SUFFOLK COUNTY ADMINISTRATIVE CODE: This application was referred as required under the Suffolk County Administrative Code Sections A 14-14 to 23, and the Suffolk County Department of Planning issued its reply dated May 3, 2019 stating that this application is considered a matter for local determination as there appears to be no significant county -wide or inter -community impact. LWRP DETERMINATION: The relief, permit, or interpretation requested in this application is listed under the Minor Actions exempt list and is not subject to review under Chapter 268. PROPERTY FACTS/DESCRIPTION: The subject property is a non -conforming 13,685 square foot parcel located in an R-40 Zoning District. The parcel measures 85.00 feet along Hippodrome Drive on the South Side, measures 161.00 feet on the West side, measures 85.00 feet on the North side and measures 161.00 feet on the East side. The parcel is improved with a two-story frame dwelling, a frame shed, an in -ground swimming pool, a masonry patio, and an outdoor shower. All is shown on a survey prepared by Harold F. Tranchon, L.L.S. dated September 4, 2018 BASIS OF APPLICATION: Request for Variances from Sections 280-15; Article XXIII; Section 280-124; and the Building Inspector's March 22, 2019, Notice of Disapproval based on an application to legalize an "as -built" accessory swimming pool and an "as -built" accessory shed; at 1) accessory shed located less than the code required side yard setback of 5 feet; 2) accessory shed at less than code required rear yard setback of 5 feet; 3) "as -built" construction is more than the code permitted maximum lot coverage of 20%; located at 230 Hippodrome Drive, Southold, NY SCTM # 1000-66-2-25. RELIEF REQUESTED: The applicant requests a variance to legalize an "as -built" swimming pool and an "as - built" shed both built without building permits. The "as -built" swimming pool and shed resulted in lot coverage of 25.9% where Town Code allows maximum lot coverage of 20%. In addition, the "as -built" shed has a side yard and rear yard setback of 3 feet where code requires a minimum side yard and rear yard setback of 5 feet. Page 2, February 20, 2020 #7309, Yedid SCTM No. 1000-66-2-25 AMENDED APPLICATION: During the hearing, the applicant was asked to bring the plan into more conformity with the Town code. The applicant on February 6, 2020 submitted a site plan prepared by Mark Schwartz Architect, dated February 4, 2020 depicting the removal of the "as -built" shed, thereby eliminating the required variances for non -conforming setbacks and reducing the non -conforming lot coverage from 25.9% to 24.5%. The site plan also shows that the existing septic tank in the rear yard is closer than the minimum distance permitted by the Suffolk County Health Department. In order to maintain the as built pool, the applicant's representative explained that the Suffolk County Health Department will require the applicant to abandon that system and to install an I/A Innovative Advanced septic treatment system in the front yard, which the agent asserted was a " persuasive environmental benefit" for in favor of granting relief for the as built pool that exceeds the code permitted maximum lot coverage in a neighborhood where no other prior ZBA for excessive lot coverage could be found. ADDITIONAL INFORMATION: At the public hearing of September 12, 2018, the applicant's agent testified that he submitted plans written on an old survey to the Building Department showing a swimming pool to be built on his client's property. After submitting the plans, the Building Department advised the applicant's agent that the plans submitted were based on an outdated survey that does not accurately depict the size of the structures on the property. Using a new version of the survey that the Building Department had on file, the applicant's agent was advised that the largest code permitted pool he may build on the subject property is 200 square feet. The applicant testified at the hearing that he knew that a building permit had not been issued for the swimming pool when pool construction began. As an attempt to comply with the Board's request to bring the plan into more conformity, the applicant removed a section of the "as built" shed walls, leaving the roof intact, wrongly assuming that this would create code conforming setbacks for the shed, and submitted a photograph of the modified shed during the October 10, 2019 public hearing. During that same public hearing, the applicant, after researching comparable variances in the area, testified that pools were a common accessory structure in the Breixidon Estates neighborhood. However, he was not able to find any parcels that had received prior ZBA variance relief for lot coverage that exceeded the code permitted maximum. FINDINGS OF FACT/ REASONS FOR BOARD ACTION: The Zoning Board of Appeals held a public hearing on this application on September 12, 2019, October 10, 2019 and February 6, 2020 at which time written and oral evidence were presented. Based upon all testimony, documentation, personal inspection of the property and surrounding neighborhood, and other evidence, the Zoning Board finds the following facts to be true and relevant and makes the following findings: 1. Town Law V67-1b(3)(b)(1). Grant of the variance will produce an undesirable change in the character of the neighborhood or a detriment to nearby properties. The neighborhood of Breixodon Estates is an older neighborhood consisting of modest single-family homes on smaller lots. The construction and subsequent renovations to the applicant's dwelling only resulted in 18.4% lot coverage according to the site plan prepared by Mark Schwartz, Architect dated February 4, 2020. Lots developed with greater than the code permitted lot coverage are not characteristic of this neighborhood. 