SUFFOLK COUNTY ADMINISTRATIVE CODE: This application was referred as required under the Suffolk County Administrative Code Sections A 14-14 to 23, and the Suffolk County Department of Planning issued its reply dated November 18, 2019 stating that this application is considered a matter for local determination as there appears to be no significant county -wide or inter -community impact. LWRP DETERMINATION: This application was referred for review under Chapter 268, Waterfront Consistency review of the Town of Southold Town Code and the Local Waterfront Revitalization Program (LWRP) Policy Standards. The LWRP Coordinator issued a recommendation dated January 23, 2020. Based upon the information provided on the LWRP Consistency Assessment Form as well as the records available describing a top of the bluff setback for the inground swimming pool of 45 feet, it is recommended that the proposed action is INCONSISTENT with LWRP policy standards and therefore is INCONSISTENT with the LWRP. The following is a summary of LWRP comments: Policy 1: The Long Island Sound bluff systems within this area are traditionally unstable and experience periods of normal and accelerated erosion. There is room on the property to locate the pool near the house thereby increasing the setback to the top of bluff. Policy 4: The Town Board of Trustees requires a setback of 50 feet from a pool and related structures to a top of bluff. Policy 4.1: In order to minimize potential loss and damage, structures should be located as far from erosion hazards as possible. It is recommended that the pool is relocated to achieve the greatest setback from the top of bluff. Policy 6.3: Development on or near bluff ecosystems has resulted in loss and impairments to these and other dependent natural features (beaches) and their functions; cumulatively impacting the Town of Southold's ecosystem. Based upon the aforementioned comments by the LWRP Coordinator, the Board requested that the applicant relocate the pool to a more conforming location in order to mitigate the described adverse impacts to the environment. The applicant submitted a survey, last revised February 6, 2020, depicting an amended location and design of the proposed swimming pool, setback 76 feet from the top of the bluff. Given the increased setback from Page 2, February 20, 2020 #7364, Basios SCTM No. 1000-94-1-12.2 the bluff proposed in the amended application AND THE CONDITIONS IMPOSED HEREIN, the Board finds the proposed action to be CONSISTENT with the LWRP. SUFFOLK COUNTY SOIL AND WATER CONSERVATION DISTRICT: This application was referred to Suffolk County Soil and Water Conservation District (SCS&WCD) for review and comment and the agency issued its reply received February 19, 2020 indicating an inventory, evaluation and site visit had occurred on February 18, 2020. Agency comments include: • Irrigation located throughout the property should be monitored and regularly maintained to eliminate the risk of erosive runoff and ensure stability of the bluff face. • It is essential for the health of the bulkhead and stability of the bluff to perform regular maintenance on the structure. • Installation of a pool is a ground disturbing activity. It is important to use caution during any type of construction in close proximity to the bluff. Compaction from heavy machinery should be minimized by creating and utilizing necessary paths to enter, work and exit the property. Areas that have experienced disturbance of vegetation should be revegetated with plant species native to the ecology. • Heavy equipment should not be stored near critical areas of bluffs or near any unstable soils. • Water runoff is a major contributor to bluff destabilization. It is advised to vegetate bare soil with native species to mitigate the effects of stormwater runoff. PROPERTY FACTS/DESCRIPTION: The subject property is a conforming 41,894 square foot parcel located in an R-40 Zoning District. The parcel has 102.53 feet of bulkhead frontage along Long Island Sound. The parcel measures 105.00 feet fronting Sound View Avenue, along the southerly property line, measures 395.43 feet along the westerly property line, and measures 416.71 feet along the easterly property line. The parcel is improved with a two-story concrete dwelling and garage, a concrete deck and a second story concrete deck. There is also a staircase going down the bluff which includes a wood walkway and two landings. All is shown on a survey prepared by Howard W. Young, L.S. last revised February 6, 2020. BASIS OF APPLICATION: Request for a Variance from Sections 280-116(A)(1) and the building inspector's September 25, 2019 Notice of Disapproval based on an application for a permit to construct an accessory in -ground swimming pool at, 1) located less than the code required 100 feet from the top of the bluff, located at 2505 Soundview Avenue, (Adj. to the Long