AUTHORIZATION
iPursuant to the provisions of Chapter 275 of the Town Code of the Town of Southold and in
accordance with the Resolution of the Board of Trustees adopted at the meeting held on February 12, 2020, and
in consideration of application fee in the sum of $250.00 paid by Fred & Maureen Dacimo and subject to the
Terms and Conditions as stated in the Resolution, the Southold Town Board of Trustees authorizes and permits
the following: -
Wetland Permit to replace the foundation of a 36.2'x32' existing residential cottage and raise
foundation to FEMA standards, renovate the cottage, and for the existing 20.8'x68.5' one-story
frame storage building with concrete slab; existing 40.41x20.3' two-story frame building;
concrete shed and fuel tank; existing 10.2'x14.2' shed; existing
74.3'x49'x28.7'x17.7'x51.6'x31.3' one-story storage building; existing 8'x8' windmill tower
base; and existing 5'x5' outhouse/public bathroom for marina customers; with, the condition
that the following line from the project description be stricken: "and repair or replace existing
sanitary system as needed"; and as depicted on the site, plan prepared by Frederick R. Weber,
Architect dated December 18, 2018, and stamped approved on February 12, 2020.
IN WITNESS WHEREOF, the said Board of Trustees hereby causes its Corporate Seal to be affixed,
and these presents to be subscribed by a majority of the said Board as of the 12th day of February, 2020.
TERMS AND CONDITIONS
The Permittee Fred & Maureen Dacimo residing at 5520 Narrow River Road, Orient,
New York as part of the consideration for the issuance of the Permit does understand and
prescribe to the following:
That the said Board of Trustees and the Town of Southold are released from any and all
damages, or claims for damages, of suits arising directly or indirectly as a result of any
operation performed pursuant to this permit, and the said Permittee will, at his or her own
expense, defend any and all such suits initiated by third parties, and the said Permittee
assumes full liability with respect thereto, to the complete exclusion of the Board of
Trustees of the Town of Southold.
2. That this Permit is valid for a period of 24 months, which is considered to be the estimated
time required to complete the work involved, but should circumstances warrant, request for
an extension may be made to the Board at a later date.
3. That this Permit should be retained indefinitely, or as long as the said Permittee wishes to
maintain the structure or project involved, to provide evidence to anyone concerned that
authorization was originally obtained.
4. That the work involved will be subject to the inspection and approval of the Board or its
agents, and non-compliance with the provisions of the originating application may be cause
for revocation of this Permit by resolution of the said Board.
That there will be no unreasonable interference with navigation as a result of the work
herein authorized.
6. That there shall be no interference with the right of the public to pass and repass along the
beach between high and low water marks.
7. That if future operations of the Town of Southold require the removal and/or alterations in
the location of the work herein authorized, or if, in the opinion of the Board of Trustees,
the work shall cause unreasonable obstruction to free navigation, the said Permittee will be
required, upon due notice, to remove or alter this work project herein stated without
expenses to the Town of Southold.
8. That the said Board will be notified by the Permittee of the completion of the work
authorized.
9. That the Permittee will obtain all other permits and consents that may be required
supplemental to this permit, which may be subject to revoke upon failure to obtain same.
10. No right to trespass or interfere with riparian rights. This permit does not convey to the
permittee any right to trespass upon the lands or interfere with the riparian rights of others
in order to perform the permitted work nor does it authorize the impairment of any rights,
title, or interest in real or personal property held or vested in a person not a party to the
permit.

The Board of Town Trustees took the .following action during its regular meeting held on
Wednesday, February 12, 2020 regarding the above matter:
WHEREAS, Patricia C. Moore, Esq. on behalf of FRED & MAUREEN DACIMO applied
to the Southold Town Trustees for a permit under the provisions of Chapter 275 of the
Southold Town Code, the Wetland Ordinance of the Town of Southold, application
dated July 23, 2019, and,
WHEREAS, said application was referred to the Southold Town Conservation Advisory
Council and to the Local Waterfront Revitalization Program Coordinator for their findings
and recommendations, and,
WHEREAS, the LWRP Coordinator issued a recommendation that the application be
found Consistent with the Local Waterfront Revitalization Program policy standards,
and,
WHEREAS, a Public Hearing was held by the Town Trustees with respect to said
application on September 18, 2019 and February 12, 2020, at which time all interested
persons were given an opportunity to be heard, and,
WHEREAS, the Board members have personally viewed and'are familiar with the
premises in question and the surrounding area, and,

