RECIPROCAL DRIVEWAY EASEMENT
Agreement made the 20" day of December 2019, between
1470 JACKSON STLLC., 68 Jane Street #22E,New York, NY 10014 hereinafter
referred to as "1470 JACKSON"And,
JOHN W. BELLANDO and ELLEN BELLANDO, having an address of 1370 Jackson
Street, New Suffolk, NY 11956 hereinafter referred to as "BELLANDO."
WHEREAS, 1470 JACKSON is the owner of the land more particularly described in
Schedule A, known by the street address of 1470 Jackson Street, New Suffolk, NY 11956 and
BELANDO is the owner of land more particularly described in Schedule B known by the street
address of 1370 Jackson Avenue,New Suffolk, NY 11956, AND,
WHEREAS the parcels are contiguous,adjoining,and have a common boundary line,AND
WHEREAS, the parties desire to create a reciprocal driveway casement for automobiles,
for their use in common, the parties hereby agree to the follow:
1. The owners of the Parcels, their guests and invitees, are hereby granted an easement
for the purposes of ingress and egress, in common with others over the common driveway shown
on the survey prepared by John Minta, L.S. and dated October 22, 2019 which survey is attached
hereto and made a part hereof as Schedule C. This easement shall run to the benefit of the owners
of each of Parcel A and Parcel B. It is intended that the easement herein granted and the obligations
herein incurred shall be binding upon the owners of Parcel A and Parcel B, their successors and
assigns, and it shall run with the land.
2. Each of the owners of Parcel A and Parcel B shall jointly maintain the common driveway
and shall make such repairs and replacements as are reasonable and appropriate and shall equally
share the cost and expense("co-maintenance charges").The co-maintenance charges are to be paid
as and when incurred and shall be divided equally by the owners of Parcel A and Parcel B, their
successors or assigns. On the date the costs are incurred, one-half of the costs shall become a lien
upon each Parcel and such lien shall continue until fully paid. The owners of the Parcels may
enforce this lien against each other. 1f the common driveway is not kept clear of snow, ice and/or
other impediments to traffic flow and/or not properly kept, maintained and repaired,the owners of
the Parcels shall each have the right and obligation to enter upon the common driveway for the
purposes of maintaining, repairing and keeping the same clear of snow and ice and/or other
impediments to traffic flow and to charge the one-half of the cost thereof to the owner of the other
Parcel. The owners of the Parcels hereby covenant and agree that they will not obstruct the
common driveway, nor interfere with the use of the common driveway by the other, nor prevent
ingress and egress of persons and motor vehicles over the common driveway. It is further agreed
that no area of the common driveway shall be used for the extended parking of any trucks, or vans,
nor for the storage of boats or recreational vehicles. The owners of the Parcels shall indemnify
and hold each other harmless, and their successors or assigns, from and against all liability and
costs (including reasonable attorneys' fees) for personal injury or property damage directly
resulting from the use by each other of the common driveway.
This easement agreement shall inure to the benefit of the respective parties, their heirs,
successors, grantees and assigns, and shall constitute an agreement running with the land.

SCHEDULE A DESCRIPTION
ALL that certain plot, piece or parcel of land, with the buildings and improvements thereon
erected, situate, lying and being in the Village of New Suffolk, Town of Southold, County of
Suffolk and State of New York, more particularly bounded and described as follows:
BEGINNING at a point on the southerly side of Jackson Street, distant 231.57 feet westerly
from the corner formed by the intersection of the southerly side of Jackson Street with the
westerly side of Fifth Street;
RUNNING THENCE South 6 degrees 08 minutes 20 seconds West 421 feet to the ordinary
high water mark of Great Peconic Bay as it existed and as shown on a survey by Van Tuyl
and Son, Licensed Land Surveyors, dated May 24, 1957, and continuing along said course
for a total of 449.26 feet to the ordinary high water mark of Great Peconic Bay as of
10/2212019;
