SUFFOLK COUNTY ADMINISTRATIVE CODE: This application was referred as required under the Suffolk County Administrative Code Sections A 14-14 to 23, and the Suffolk County Department of Planning issued its reply dated November 15, 2019 stating that this application is considered a matter for local determination as there appears to be no significant county -wide or inter -community impact. LWRP DETERMINATION: The relief, permit, or interpretation requested in this application is listed under the Minor Actions exempt list and is not subject to review under Chapter 268. PROPERTY FACTS/DESCRIPTION: The subject, non -conforming 5,652 square feet, .13 acre rectangular parcel located in the R-40 Zoning District measures 40.27 feet along Bridge Street, then runs north 140.56 feet along a residentially developed lot to the east, then runs 40.20 feet along a residentially developed lot to the north, then returns 140.56 feet along two residentially developed lots to the west. The site is undeveloped, however, a 4 - bedroom, two-story wood frame house is proposed for the site, including a pervious driveway, as shown on the survey prepared by John T. Metzger, Licensed Land Surveyor, last revised December 9, 2019. BASIS OF APPLICATION: Request for Variances from Article XXIII, Section 280-124 and the Building Inspector's August 27, 2019, Amended December 6, 2019 Notice of Disapproval based on an application for a permit to construct a single family dwelling at, 1) located less than the code permitted side yard setback of 10 feet; 2) located less than the code permitted combined side yard setback of 25 feet, located at 155 Bridge Street, Greenport, NY, SCTM#1000-34-3-45. RELIEF REQUESTED: The applicant requests variances to construct a new, two-story, wood -frame single family residence, measuring 20 feet wide by 47 feet long, for a total of 1,648 square feet of living space on a 5,652 square feet lot with a proposed single side yard setback of 5 feet and a combined side yard setback of 20.2 where the code requires a minimum single side yard setback of 10 feet with a minimum combined side yard setback of 25 feet. ADDITIONAL INFORMATION: According to Town records a single-family residence stood on the lot and was presumably built in the early to mid -20`x' Century, prior to zoning. A previous owner was issued two demolition permits for the residence under Building Permit #20666 issued May 29, 1992 and Building Permit #22626 issued Page 2, February 20, 2020 #7367, Nicholson — Boger SCTM No. 1000-34-3-45 March 15, 1995. The lot is wooded and vacant of any improvements. The applicant proposes to construct a residence with a ridge height of 28.8 feet and does not intend to have a garage. Total lot coverage for all improvements is proposed to be 16.6%. Furthermore, the applicant provided documentation to establish that the lot is within the Greenport Sewer District, that service is available, and that the treatment plant has sufficient capacity for the proposed use and loading. Suffolk County Water Authority also affirmed that a public water main exists on Bridge Street, negating the need for a private well. An immediate neighbor submitted a letter indicating their preference to "flip" the driveway location, creating a greater distance from the proposed new dwelling and their home from. No other member of the public spoke in favor of or against this application. The applicant's representative submitted a map showing established front yard setbacks upon neighboring developed properties. Pursuant to Section 280-104, where property in the vicinity is improved with principal buildings with front yards of less than that required, the front yard setback shall be the average setback of the existing buildings within 300 feet of the proposed building on the same side of the street within the same use district. The proposed dwelling property is greater than the average front yard setback. FINDINGS OF FACT/ REASONS FOR BOARD ACTION: The Zoning Board of Appeals held a public hearing on this application on February 6, 2020 at which time written and oral evidence were presented. Based upon all testimony, documentation, personal inspection of the property and surrounding neighborhood, and other evidence, the Zoning Board finds the following facts to be true and relevant and makes the following findings: 1. Town Law 12267-b(3)(b)(1). Grant of the variances will not produce an undesirable change in the character of the neighborhood or a detriment to nearby properties. While the subject property is located in the Town of Southold, the streetscape conforms to that of the adjacent Incorporated Village of Greenport, where small lots are developed with single and multi -family residences in a `grid' fashion, typical of early 20'h Century communities. The majority of homes in the immediate area are of varying size, architectural style, condition and age, many of which do not have conforming front, rear, or side yard setbacks. 2. Town Law §267-b(3)(b)(2). The benefit sought by the applicant can be achieved by some method, feasible for the applicant to pursue, other than an area variance. The applicant can build a house with a maximum width of 15.27 feet; however, such a narrow house is not common to the community nor practical for living conditions and will also require additional considerations unique to the site to achieve a single-family residence comfortable to current standards. 3. Town Law §267-b(3)(b)(3). The variances granted herein are mathematically substantial, representing 50% relief relative to a minimum single side yard setback and 19.2% relief from the code relative to a minimum combined side yard setback. However, a reduced side yard and combined yard setback will not be discernable in this neighborhood since many adjacent properties share similar non -conformities. Additionally, the applicant proposes to construct the house along the western lot line, thereby increasing the distance to the eastern lot line where the closest residential structure is located. In doing this, the applicant also proposes to install a pervious driveway, allowing future resident's to park multiple cars on site instead of using public street parking in the area. The applicant states that the property will be landscaped and the neighbor to the west maintains a 6 -feet high, vinyl, stockade fence ensuring privacy to their home located a substantial distance away. 4. Town Law &267-b(3)(b)(4). No evidence has been submitted to suggest that a variance in this residential community will have an adverse impact on the physical or environmental conditions in the neighborhood. The applicant must comply with Chapter 236 of the Town's Storm Water Management Code. Page 3, February 20, 2020 #7367, Nicholson — Boger SCTM No. 1000-34-3-45 5. Town Law 4267-b(3)(b)(5). The difficulty has been self-created. The applicant purchased the parcel after the Zoning Code was in effect and it is presumed that the applicant had actual or constructive knowledge of the limitations on the use of the parcel under the Zoning Code in effect prior to or at the time of purchase. 