Island Sound) Mattituck NY. SCTM# 1000-94-1-12.2 RELIEF REQUESTED: The applicant requests a variance to construct an accessory in ground swimming pool located 45 feet from the top of the bluff where the Town Code requires a minimum 100 -foot setback from the top of the bluff. AMENDED APPLICATION: During the hearing, the applicant was asked to bring the plan into more conformity with the code. The applicant on February 11, 2020 submitted a survey last revised February 6, 2020 increasing the bluff setback to 76 feet thereby bringing the plan into more conformity with the Town Code. FINDINGS OF FACT/ REASONS FOR BOARD ACTION: The Zoning Board of Appeals held a public hearing on this application on February 6, 2020 at which time written and oral evidence were presented. Based upon all testimony, documentation, personal inspection of the property and surrounding neighborhood, and other evidence, the Zoning Board finds the following facts to be true and relevant and makes the following findings: Page 3, February 20, 2020 #7364, Basios SCTM No. 1000-94-1-12.2 1. Town Law X267-b(3)(b)(1). Grant of the variance as amended will not produce an undesirable change in the character of the neighborhood or a detriment to nearby properties. The neighborhood consists of single-family waterfront homes setback 100 feet or more from the top of the bluff. Swimming pools in code conforming locations are characteristic in this neighborhood. However, the placement of the existing home does not leave space to construct a swimming pool in a rear yard location and still meet the code required minimum 100 -foot setback from the top of the bluff. 2. Town Law §267-b(3)(b)(2). The benefit sought by the applicant cannot be achieved by some method, feasible for the applicant to pursue, other than an area variance. The applicant could build a swimming pool located in the side yard in order to meet the code required minimum 100 foot setback from the top of the bluff, or in a code conforming front yard if the sanitary system is not located there. However, the proposed 76 -foot bluff setback is the minimum distance from the bluff that is practical to allow the pool to be placed in the code permitted rear yard. 3. Town Law &267-b(3)(b)(3). The variance as Amended granted herein is mathematically substantial, representing 24% relief from the code. Additionally, the relocation of the swimming pool partially located in the side yard is mathematically substantial representing 100% relief from the code. However, the house is exists and the applicant is proposing the minimum practicable bluff setback while constructing the pool in the code conforming rear yard. 4. Town Law §267-b(3)(b)(4). Comments received from the LWRP coordinator suggest that a variance in this residential community may have adverse impacts on the physical or environmental conditions in the neighborhood. The coastal area may be adversely affected by structures that are located in close proximity. The applicant has attempted to mitigate any possible impacts by increasing the top of bluff setback to 76 feet. The applicant must comply with Chapter 236 of the Town's Storm Water Management Code. 5. Town Law &267-b(3)(b)(5). The difficulty has been self-created. The applicant purchased the parcel after the Zoning Code was in effect and it is presumed that the applicant had actual or constructive knowledge of the limitations on the use of the parcel under the Zoning Code in effect prior to or at the time of purchase. 6. Town Law &267-b. Grant of relief As Amended is the minimum action necessary and adequate to enable the applicant to enjoy the benefit of a swimming pool while preserving and protecting the character of the neighborhood and the health, safety and welfare of the community. RESOLUTION OF THE BOARD: In considering all of the above factors and applying the balancing test under New York Town Law 267-13, motion was offered by Member Dantes, seconded by Member Weisman (Chairperson), and duly carried, to GRANT RELIEF AS AMENDED as follows for a swimming pool located 76 feet from the top of the bluff and shown on the survey prepared by Howard W. Young, L.L.S. last revised February 6, 2020. SUBJECT TO THE FOLLOWING CONDITIONS: 1. The applicant must comply with Chapter 236 of the Town's Storm Water Management Code. 2. Pool mechanicals shall be placed in a sound deadening enclosure. 3. A Drywell for pool de -watering shall be installed. 4. Approval from the Board of Town Trustees is required. 