permission to the Mattituck Lions Club to use Strawberry Fields in Mattituck, NY from
June 18 through , June 21, 2020 for the Annual Strawberry Festival and be it.further
RESOLVED that the Town Board of the Town of Southold authorizes the Town Clerk to
issue a Special Events Permit to the Mattituck Lions to hold its Annual Strawberry
Festival at ,Strawberry Fields Mattituck, NY from June 18 through June 21, 2020
provided
1. They file with the Town Clerk a Two Million Dollar Certificate of Insurance
naming the Town of Southold and the County of Suffolk as an additional insured;
2. Coordinate traffic control upon notification of the adoption of this resolution with
Captain Kruszeski
3. No permanent markings be placed on town, county or state roads or property for
the event;
4. Any road markings or signs for the event be removed within twenty-four(24)
hours of the completion of the event.

Resolution Number 2020-023,of the Fishers Island Ferry District adopted February 3, 2020
which reads as follows:
WHEREAS the Fishers Island Ferry District policy as described in the Employee Handbook and
the CSEA Collective Bargaining Agreement grants a 3% longevity increase to wages when an
individual has been employed by the Fishers Island Ferry District for five years; and,
WHEREAS Christopher Newell has met that requirement. now therefore be it
RESOLVED that Mr. Newell's wages be increased from $28:00 to $28.84 per hour, effective
November 13, 2019.

ISLAND, STATING THE ESTIMATED MAXIMUM COST
THEREOF IS $150,000, APPROPRIATING SAID AMOUNT
FOR SUCH PURPOSE, AND AUTHORIZING THE ISSUANCE
OF BONDS IN THE PRINCIPAL AMOUNT OF $150,000 TO
FINANCE SAID APPROPRIATION
THE TOWN BOARD OF THE TOWN OF SOUTHOLD, IN THE COUNTY OF
SUFFOLK, NEW YORK, HEREBY RESOLVES (by the favorable vote of not less than two-
thirds of all the members of said Town Board) AS FOLLOWS:
Section 1. The Town of Southold, in the County of Suffolk, New York (herein
called the "Town"), is hereby authorized to construct a new highway barn on Fishers Island. The
estimated maximum cost thereof, including preliminary costs and costs incidental thereto and the
financing thereof, is $150,000 and said amount is hereby appropriated for such purpose. The
plan of financing includes the issuance of bonds in the principal amount of$150,000 to finance
said appropriation, and the levy and collection of taxes on all the taxable real property in the
Town to pay the principal of said bonds and the interest thereon as the same shall become due
and payable.
Section 2.' Bonds of the Town in the principal amount of $150,000 are hereby
authorized to be issued pursuant to the provisions of the Local Finance Law, constituting Chapter
33-a of the Consolidated Laws of the State of New York (herein called the "Law"), to finance
said appropriation.
Section 3. The following additional matters are hereby determined and declared:

(a) The period of probable usefulness applicable to the object or purpose for
which said bonds are authorized to be issued, within the limitations of Section 11.00 a."11 (c) of
the Law, is fifteen (15) years.
(b) The proceeds of the bonds herein authorized and any bond anticipation notes
issued in anticipation of said bonds may be applied to reimburse the Town for expenditures made
after the effective date of this resolution for the purposes for which said bonds are authorized.
The foregoing statement of intent with respect to reimbursement is made in conformity with
Treasury Regulation Section 1.150-2 of the United States Treasury Department.
(c) The proposed maturity of the bonds authorized by this resolution will exceed
five (5) years.
Section 4. Each of the bonds authorized by this resolution and any bond
anticipation notes issued in anticipation of the sale of said bonds shall contain the recital of
validity as prescribed by Section 52.00 of the Law and said bonds and any notes issued in
anticipation of said bonds shall be general obligations of the Town, payable as to both principal
and interest by general tax upon all the taxable real property within the Town. The faith and
credit of the Town are hereby irrevocably pledged to the punctual payment of the principal of
and interest on said bonds and any notes issued in anticipation of the sale of said bonds and
provision shall be made annually in the budget of the Town by appropriation for (a) the
amortization and redemption of the bonds and any notes in anticipation thereof to mature in such
year and (b)the payment of interest to be due and payable in such year.
Section 5. Subject to the provisions of this resolution and of the Law and
pursuant to the provisions of Section 21.00 of the Law relative to the authorization of bonds with
substantially level or declining annual debt service, Section 30.00 relative to the authorization of
the issuance of bond anticipation notes and Section 50.00 and Sections 56.00 to 60.00 and
Section 168.00 of the Law, the powers and duties of the Town Board relative to authorizing bond
anticipation notes and prescribing the terms, form and contents and as to the sale and issuance of
the bonds herein authorized, and of any bond anticipation notes issued in anticipation of said
bonds, and the renewals of said bond anticipation notes, and as to the execution of agreements
for credit enhancements, are hereby delegated to the Supervisor, the chief fiscal officer of the
Town.
Section 6. The validity of the bonds authorized by this resolution, and of any
notes issued in anticipation of the sale of said bonds, may be contested only if.
(a) such obligations are authorized for an object or purpose for which the
Town is not authorized to expend money, or
(b) the provisions of law which should be complied with at the date of
publication of such resolution, or a summary thereof, are not substantially
complied with,
and an action, suit or proceeding contesting such validity is commenced within twenty days after
the date of such publication, or
(c) such obligations are authorized in violation of the provisions of the
constitution.

