Existing non-native and invasive vegetation proposed to be removed from this area include(Wisteria sp.,Mile-a-minute weed(Persicaria perfoliata),Poison Ivy(Toxicodendron radicans),Plume 1a y Grass(Saccharum sp.),and Bittersweet(Celastrus orbiculatus). All vegetation removal and disturbance associated with proposed lawn conversion shall occur landward of the non-disturbance zone. Proposed Eastern Red Cedar: ati The applicant proposes to plant an approximate 170' row of Eastern Red Cedar(Juniperus virginiana)along the V", southern property boundary to provide additional privacy for the residence. Approximately 28 Eastern Red Cedar N is are proposed,which are to be planted 6' on center,5' in height. The trees shall be B&B grown stock,and all work to be completed by hand. Any excess soil from planting holes will be removed from the non-disturbance zone,and no removal of native vegetation will occur within the non-disturbance zone. Installation of Eastern Red Cedar shall occur on the applicant's side of the existing fence line during the planting season,the proposed row of Eastern Red Cedar shall extend seaward to match the eastern limit of the neighboring residence to the south; and as depicted on the site plan prepared by Land Use Ecological Services,Inc.,last dated December 19,2019,and stamped approved on January 15,2020. ME , i TERMS AND CONDITIONS The Permittee Rosaria Forchelli,residing at 1635 Meadow Beach Lane,Mattituck, New York as part of the consideration for the issuance of the Permit does understand and prescribe to the following: 1. That the said Board of Trustees and the Town of Southold are released from any and all damages, or claims for damages, of suits arising directly or indirectly as a result of any operation performed pursuant to this permit, and the said Permittee will, at his or her own expense, defend any and all such suits initiated by third parties, and the said Permittee assumes full liability with respect thereto,to the complete exclusion of the Board of Trustees of the Town of Southold. 2. That this Permit is valid for a period of 24 months,which is considered to be the estimated time required to complete the work involved, but should circumstances warrant, request for an extension may be made to the Board at a later date. 3. That this Permit should be retained indefinitely, or as long as the said Permittee wishes to maintain the structure or project involved,to provide evidence to anyone concerned that authorization was originally obtained. 4. That the work involved will be subject to the inspection and approval of the Board or its agents, and non-compliance with the provisions of the originating application may be cause for revocation of this Permit by resolution of the said Board. 5. That there will be no unreasonable interference with navigation as a result of the work herein authorized. 6. That there shall be no interference with the right of the public to pass and repass along the beach between high and low water marks. 7. That if future operations of the Town of Southold require the removal and/or alterations in the location of the work herein authorized, or if, in the opinion of the Board of Trustees, the work shall cause unreasonable obstruction to free navigation,the said Permittee will be required, upon due notice, to remove or alter this work project herein stated without expenses to the Town of Southold. 8. That the said Board will be notified by the Permittee of the completion of the work authorized. 9. That the Permittee will obtain all other permits and consents that may be required supplemental to this permit,which may be subject to revoke upon failure to obtain same. 10. No right to trespass or interfere with riparian rights. This permit does not convey to the permittee any right to trespass upon the lands or interfere with the riparian rights of others in order to perform the permitted work nor does it authorize the impairment of any rights, title, or interest in real or personal property held or vested in a person not a party to the permit. WHEREAS, the structure complies with the standards set forth in Chapter 275 of the Southold Town Code, WHEREAS, the Board has determined that the project as proposed will not affect the health, safety and general welfare of the people of the town, NOW THEREFORE BE IT, RESOLVED, that the Board of Trustees approve the application of ROSARIA FORCHELLI to convert a vegetated area of approximately 4,300sq.ft. to lawn, and also to plant a row of Eastern Red Cedar (Juniperus virginiana) along the southern property boundary. An area of approximately 9,673 sq. ft. along the eastern side of the property, bordering Hall's Creek, is currently dominated by Phragmites australis. An upland buffer area of approximately 9,250 sq. ft. lies adjacent to the Phragmites marsh to the west, and is similarly dominated with various invasive vegetative species. The applicant seeks to manage this dense Phragmites stand on the shoreline of the property, as well as the upland vegetated area, as shown on the enclosed Phragmites and Vegetation Management Plan. The goal of the Phragmites and Vegetation Management Plan is to remove the dense monoculture of invasive Phragmites via cutting, and to promote the growth of native plant populations along the shoreline to improve habitat quality. Invasive and non-native vegetation within the upland area shall also be removed, with disturbed areas being re-seeded with native Switchgrass (Paniczcm virgatum). The Neiv York State Salt Marsh Restoration and Monitoring Guidelines (2000) states "[o]nce established, Phragmites shades existing vegetation and hinders the germination and growth of other species. Phragmites stands are also thought to provide inferior nesting habitat for many marsh birds (Howe et al., 1978), including seaside sparrow, sharp-tailed sparrow, and willet. These marsh specialists are adapted to nesting in short grasses like Spartina patens and Distichlis spicata (Benoit, 1997). The slower degradation rate of Phragmites stalks can also raise the elevation of the marsh, thereby decreasing the area that can be flooded with salt water by tidal flow and further promoting Phragmites australis invasion(T. Diers). Stands of Phragmites, growing up to 14 feet in height, are often considered to negatively impact the "viewshed" in an area(Tiner, 1987; Eastman, 1995)." Phragmites Management Methodology and Reporting The following are the procedures and specifications of the proposed Phragmites Management Plan. The work must be