers. New bulkhead will be @ 15" higher than existing bulkhead to match the elevation of the adjacent bulkhead to the west. Bulkhead will be anchored by 15' foot x %" steel rod tie back 10" butt lay logs and 8" butt deadmen. The new bulkhead remains at same location of existing bulkhead. No excavation is anticipated seaward of the bulkhead line. Project action includes excavation and replacement @ 165 cubic yards of soils (area 0.017 ac ) to accommodate bulkhead removal and replacement. No added fill is anticipated. However, a surface layer gravel buffer reaching 10' landward of the bulkhead (0.012ac) is required, and will be installed. A removable, seasonal wooden stairs will replace the existing permanent wooden stairs. Seaward of the bulkhead and within the property line is an intertidal area vegetated with about 293 sq. ft. (0.0007ac) of Spartina. All reasonable precautions will betaken including the appropriate BMPs to minimize any impacts to these wetlands. Such measures will include landward construction approach, staking hay bales or other sediment barrier materials seaward of the bulkhead line and working during a time period that coincides with maximizing low tide during daylight working hours, again to reduce sedimentation. The proposed replacement of the deteriorated wood bulkhead with a new vinyl bulkhead in the same location Rromotes this policy by preserving, maintaining protecting, and enhancing the character this waterfront community along the Corey Creek shore line. The proposed project does not represent a change or increase in developmental pressure, and does allows continuation of beneficial use of a coastal location. It is not anticipated that this project will significantly impact any natural resources. It is possible that some temporary impacts may affect the spartina nearest to the bulkhead. There may be some deposition of sediments or mechanical disturbance to the vegetation due to removal and installation actions and these effects could negatively impact some vegetation. The Spartina is expected to recover from these temporary impacts. Any permanent loss of spartina will be mitigated for by replanting if necessary. This proposed project is compliant with this policy. 3. General visual quality of the project site will be enhanced by removing deteriorated bulkhead components and replacing them with new bulkhead materials of compatible character to the neighboring (western) structure. These new materials are expected to deteriorate at a much slower rate than ordinary wood thus maintaining enhanced visual quality for a far greater length of time than ordinary wood. Impacts to natural resources (vegetation/intertidal zone/WQ) will be minimized by implementing BMPs such as placing sediment barriers seaward of the bulkhead location and conducting most work from landward side of the bulkhead location. This proposed project is compliant with this policy. 4. The residence at 555 Windy Pt lane was raised post Sandy and there is a natural wetlands buffer fronting the existing bulkhead, but it is unlikely that this small area of spartina or an enhancement in vegetation would provide and adequate source of erosion control except under the most mild conditions without a hard structure. Similarly there are no other natural erosion control features to enhance or restore that can provide erosion control at this location. Further deterioration of the of bulkhead and eventual failure would facilitate rapid erosion of the land behind the bulkhead putting the residence as well as neighboring properties at increased flood risk. It is also likely that rapid loss of sediments from behind the failed bulkhead may negatively impact localized water quality, the character and quality of the adjacent intertidal benthos, and the upper vegetated areas of the intertidal. Reconstruction of the bulkhead is the most effective and affordable method of providing erosion protection, and decreasing potential threats to life and property at this location. Appropriate BMPs (see #3) including recommendations from the trustees will be instituted to minimize any negative impacts to natural resources. Impacts to the existing vegetation may occur, and if deemed significant replanting will be conducted. This proposed project is compliant with this policy. 6. This proposed bulkhead replacement project is located within Reach 7 of the Town of Southold Significant Coastal Fish and Wildlife Habitat designations. Ecological quality at the construction site and adjacent to this proposed project will be protected and maintained Significant losses or degradation are not anticipated, as avoidance and minimization will be instituted whenever possible by using BIVIPs as previously discussed as well as employing those regulations and recommendations required by the town trustees. No significant impacts on ecological components or ecological function are expected from project implementation. There may be temporary negative impacts including localized increases to turbidity, increased sedimentation within the intertidal, and potential damage to vegetation immediately adjacent to the construction zone, where the bulkhead is located. No fragmentation is expected. Project construction will not significantly impair viability of the project site ecosystems or adjacent intertidal or littoral habitats. The project will not significantly impact any physical or chemical parameters as they relate to tolerance limits of any fish, benthic or other wildlife species. There are no known (State or Federal) rare or endangered species of plants or wildlife expected to be present at or adjacent to the project area property. However, it is possible that occasional transient individuals of listed species ,may visit the area. None of these previously listed impacts are expected to have significant or long term negative impacts to these habitats. Intertidal organisms, infauna and epifauna evolve various survival strategies to tolerate large often rapid changes in turbidity, salinity, and sedimentation rates in areas susceptible periodic high energy events. Finfish will migrate out of the area. Temporary impacts to physical and chemical parameters from the mitigated construction activity of this project are not expected to surpass the tolerance levels of the various marine organisms existing in these habitats. Any negative benthic impacts are expected to be short term and insignificant with full recovery of benthic diversity and density within a few months after construction is completed. There will be no filling or dredging within the tidal wetlands. Although it is not anticipated, any significant loss of vegetation will be mitigated for by replanting as recommended by the Trustees in the pre -submission site visit.