Section 7. This bond resolution is subject to a permissive referendum and the
Deputy Town Clerk is hereby authorized and directed, within ten (10) days after the adoption of
this resolution, to cause to be published in "The Suffolk Times, " a newspaper having a general
circulation within said Town and hereby designated the official newspaper of the Town for such
publication and posted on the sign board of the Town maintained pursuant to the Town Law, a
Notice in substantially the following form:
TOWN OF SOUTHOLD,NEW YORK
PLEASE TAKE NOTICE that on February 11, 2020, the Town Board of the
Town of Southold, in the County of Suffolk,New York, adopted a bond resolution entitled:
"Bond Resolution of the Town of Southold, New York,

new highway barn on Fishers Island, stating the estimated

estimated maximum cost thereof, including preliminary costs and costs incidental thereto and the

said appropriation, and the levy and collection of taxes on all the taxable real property in the

(a) The period of probable usefulness applicable to the object or purpose for
which said bonds are authorized to be issued, within the limitations of Section 11.00 a. 28 of the
Law, is fifteen (15) years.
(b) The proceeds of the bonds herein authorized and any bond anticipation notes
issued in anticipation of said bonds may be applied to reimburse the Town for expenditures made

BOND RESOLUTION OF THE TOWN OF SOUTHOLD, NEW
YORK, ADOPTED FEBRUARY 11, 2020, AUTHORIZING THE
CONSTRUCTION OF DRAINAGE IMPROVEMENTS FOR
STORMWATER MITIGATION, STATING THE ESTIMATED
MAXIMUM COST THEREOF IS $250,000, APPROPRIATING
SAID AMOUNT FOR SUCH PURPOSE, AND AUTHORIZING
THE ISSUANCE OF BONDS IN THE PRINCIPAL AMOUNT
OF $250,000 TO FINANCE SAID APPROPRIATION
THE TOWN BOARD OF THE TOWN OF SOUTHOLD, IN THE COUNTY OF
SUFFOLK, NEW YORK, HEREBY RESOLVES (by the favorable vote of not less than two-
thirds of all the members of said Town Board) AS FOLLOWS:
Section 1. The Town of Southold, in the County of Suffolk, New York (herein
called the "Town"), is hereby authorized to construct drainage improvements for stormwater
mitigation. The estimated maximum cost thereof, including preliminary costs and costs
incidental thereto and the financing thereof, is $250,000 and said amount is hereby appropriated
for such purpose. The plan of financing includes the issuance of bonds in the principal amount
of$250,000 to finance said appropriation, and the levy and collection of taxes on all the taxable
real property in the Town to pay the principal of said bonds and the interest thereon as the same
shall become due and payable.
Section 2. Bonds of the Town in the principal amount of $250,000 are hereby
authorized to be issued pursuant to the provisions of the Local Finance Law, constituting Chapter
33-a of the Consolidated Laws of the State of New York (herein called the "Law"), to finance
said appropriation.
Section 3. The following additional matters are hereby determined and declared:
(a) The period of probable usefulness applicable to the object or purpose for
which said bonds are authorized to be issued, within the limitations of Section 11.00 a. 4 of the
Law, is forty (40) years.
(b) The proceeds of the bonds herein authorized and any bond anticipation notes
issued in anticipation of said bonds may be applied to reimburse the Town for expenditures made
after the effective date of this resolution for the purposes for which said bonds are authorized.
The foregoing statement of intent with respect to reimbursement is made in conformity with
Treasury Regulation Section 1.150-2 of the United States Treasury Department.
(c) The proposed maturity of the bonds authorized by this resolution will exceed
five (5) years.
Section 4. Each of the bonds authorized by this resolution and any bond
anticipation notes issued in anticipation of the sale of said bonds shall contain the recital of
validity as prescribed by Section 52.00 of the Law and said bonds and any notes issued in
anticipation of said bonds shall be general obligations of the Town, payable as to both principal
and interest by general tax upon all the taxable real property within the Town. The faith and