6. Town Law 4267-b. Grant of the requested relief is the minimum action necessary and adequate to enable the applicant to enjoy the benefit of a new construction, single-family residence measuring 20 feet by 47 feet while preserving and protecting the character of the neighborhood and the health, safety and welfare of the community. RESOLUTION OF THE BOARD: In considering all of the above factors and applying the balancing test under New York Town Law 267-B, motion was offered by Member Planamento, seconded by Member Dantes, and duly carried, to GRANT the variances as applied for, and shown on the survey prepared by John T. Metzger, Licensed Land Surveyor, last revised December 9, 2019 and the architectural plans prepared by Anthony M. Portillo, R.A., (Pages page 1 and page 2 elevations and floor plans) dated December 4, 2019. Any deviation from the survey, site plan and/or architectural drawings cited in this decision will result in delays and/or a possible denial by the Building Department of a building permit, and may require a new application and public hearing before the Zoning Board of Appeals. Any deviation from the variance(s) granted herein as shown on the architectural drawings, site plan and/or survey cited above, such as alterations, extensions, or demolitions, are not authorized under this application when involving nonconformities under the zoning code. This action does not authorize or condone any current or future use, setback or other feature of the subject property that may violate the Zoning Code, other than such uses, setbacks and other features as are expressly addressed in this action. In the event that this is an approval subject to conditions, the approval shall not be deemed effective until such time that the foregoing conditions are met; and failure to comply therewith will render this approval null and void. The Board reserves the right to substitute a similar design that is de minimis in nature for an alteration that does not increase the degree of nonconformity. Pursuant to Chapter 280-146(B) of the Code of the Town of Southold any variance granted by the Board of Appeals shall become null and void where a Certificate of Occupancy has not been procured, and/or a subdivision map has not been filed with the Suffolk County Clerk, within three (3) years from the date such variance was granted. The Board of Appeals may, upon written request prior to the date of expiration, grant an extension not to exceed three (3) consecutive one (1) year terms. Attached you will find a survey showing the foundation location taken after the foundation walls were poured. The side yard setback,as located on the survey,is now 6.3ft with the combined side yard setback exactly the same at 20.3ft. The side yard setback of 6.3ft meets the ZBA's ruling stating a side yard setback of"minimum 5ft"and is actually more conforming than what was originally applied for. Other homes on the street are all on undersized/nonconforming lots. In fact, many of the existing homes have side yard setbacks that are more non -conforming than what is being proposed by this application. On Bridge Street, four of the surrounding homes on the same side of the street breach the 25ft combined side yard setback by 3ft to 11ft. Additionally, two houses across the street from the proposed home breach permitted setbacks by 1ft and 18ft. Behind the proposed home on Champlin Place, four homes breach permitted setbacks by Oft to 14ft. We are requesting a 4'8" combined side yard setback overage. The previous home on this lot was 23ft wide while the proposed home is 20ft wide. The previous home fit in with the character of the neighborhood and was of no detriment to the nearby properties. Thus, the new residence to be built is more code compliant than the previous dwelling and will surely fit with the character of the neighborhood. Granting a 5ft side yard setback also allows for an adequately sized driveway for multiple cars to be placed next to the house so that the shortage of available parking spots in Greenport will not be compounded. 2. Currently, under 280-124, the building code only allows a 15ft wide home to be built on the lot. A dwelling this narrow is not practical as most living spaces would be cramped, uncomfortable, and certainly not conducive to creating modern living accommodations. Utility placement would problematic and inefficient. There is also not a single home in the neighborhood that is 15ft wide. If we are not granted a side yard variance, we would be forced to build a home grossly out of character of not only the neighborhood, but the entirety of Southold Town and the Village of Greenport. There is no other remedy available to Applicant to ameliorate these issues for the subject lot. The proposed home, is not excessive in size and, as previously stated, is similar to the existing homes in the surrounding area. More importantly this is not an excessively large dwelling as evidenced by the fact that it is still under the 20% lot coverage threshold. The relief is also not substantial because it is significantly less than the overages of existing homes on the street. While I am not opposed to the construction of a home on this parcel, I do respectfully oppose the location of the home as currently proposed. As proposed the home will be at a reduced side yard setback of 5 feet, and my property will be negatively impacted by the massing of the house on our property line. It would be most beneficial if the location of the proposed home and driveway be switched -- in other words for the driveway to be located along the boundary between my parcel and the applicant's parcel with the proposed home moved further to the east. It is my opinion that this would have less of a visual impact on my own property and would not negatively impact the existing home to the east of the applicant's parcel as there would be a driveway between the proposed home and existing home to the east.
