- ' ABANDONMENT AND REPLACEMENT OF RIGHT OF WAY
ROBERT LEONE and ELLEN LEONE being the sole owners of premises
commonly know as 5610 Main Bayview Road, Southold, New York bearing SCTM
#1000-078.00-04.00-039.000, hereinafter referred to as the "Leone parcel" and NORTH
EASTWOOD PROPERTIES, LLC being the sole owner of premises commonly known
as 5532 Main Bayview Road, Southold, New York bearing SCTM #1000-078.00-04.00-
040.000, hereinafter referred to as the NORTH EASTWOOD parcel" hereby intend to
abandon a certain 15 foot Right of Way extending along the northwesterly line of the
Leone parcel and replacing it with a 15 foot Right of Way extending along the
southeasterly line of the Leone parcel as depicted on the survey attached hereto as Exhibit
A;
NOW, THEREFORE, the parties hereto agree in consideration of One ($1.00)
Dollar and other good and valuable consideration, the receipt of which is hereby
acknowledged, NORTH EASTWOOD PROPERTIES, LLC hereby abandons and
releases to ROBERT LEONE and ELLEN LEONE the 15 foot Right of Way running
along the northwesterly line of the Leone parcel as recited in Liber 12648 Page 595 and
ROBERT LEONE and ELLEN LEONE hereby grant a replacement 15 foot Right of
Way over a strip of land 15 feet in width extending along the southeasterly line of the
land of ROBERT LEONE and ELLEN LEONE from the northeasterly corner of the
Leone parcel from the southerly side of Main Bayview Road and RUNNING THENCE
South 41 degrees 52 minutes 50 seconds West a distance of 304.03 feet to the NORTH
EASTWOOD parcel for the purpose of ingress and egress to and from the NORTH
EASTWOOD parcel and to and from Main Bayview Road and also for the purpose of
installation, maintenance, repair and replacement of public utility lines, pipes, wires and
conduits below the surface, above the surface and on the surface of said right of way in
such manner so as not to interfere with the surface travel over the same.