credit of the Town are hereby irrevocably pledged to the punctual payment of the principal of
and interest on said bonds and any notes issued in anticipation of the sale of said bonds and
provision shall be made annually in the budget of the Town by appropriation for (a) the
amortization and redemption of the bonds and any notes in anticipation thereof to mature in such
year and (b)the payment of interest to be due and payable in such year.
Section 5. Subject to the provisions of this resolution and of the Law and
pursuant to the provisions of Section 21.00 of the Law relative to the authorization of bonds with
substantially level or declining annual debt service, Section 30.00 relative to the authorization of
the issuance of bond anticipation notes and Section 50.00 and Sections 56.00 to 60.00 and
Section 168.00 of the Law, the powers and duties of the Town Board relative to authorizing bond
anticipation notes and prescribing the terms, form and contents and as to the sale and issuance of
the bonds herein authorized, and of any bond anticipation notes issued in anticipation of said
bonds, and the renewals of said bond anticipation notes, and as to the execution of agreements
for credit enhancements, are hereby delegated to the Supervisor, the chief fiscal officer of the
Town.
Section 6. The validity of the bonds authorized by this resolution, and of any
notes issued in anticipation of the sale of said bonds, may be contested only if:
(a) such obligations are authorized for an object or purpose for which the
Town is not authorized to expend money, or
(b) the provisions of law which should be complied with at the date of
publication of such resolution, or a summary thereof, are not substantially
complied with,
and an action, suit or proceeding contesting such validity is commenced within twenty days after
the date of such publication, or
(c) such obligations are authorized in violation of the provisions of the
constitution.
Section 7. This bond resolution is subject to a permissive referendum and the
Deputy Town Clerk is hereby authorized and directed, within ten (10) days after the adoption of
this resolution, to cause to be published in "The Suffolk Tunes, " a newspaper having a general
circulation within said Town and hereby designated the official newspaper of the Town for such
publication and posted on the sign board of the Town maintained pursuant to the Town Law, a
Notice in substantially the following form:

Intersection and surrounding area" now, therefore, be it
RESOLVED that the Town Board of the Town of Southold will hold a public hearing on the
aforesaid Local Law at the Southold Town Hall, 53095 Main Road, Southold,New York, on the
24th day of March, 2020 at 4:30 p.m. at which time all interested persons will be given an
opportunity to be heard, and be it further
RESOLVED that the Town Board of the Town of Southold hereby authorizes and directs the
Town Clerk to send the following proposed Local Law to the Suffolk County Planning
Department and the Southold Town Planning Board for their recommendations and review.
The proposed Local Law entitled, , "A Local Law in relation to the six (6) month Extension

LOCAL LAW NO. 2020
A Local Law entitled, "A Local Law in relation to the six (6) month Extension of a
Temporary Moratorium on the issuance of approvals and/or permits for the parcels of
property in "The State Route 25 Love Lane Intersection and surrounding area" .
BE IT ENACTED by the Town Board of the Town of Southold, as follows:
Section 1. Purpose
Moratorium Extension
The Town Board recognizes that in the area of the intersection of State Route 25 (a/k/a
"Main Road") and Love Lane there is insufficient infrastructure to handle the drastic increase in
traffic in recent years and to allow for the safe passage of pedestrians to safely cross Main Road
at the Love Lane intersection as well as at other intersections immediately to the East and West
of the aforementioned intersection. This lack of infrastructure puts the health, safety and welfare
of the public at risk. The residents of the hamlet of Mattituck and the surrounding areas have
voiced their concerns regarding the risk to the health, safety and welfare of the community and
the need for improvements to the infrastructure at the intersection of Main Road and Love Lane.
Similarly, local business owners have identified the traffic issues along Route 25 and Love Lane
as having a negative effect on local businesses.
A six (6) month moratorium was enacted by the Town Board of the Town of Southold
as Local Law 1-2019, on August 27, 2019. The current moratorium is set to expire in March