2. Town Law §267-b(3)(b)(2). The benefit sought by the applicant cannot be achieved by some method, feasible for the applicant to pursue, other than an area variance. The applicant's existing home covered 18.4% of the code permitted lot coverage. The "as -built" swimming pool constructed without permits increased the property's lot coverage to 24.5% and the "as -built" shed increased the property's total lot coverage to 25.9%. However, the applicant could have applied for a building permit to build a smaller pool and shed that met the maximum code conforming lot coverage rather than building the swimming pool and shed without permits. 3. Town Law X267-b(3)(b)(3). The variance for relief as amended and denied herein is mathematically substantial, representing 22.5% relief from the code for exceeding permitted lot coverage. Evidence has been submitted to suggest that a variance in this residential community will have an adverse impact on the physical or environmental conditions in the neighborhood. The existing septic system is closer to the pool than is permitted by the Suffolk County Department of Health Sanitary Code. Prior to the installation of the pool, the sanitary system was conforming. In order to maintain the as built pool the Suffolk County Health Department will require the applicant to abandon the existing sanitary system and to mitigate the adverse environmental impacts by installing an UA Innovative Advanced septic system at a code conforming distance from the "as -built" pool in the front yard of the subject property. 5. Town Law 4267-b(3)(b)(5). The difficulty has been self-created. The applicant testified that prior to constructing the pool, he was advised by the Building Department that the proposed pool would exceed the code permitted 20% maximum buildable lot coverage, and that he would need a variance relief in order to build the pool. The applicant further testified that rather than submit an application for variance relief, he built the pool without any permit, knowing that it was not permitted by Town Code. 6. Town Law §267-b. Grant of the relief as amended IS NOT the minimum action necessary to enable the applicant to enjoy the benefit of a swimming pool and shed while preserving and protecting the character of the neighborhood and the health, safety and welfare of the community. Prior to building the pool without a permit, the applicant should have applied to the Building Department to construct a swimming pool and shed resulting in either a conforming lot coverage with confirming setbacks for the shed, or at the minimum, a more conforming lot coverage then the percentage of variance relief requested herein from this Board. RESOLUTION OF THE BOARD: In considering all of the above factors and applying the balancing test under New York Town Law 267-B, motion was offered by Member Dantes, seconded by Member Lehnert, and duly carried, to DENY as applied for. A survey by John C. Ehlers dated October 17, 2000 shows a two-story house with an one-story segment on the westerly side and a raised wooden patio/deck. The house is 45.8 feet from Orchard Road and 35.4 feet from Arshamomaque Road. BASIS OF APPLICATION: Building Inspector's March 9, 2001 Notice of Disapproval which states that under Article XXIV, Section 100-244B the proposed construction will have setbacks at less than 35 feet from the front property line, less than 10 feet from the side property line, less than 35 feet from the rear property line, and lot coverage for total building area in excess of the 20% code limitation. AREA VARIANCE RELIEF REQUESTED: Applicant originally requested variances to locate: (a) proposed 7 x 10 ft. entry foyer at the east side of the dwelling, leaving a front yard setback at 30 feet, (b) proposed deck, steps and shower structure at the west side of the house, leaving 5.3 and 5.5 feet at its closest points to the westerly property line, (c) 13' x 45', plus 5' x 10' deck and shower area which will be five feet from the rear property line. The original request was for a lot coverage of 22.10%. Subsequently, the application request was amended to eliminate the variance request for lot coverage as shown on the survey amended May 17, 2001, prepared by John C. Ehlers, L.S. In the amendment, the deck was reduced to an approximately size of 13 x 25', plus18.4 x 5.5 step area, all at the southwest comer of the house. The front 7x10 ft. entrance foyer remains the same. The addition of the pool and the lot coverage will not produce a change in the character of the neighborhood. Our home is an attractive 4 -bedroom home with a circular drive with substantial curb appeal; the pool and