SUFFOLK COUNTY ADMINISTRATIVE CODE: This application was referred as required under the Suffolk County Administrative Code Sections A 14-14 thru 14-25, and the Suffolk County Department of Planning issued its reply dated November 15, 2019 stating that this application is considered a matter for local determination as there appears to be no significant county -wide or inter -community impact. LWRP DETERMINATION: The relief, permit, or interpretation requested in this application is listed under the Minor Actions exempt list and is not subject to review under Chapter 268. PROPERTY FACTS/DESCRIPTION: The subject property is located on a nonconforming 24,865.87 square foot parcel in an R-40 Zoning District. The northerly property line measures 175.00 feet and is adjacent to a road that is shown on the Suffolk County tax map. The subject road was never paved and is concealed by vegetation, and there is only a visible curb cut on Willow Drive. The easterly property line measures 100.00 feet and is adjacent to Willow Drive, the southerly property line measures 200.00 feet, and the westerly property line measures 125.00 feet and borders a designated New York State Freshwater Wetlands located more than 100 feet west of the subject property. The property is improved with a two-story framed residence and attached garage with an existing accessory shed that measures 10 feet by 12.2 feet as shown on the survey map prepared by John C. Ehlers, L.S., last revised September 10, 2019, with a notation indicating a New York State Wetland Boundary flagged on September 7, 2018. BASIS OF APPLICATION: Request for Variance from Article III, Sections 280-15 and the Building Inspector's September 18, 2019 Notice of Disapproval based on an application for a permit to construct an accessory in -ground swimming pool; at, 1) located in other than the code required rear yard; located at 1120 Willow Drive, Greenport, NY. SCTM#1000-40-2-6.8. RELIEF REQUESTED: The applicant requests a variance for a permit to locate and construct an accessory in - ground swimming pool in the front yard. The Town Code requires accessory structures to be located in the rear yard. Page 2, February 20, 2020 #7366, Evans SCTM No. 1000-40-2-6.8 ADDITIONAL INFORMATION: The subject property is currently fenced. However, the fence height is not pool compliant as a four -foot fence would be required. The property to the west that is preserved by the State and designated as Freshwater Wetlands extinguishes the non -existing road that is shown on the Suffolk County Tax Map. Currently, the survey, last revised 9/10/2019 depicts a proposed lot coverage measuring 21.3% that includes the driveway which should not be considered in this calculation. The survey can be revised to depict an accurate percentage of lot coverage of approximately 15.35%. FINDINGS OF FACT/ REASONS FOR BOARD ACTION: The Zoning Board of Appeals held a public hearing on this application on February 6, 2020 at which time written and oral evidence were presented. Based upon all testimony, documentation, personal inspection of the property and surrounding neighborhood, and other evidence, the Zoning Board finds the following facts to be true and relevant and makes the following findings: 1. Town Law X267-b(3)(b M. Grant of the variance or will not produce an undesirable change in the character of the neighborhood or a detriment to nearby properties. This is a residential neighborhood and in -ground swimming pools are common. The yard in which the pool is proposed is fenced and the pool will not be seen from the street or adjacent properties. 2. Town Law X267 -b(30)(2). The benefit sought by the applicant cannot be achieved by some method, feasible for the applicant to pursue, other than an area variance. A variance is needed due to the existence of an unopened road that only exists on a tax map and that technically creates two front yards on the subject property. 3. Town Law §267-b(3)(b)(3). The variance granted herein is mathematically substantial, representing 100% relief from the code. However, the property to the west of the subject lot is preserved by the State and designated as Freshwater Wetlands, which extinguishes the non -existing road that is shown on the Suffolk County Tax Map 4. Town Law &267-b(3)(b)(4). No evidence has been submitted to suggest that a variance in this residential community will have an adverse impact on the physical or environmental conditions in the neighborhood. The applicant must comply with Chapter 236 of the Town's Storm Water Management Code. 5. Town Law &267-b(3)(b)(5). The difficulty has not been self-created. The applicant is proposing to locate a swimming pool in a corner of their architectural rear yard which also fronts an unopened, non-existent road. The location of the proposed swimming pool is intended to permit additions and alterations to the existing single-family dwelling in the future. 6. Town Law 4267-b. Grant of the requested relief is the minimum action necessary and adequate to enable the applicant to enjoy the benefit of an in -ground swimming pool while preserving and protecting the character of the neighborhood and the health, safety and welfare of the community. RESOLUTION OF THE BOARD: In considering all of the above factors and applying the balancing test under New York Town Law 267-B, motion was offered by Member Weisman (Chairperson), seconded by Member Planamento, and duly carried, to GRANT the variance as applied for, and shown on the survey map prepared by John C. Ehlers, L.S., and last revised September 10, 2019. Page 3, February 20, 2020 #7366, Evans SCTM No. 1000-40-2-6.8 SUBJECT TO THE FOLLOWING CONDITIONS: 1. Pool mechanicals shall be placed in a sound deadening enclosure. 2. A drywell for pool de -watering shall be installed. 3. A code compliant fence for the pool shall be installed. 