5. The applicant must adhere to the recommendations made by the Suffolk County Soil and Water Conservation District as cited herein. Page 4, February 20, 2020 #7364, Basios SCTM No. 1000-94-1-12.2 That the above conditions be written into the Building Inspector's Certificate of Occupancy, when issued. Any deviation from the survey, site plan and/or architectural drawings cited in this decision will result in delays and/or a possible denial by the Building Department of a building permit, and may require a new application and public hearing before the Zoning Board of Appeals. Any deviation from the variance(s) granted AS AMENDED herein as shown on the architectural drawings, site plan and/or survey cited above, such as alterations, extensions, or demolitions, are not authorized under this application when involving nonconformities under the zoning code. This action does not authorize or condone any current or future use, setback or other feature of the subject property that may violate the Zoning Code, other than such uses, setbacks and other features as are expressly addressed in this action. In the event that this is an approval subject to conditions, the approval shall not be deemed effective until such time that the foregoing conditions are met; and failure to comply therewith will render this approval null and void. The Board reserves the right to substitute a similar design that is de minimis in nature for an alteration that does not increase the degree of nonconformity. The evaluation was done in response to the homeowner's appeal to the Zoning Board of the Town of Southold. The notice of disapproval from the Zoning Board initially denied the permit to install a 50 foot by 30 foot swimming pool in the backyard, due to the fact that the edge of the pool sits 76 feet away from the bluff edge, encroaching within the 100 foot limit set forth by Article XXII Section 280-166A: "All buildings or structures located on lots upon which there exists a bluff landward of the shore or beach shall be set back not fewer than 100 feet from the top of such bluff." During the inventory and evaluation, the property and the bluff face were surveyed in its entirety to determine the erodability, and overall health of the surrounding landscape. The house sits within 120 feet of the bluff edge at its closest point. The backyard has turf ground cover and shrubbery vegetating the perimeter of the property, as well as the bluff edge. The residence is outfitted with downspouts that direct rainfall from the roof to underground drainage wells. Office Hours: Monday through Thursday 7:30 a.m. to 4:00 p.m. Friday 7:30 a.m. through 3:00 p.m. Irrigation heads are located throughout the property, in both the front and backyard, and including the bluffs top. It is important to monitor irrigation to ensure stability of the bluff face. Overwatering an area could lead to oversaturation of soil and increase the risk of runoff occurring, especially in storm events. The location of the irrigation heads to the bluff face is also of concern. Irrigation installed within 10 feet of the bluff edge decreases ground stability. This is due to the initial installation of plumbing disturbing the ground. Furthermore, a leak or blowout in the line could result in an erosion event. The best way to preserve the stability of the bluff face is to emphasize regular maintenance on the irrigation system Above ground sprinkler heads The face of the bluff has a considerable amount of vegetative cover directly behind the property as well as the neighboring properties. The area of coverage encompassed 80% and above of the bluff face. Certain areas of the bluff have been compacted and show signs of a trail. These trails, in conjunction with hoof prints and extensive browsing of shrubbery on the property, indicate the presence of deer. 2 Deer Trail Located on the Bluff Face Vegetation on the bluff is comprised of at least 50% percent of invasive species, Phragmites and Garlic Mustard are two invasive species that could be identified. Because many of the plants lay dormant at the time of the site visit, a full inventory of invasives could not be identified. It is not recommended to remove any vegetation from the bluff face, which would risk destabilizing the bluff further. Even though the bluff is well vegetated, it does not have the recommended angle of repose (3:1) but a much steeper -- n event. 44 (t � \ 4 Phragmites stand occupying both sides of bluff stairs 3 The toe of the bluff is supported by a bulkhead that is in functioning order. The bulkheading running along the neighbor's properties are also in good condition, indicating a stable toe. It is essential for the health of the bulkhead, and the stability of the bluff, to perform regular maintenance on the structure. The bulkhead should be examined after every storm event to minimize the chance of bluff instability. Installation of a pool is a ground disturbing activity, and could potentially lead to factors that contribute to destabilizing the bluff. It is important to use caution during any type of construction in close proximity to the bluff. Compaction from heavy machinery should be minimized by creating and utilizing necessary paths to enter, work, and exit the property. Areas that have experienced disturbance of