backyard are fully enclosed with a 6 -foot high vinyl solid white fence and therefore is not visible to the street or our neighbors. Several neighbors in Beixedon Estates have complimented us on the pool and tasteful landscaping installed around the pool. They view is as a positive for the neighborhood. b. Moreover, in the research I performed at the request of Board members from our September 12"' hearing, there are 9 pools installed along the homes along four major streets in Beixedon Estates - Hippodrome Drive, Arshamomoque Ave., Rodgers Rd., and Orchard Rd. Many homes do not have pools as they face the creek (9 homes), thereby providing water access and docks, or face the Peconic River (5 homes). Moreover, the density of pools in Beixedon Estates appears greater than in other Southold neighborhoods south of the Main Road based on a detailed examination using Google maps (satellite view), such as Old Shipyard Lane, Town Harbor Lane and Thomas St., as well as in areas such as August Lane and Kerwin Blvd. 2. The benefit sought by the applicant CANNOT be achieved by some method feasible for the applicant for the to pursue, other than an area variance, because: a. We were not aware when we purchased the house that it was on a non -conforming lot. Under the Town Building Code, our lot size of 13,500 feet only permits 20% lot coverage. The house and existing shed already provide almost 19% lot coverage; therefore, it would be impossible to add the pool without an area variance. b. In order to ameliorate the size of the variance needed we have performed the following work at our substantial expense: i. The shed has been reduced in size from 10x12' to 10x10' and has been moved in order to provide a 5 -foot clearance from both the back and right hand side of the property lines. G'1 1�� ii. Anew dry well was installed on October 2, 2019 by Long Island Pool Care in order to provide for drainage from bi-weekly backwashing of the pool filter system and for pool drainage prior to closing the pool for the season. 3. The amount of relief is not substantial because: a. The pool, which has been installed by a reliable and local Southold pool builder/maintenance company, is not visible to my neighbors and therefore does not impose any hardship on them. As noted above, the pool and backyard are fully enclosed with a 6 -foot high vinyl solid white fence. b. The application seeks only to install an in -ground swimming pool which is in keeping with modern practices and which will have no effect of any kind on the neighboring properties. Notwithstanding the percentage of deviation from the permitted lot coverage, there is nothing about the placement of the swimming pool that will cause any adverse effect on any neighboring property. Our property, many of the surrounding properties, is heavily screened and substantially separated from its neighbors. The addition of the swimming pool will both conform to what exists in the neighborhood and add value to the property. 4. The variance will NOT have an adverse effect or impact on the physical or environmental conditions in the neighborhood or district because: a. This is a self-contained swimming pool, with a newly installed pump, filtration system, and automated cleaning system (Polaris) for leaf collection. b. In doing the construction of the pool, we added new dry wells in the spring of 2018 and another one this month. c. The pool and recently added dry well meets the Town's requirements for swi nming pools. Accordingly, the proposed variance will not have an adverse physical or environmental impact. 5. Has the alleged difficulty been self-created? While we certainly did not intend to violate the Town's Building Code, at the time that we bought the house we were unaware of the lot coverage regulations and how they would affect our ability to improve the property. Research by the real estate attorney that represented my wife and I in the purchase of our home, found that cases where it is determined that the alleged difficulty was self-created generally involve an applicant who has purchased an unimproved substandard lot and then seeks to develop it by constructing a structure that he knew or should have known was prohibited by the existing zoning laws. In this case, although we purchased an existing structure on a substandard lot and are imputed with the knowledge of the applicable zoning laws, we seek to enhance the property in such a way as to make it a more natural fit which does not rise to the level of a self-created hardship; however, even if the board were to find KA 1 these facts to constitute a self-created hardship, it would not be fatal to the granting of an area variance because, as has already been shown, the impact upon the community will be negligible, and the swimming pool is consistent with many of the e-'Usting structures in the neighborhood. Case law has held that actual knowledge of a zoning restriction prior to the consummation of a purchase contract, while a self-created hardship, does not bar the granting of an area variance. The courts have minimized the significance of self-created hardship in balancing the relevant factors where no valid public purpose would be served by denying the area variance requested.