supervised by a qualified ecologist and will be completed when water levels are low. Year 1: In the early spring (March — April) Phragmites will be cut to 6" above ground level, and not lower. All cut material and thatch shall be hand-raked and disposed of at an approved off-site landfill. Cutting shall be performed using commercial hedge trimmers, weed whacker, and hand pruners. Cutting shall be monitored by a qualified ecologist to ensure that no native herbaceous plants or woody shrubs are removed. Phragmites shoots will be re-cut again in early June. Phragmites will be re-cut to a height of 18-24" above soil level. This cutting height will serve to avoid cutting native vegetation. One additional cutting will occur as needed during the growing season (April — October). Cutting will only occur when there is substantial height difference between Phragmites and native vegetation to allow for cutting of Phragmites without damage to native vegetation. Please see attached Project Description for details. - Forchelli-Mattituck 1635 Meadow Beach Lane,Mattituck,NY 119521 SCTM#1000-116-7-8 Project Description The proposed project is located on a 1.15-acre residential property at 1635 Meadow Beach Lane in Mattituck, New York. An area of approximately 9,673 sq. ft. along•the eastern side of the property, bordering Hall's Creek, is currently dominated by Phragmites australis. An upland buffer area of approximately 9,250 sq. ft. lies adjacent to the Phragmites marsh to the west, and is similarly dominated with various invasive vegetative species. The applicant seeks to manage this dense Phragmites stand on the shoreline of the property, as well as the upland vegetated area, as shown on the enclosed Phragmites and Vegetation Management Plan. The goal of the Phragmites and Vegetation Management Plan is to remove the dense monoculture of invasive Phragmites via cutting, and. to promote ,the growth of native plant populations along the shoreline to improve habitat quality. Invasive and non-native vegetation within the upland area shall also be removed, with disturbed areas being.re-seeded with native Switchgrass (Panicum virgatum). The New .York State, Salt Marsh Restoration and Monitoring Guidelines (2000) states "[o]nce established, Phragmites shades existing vegetation and hinders the germination and growth of,other, species., Phragmites, stands Are,also thought-to provide inferior, nesting habitat for many marsh-birds (Howe et al., 1978), including seaside sparrow, sharp-tailed sparrow,,and willet.,These marsh specialists are adapted to nesting in short grasses like Spartina patens and Distichlis spicata;(Benoit, 1997). The slower degradation rate of Phragmites stalks can also raise the elevation of the marsh, thereby decreasing the,area that can be;flooded;with salt water by tidal flow and further:promoting,Phragmites, australis invasion(T:Diers). Stands of Phragmites, growing up to 14 feetin height, are often considered. to negatively impact the,"uiewshed'•' in an area(Tiner, 1987; )Eastman, 1995)." Phragmites Management Methodology and Reporting The following are the procedures and specifications of the proposed Phragmites Management Plan. The work must be supervised by a qualified ecologist and will be completed when water levels are low. Year 1: In the early spring (March—April) Phragmites will be cut to ground level approximately 3" in height and not lower. All out material and thatch shall be hand-raked and removed. Cutting shall be performed using commercial hedge trimmers, weed whacker, and hand pruners. Cutting shall be monitored by a qualified ecologist to ensure that no native herbaceous plants or woody shrubs are removed. Phragmites shoots will be re-cut again in early June. If there is substantial growth of native vegetation,Phragmites will be cut to a height of 18-24" above soil level. This greater cutting height will serve to avoid cutting native vegetation. If there is minimal growth of native plants, Phragmites will again be cut to 3" above soil level. One additional cutting will occur as needed during the growing season (April — October). Cutting will only occur when there is substantial height difference between Phragmites and native vegetation to allow for cutting of Phragmites without damage to native vegetation. Prior to every cutting, the management area will be inspected by a qualified ecologist to determine an appropriate cutting height to avoid disturbance to native vegetation and to identify and flag any vegetation which shall be avoided. IN THE TOWN HALL MEETING HALL PROJECT DESCRIPTION FOR: Land Use Ecological Services, Inc. on behalf of ROSARIA FORCHELLI LOCATED: 1635 Meadow Beach Lane, Mattituck SCTM## 1000-116-7-8 For a Wetland Permit for a Ten Year Maintenance Permit to cut the Phragmites to 6" above ground level (in March-April), and not lower in the first year; all cut material and thatch shall be hand-raked and disposed of at an approved off-site landfill; cutting shall be performed by hand and monitored by a qualified ecologist to ensure that no native herbaceous plants or woody shrubs are removed; Phragmites shoots will be re-cut again in early June to a height of 18'- 24" above soil level in order to avoid cutting native vegetation; one additional cutting will occur as needed to a height of 18" above ground level during the growing season (April — October); after the first year, up to two (2) cuttings per year to a minimum height of 18" (i.e. cut height shall not be shorter than 18"), with native vegetation to be identified and flagged to be protected; if new growth of invasive species is observed during on-going Phragmites monitoring, it will be immediately removed by hand; approximately 9,250sq.ft. of vegetated upland area shall be managed through removal of non-native and invasive species (Wisteria sp., Mile-a-minute weed (Persicaria perfoliata), Poison Ivy (Toxicodendron radicans), Plume Grass (Saccharum sp.), Bittersweet (Celastrus orbiculatus), with all existing native plants within the Vegetation Management Plan area to remain; any disturbed areas are to be seeded with Switchgrass (Panicum virgatum) at a rate of 20lbs/acre; and within a 100 linear foot long area along the southwest property boundary plant 17 Thuja sp. 6' o/c; five years of post-construction monitoring will occur during spring and fall seasons with progress reports on the Phragmites management and re- colonization of native plants, including representative photographs to be submitted by December 31 st of each of the five years.