vegetation should be revegetated with plant species native to the ecology. Practices that Encourage Bluff Stability: • Closely monitor irrigation on the property. It is important to routinely check the system's water pressure for leaks, and to make sure that the area is not being irrigated when it is unnecessary to do so. This should be done by a qualified individual. • Water runoff is a major contributor to bluff destabilization. Impervious surfaces and lack of vegetative ground cover encourage the formation of rills and gullies in the landscape, eroding soil away as they develop. Vegetate bare soil with native species to mitigate the effects of runoff. • Use of heavy machinery can affect the stability of soils. Soils risk structural damage near the bluff from the vibration of running equipment, machinery should not be left to idle. Heavy machinery compacts soil increasing the chance of surface runoff on the property. Compaction can be minimized by using the same route to enter and exit the property. Unnecessary areas of compaction will be avoided. Equipment should not be stored near critical areas of bluffs or near any unstable soils. • Any ground disturbing activity has an impact on soil stability. Bare pieces of ground should be revegetated as soon as possible. Based upon the information provided on the LWRP Consistency Assessment Form submitted to this department, as well as the records available to me, the proposal is recommended as INCONSISTENT with the below LWRP policies. Policy 1 Foster a pattern of development in the Town of Southold that enhances community character, preserves open space, makes efficient use of infrastructure, makes beneficial use of a coastal location, and minimizes adverse effects of development. The proposed location of the pool does not minimize adverse effects of development by proposing to decrease the pool setback to the top -of -bluff from the required 100' to 45'. The Long Island Sound bluff systems within this area traditionally unstable and experience periods of normal and accelerated erosion. Note that this property has experienced slope failure of the bluff in 2006/2007. The Board of Trustees issues a Wetland and Coastal Erosion Hazard permit (No 6351) to restore the bluff and stabilize the toe by armoring. The proposal is not supported and does not meet this policy. There is room on the property to locate the pool near the house thereby increasing the setback to the top -of -bluff. This would require the relocating the well. It is recommended that the pool is redesigned /relocated to meet this policy. Policy 4 Minimize loss of life, structures, and natural resources from flooding and erosion. The proposed pool and patio is located just south of the coastal erosion hazard line which marks the landward limit of the coastal erosion hazard area. The coastal erosion hazard area was established to' regulate areas within the Town of Southold based upon shoreline recession rates or the location of natural protective features. It is not a limit of possible erosion. Chapter 275 Wetlands and Shorelines administered by the Southold Town Board of Trustees requires a setback of 50' from a pool and related structures to,a top -of -bluff. The proposed pool is proposed to be located 45' from the natural feature. It is recommended that the Board require that the applicant meet or exceed Chapter 275 Wetland and Shorelines requirements. This policy does not support the construction of structures (pools) within areas subject to the risk of erosion overtime or during major storm events (Hurricanes) and potential loss. Properties that are protected by hardened structures such as bulkheads and revetments still experience loss and damage (file record). Policy 4.1 A. recommends that to minimize potential loss and damage; structures should be located as far from erosion hazards as possible. The proposed action does not meet this policy and an increase in the setback by moving the pool to the south is possible. It is recommended that the pool is redesigned/relocated to achieve the greatest setback from the top -of -bluff. Policy 6.3 Protect and restore tidal and freshwater wetlands. Development on or near bluff ecosystems has resulted in loss and impairments to these and other dependent natural features (beaches) and their functions; cumulatively impacting the Town of Southold's ecosystem. Setbacks are required to help mitigate the direct and indirect adverse impacts from development. The proposed action does not meet this policy. It is'recommended that the pool is redesigned/relocated to achieve the greatest setback from the top -of -bluff. In the event the action is approved a pool de -watering well is recommended. Pursuant to Chapter 268, the Southold Town Zoning Board of Appeals shall consider this recommendation in preparing its written determination regarding the consistency of the proposed action.