4. An updated survey shall be provided to depict the accurate proposed lot coverage by removing the driveway from the calculations. That the above conditions be written into the Building Inspector's Certificate of Occupancy, when issued. Any deviation from the survey, site plan and/or architectural drawings cited in this decision will result in delays and/or a possible denial by the Building Department of a building permit, and may require a new application and public hearing before the Zoning Board of Appeals. Any deviation from the variances) granted herein as shown on the architectural drawings, site plan and/or survey cited above, such as alterations, extensions, or demolitions, are not authorized under this application when involving nonconformities under the zoning code. This action does not authorize or condone any current or future use, setback or other feature of the subject property that may violate the Zoning Code, other than such uses, setbacks and other features as are expressly addressed in this action. In the event that this is an approval subject to conditions, the approval shall not be deemed effective until such time that the foregoing conditions are met; and failure to comply therewith will render this approval null and void. The Board reserves the right to substitute a similar design that is de minimis in nature for an alteration that does not increase the degree of nonconformity. Pursuant to Chapter 280-146(B) of the Code of the Town of Southold any variance granted by the Board of Appeals shall become null and void where a Certificate of Occupancy has not been procured, and/or a subdivision map has not been filed with the Suffolk County Clerk, within three (3) years from the date such variance was granted. The Board of Appeals may, upon written request prior to the date of expiration, grant an extension not to exceed three (3) consecutive one (1) year terms. (b) Felled trees, stumps, and debris must be removed from the premises prior to occupancy of the residence. 10. Upkeep of Grounds and Dwelling (a) No garbage, rubbish, paper or other refuse shall be accumulated, or burned, on the premises. All such material shall be stored in a hidden, sanitary container and shall be removed regularly from the premises. (b) The grounds of each residence must at all times be kept reasonably well maintained. (c) No clothes poles, clotheslines, playground equipment or vegetable gardens shall be placed, erected or maintained on any portion of the subject premises except in such a position that it shall not be readily visible from the street, without the prior written approval of HOMESTEAD ACRES AT GREENPORT, INC. (d) No residence shall be boarded up nor shall any windows or entrances be sealed. (e) No trucks, cars, boats, mobile homes, campers or trailers shall be stored on the subject premises with the exception that no more than two regularly used automobiles may be parked in the driveway of each residence and that no more than one boat, not to exceed twenty feet in length, may be temporarily stored in the rear of each dwelling. 11. Moving Building (a) No building shall be moved upon the subject premises, but this restriction shall be no bar to the change of location of a building by the owner from one part of his property to another part of his property if within the hereinabove described premises. (b) Such "Park and Recreation Areas" are restricted to open space use in that no structures shall be built on the open areas. Notwithstanding any other provisions of this declaration, the open areas shall remain as such in perpetuity. (c) Each owner of a dwelling constructed on the subject premises shall share pro rata, together with other property owners entitled to the use of such facilities, in the real estate taxes and maintenance charges incurred in connection with said improvements to the "Park and Recreation Area." Annoying Activities (a) No noxious or offensive activity shall be carried on upon the subject premises, nor shall anything be done thereon which may be or may become an annoyance or nuisance of the neighborhood. Formation of a Homes Association (a) Declarant covenants and agrees that at or before the time one-half of the lots have been conveyed by it to third parties that it will at its own cost and expense establish a not -for- profit corporation to be known as HOMESTEAD ACRES HOMES ASSOCIATION hereinafter referred to as "Homestead Acres Homes Association" and that within sixty days thereafter convey to such "Association" all the right, title and the interest of the declarant in and to said Park and Recreation area together with any and all pYivate'streets shown on said Subdivision Map and, any and all areas shown on the Subdivision map for future highway dedication. (e) Dedication of all common areas shall be recorded directly on the final plat, or by reference on that plat to a dedication in a separately recorded document. Resubdivision of such areas is prohibited. (f) The Articles of Incorporation and By Laws of the Homes Association and any amendments thereto shall be subject to approval by the Southold Town Board. (g) The Homes Association shall be perpetual; it shall purchase insurance, pay taxes, specify in its charter and bylaws an annual homeowner's fee, give provision for assessment and provide that all such charges become a lien on each property in favor of said Association. The Association shall have the right to proceed in accordance with all necessary legal action for the foreclosure and enforcement of liens, and it shall also have the right to commence action against any members for the collection of any unpaid assessment in any court of competent jurisdiction. (h) The developer shall assume all responsibilities as previously outlined for the Homes Association until a majority of the dwelling sites ar sold, at which time the Homes Association shall be automatically established. 18.