WHEREAS, the Board has considered all the testimony and documentation submitted
concerning this application, and,
WHEREAS, the structure complies with the standards set forth in Chapter 275 of the
Southold Town Code,
WHEREAS, the Board has determined that the project as proposed will not affect the
health, safety and general welfare of the people of the town,
NOW THEREFORE BE IT,
RESOLVED, that the Board of Trustees have found the application to be Consistent
with the Local Waterfront Revitalization Program, and,
RESOLVED, that the Board of Trustees approve the application of FRED & MAUREEN
DACIMO to replace the foundation of a 36.2'x32' existing residential cottage and raise
foundation to FEMA standards, renovate the cottage, and for the existing 20.8'x68.5'
one-story frame storage building with concrete slab; existing 40.4'x20.3' two-story frame
building; concrete shed and fuel tank; existing 10.2'x14.2' shed; existing

Permit to construct and complete project will expire two years from the date the permit
is signed. Fees must be paid, if applicable, and permit issued within six months of the
date of this notification.
Inspections are required at a fee of $50.00 per inspection. (See attached schedule.)

The proposed action has been reviewed to Chapter 268, Waterfront Consistency Review ofthe
Town of Southold Town Code and the Local Waterfront Revitalization Program (LWRP) Policy
Standards. Based upon the information provided on the LWRP Consistency Assessment Form
submitted to this department, as well as the records available to me, it is my recommendation that
the proposed action is CONSISTENT with the policies and therefore CONSISTENT with the LWRP
provided the following is considered to further policy 6:
1. Due to the close proximity of the cottage to high quality•surface waters and
location within a VE FEMA flood zone, the installation of a I/A OWTS should be
required. Hallock Bay is a high quality marine wetland used as a spawner
sanctuary for shellfish and a designated NYSDOS Coastal Fish and Wildlife
Habitat (Orient Harbor) and NYSDEC Critical Environmental Area.
2. It is recommended that the Board verifies compliance with Chapter 236 Storm
Water Management of the Southold Town Code to further protect water quality.
Pursuant to Chapter 268, the Board of Trustees shall consider this recommendation in preparing its ,
written determination regarding the consistency of the proposed action.

Hi Elizabeth- The building department already inspected the buildings (all pre-existing buildings) twice
and they have cleared the issuance of the pre-co's. The pre-co's will be issued when the electrical permit
is issued. I believe that the October inspection is to close out electrical inspection which was required for
a safety electrical repair..I will double check this.
Confirmation that the pre -co will be issued should be available from the building department without the
need to delay the issuance of the wetland permit.

Please be advised that yesterday the Board inquired about the building inspection
regarding the Dacimo property; sctm#1000-27-2-4 and found out that the
inspection on the cottage was rescheduled to October 29, 2019. As the board
wants to know the building dept. determination of the existing cottage prior to
any Trustee determinations, they are postponing the Dacimo application from the
October 16, 2019 meeting to the' November 13, 2019 meeting with hopes that by
then the building dept. was.able to perform an inspection and make a` building
dept. determination.

In accordance with the LWRP coordinator's request for additional information and
your request for the foundation plan, enclosed is an existing conditions plan and
preliminary pile plan dated December 18, 2018 prepared by Architect Fred Weber to
raise the cottage.
As you know the -existing cottage was constructed prior to zoning. The cottage
has operable heating, electric, and plumbing, an updated roof, and was occupied prior
to commencement of permit applications to raise the cottage to FEMA standards (VE EI
9 + 2). Attached are pictures taken of the interior of the cottage when it was vacated by
Ms. Koster after occupying the cottage for over 49 years.
Whether the cottage is raised or not, the owners intend to make cosmetic repairs,
customary maintenance, and electrical update (for safety) to the existing structure. The
cottage has provided affordable housing in Orient. The owner wishes to raise the
cottage to meet FEMA requirements, complete the repairs and maintenance, and make
the cottage available as soon as possible.

INSTRUCTIONS
All applicants for permits* including Town of Southold agencies, shall complete this CCAF for
proposed actions that are subject to the Town of Southold Waterfront Consistency Review Law. This
assessment is intended to supplement other information used by a Town of Southold agency in
making a determination of consistency. *Except minor exempt actions including Building Permits
and other ministerial permits not located within the Coastal Erosion Hazard Area.
2. Before answering the questions in Section C, the preparer of this form should review the exempt
minor action list, policies and explanations of each policy contained in the Town of Southold Local
Waterfront Revitalization Program. A -proposed--action will be evaluated as to its si nig ficant
beneficial and adverse effects upon the coastal area (which includes all of Southold Town)*
3. If any question in Section C on this form is answered "yes" or "no", then the proposed action will
affect the achievement of the LWRP policy standards and conditions contained in the consistency
review law. Thus, each answer must be explained .in. detail, listing both supporting and non -