The moratorium as enacted, is intended to provide sufficient time,for the Town to
consider the recommendations of ongoing traffic studies, a parking study in the Love Lane area
and the completion of the Town Comprehensive Plan.
During the course of the moratorium the Town has met with New York State Department
of Transportation officials to determine which of the various proposed improvements to the
infrastructure the State would deem acceptable and willing to implement or allow the Town to
implement. This analysis remains ongoing. In addition, the draft Town Comprehensive Plan
has been completed and is now open for public comment. The final adoption of the plan is
anticipated to occur by spring 2020.
The Town Board wishes to be able to consider the proposals and recommendations
contained in the various aforementioned plans; consider various alternatives to current zoning
along Main Road; as well as implement improvements to the infrastructure and adopt any
recommended land use changes, to insure the health, safety and welfare of the community to
address the recent drastic increased demands on the infrastructure in the area around the Main
Road/Love Lane Intersection and surrounding area. An extension of the moratorium is necessary
to complete this function.
Given the reasons and facts set forth above and until the planning process is completed,
the Town Board finds it necessary to extend the moratorium already in effect, the terms of which
remain unchanged and are set forth below. This action is necessary in order to protect the
character, public health, safety and welfare of the residents of the hamlet of Mattituck as well as
those visiting the Love Lane area.
Section 2. ENACTMENT OF A TEMPORARY MORATORIUM
Until six (6) months from the effective date of this Local Law, after which this Local
Law shall lapse and be without further force and effect and subject to any other Local Law
adopted by the Town Board during the six (6) month period, no agency, board, board officer or
employee of the Town of Southold including but not limited to, the Town Board, the Zoning
Board of Appeals, the Trustees, the Planning Board , or the Building Inspector(s) issuing any
building permit pursuant to any provision of the Southold Town Code, shall issue, cause to be
issued or allow to be issued any approval, special exception, variance, site plan, building permit,
subdivision, or permit for any of the property situated along State Route 25, bounded on the
West by intersection of State Route 25 and Bay Avenue and bounded on the East by the
intersection of State Route 25 and Pike Street.
Section 3. DEFINITION OF "THE STATE ROUTE 25 LOVE INTERSECTION AND
SURROUNDING AREA''
The State Route 25 and Love Lane intersection and surrounding area is hereby defined as
the area bounded by the following public roads: All properties along State Route 25 in the

hamlet of Mattituck, bounded by the intersection of State Route 25 and Bay Ave on the West and
State Route 25 and Pike Street on the East.
Section 4. EXCLUSIONS
This Local Law shall not apply:
1) to any person or entity who/which has, prior to the effective date of this Local
Law, obtained all permits required for construction of a building on any
property located in the State Route 25 Love Lane Intersection and Surrounding
Area including later applications to repair or alter, but not enlarge, any such
building otherwise prohibited during the period of this temporary moratorium.
2) To any permit or application regarding a single family dwelling unit to be used
solely for residential purposes.
3) To any application by a municipal corporation or special district or fire district.
Section 5. AUTHORITY TO SUPERCEDE
To the extent and degree any provisions of this Local Law are construed as inconsistent
with the provisions of Town Law sections 264, 265, 265-a, 267, 267-a, 267-b, 274-a, 274-b, and
276, this Local Law is intended pursuant to Municipal Home Rule Law sections 10(1)(ii)(d)(3)
and section 22 to supersede any said inconsistent authority.
Section 6. VARIANCE TO THIS MORATORIUM
Any person or entity suffering unnecessary hardship as that term is used and construed in
Town Law section 267-b (2)(b), by reason of the enactment and continuance of this moratorium
may apply to the Town Board for a variance excepting the person's or entity's premises or a
portion thereof from the temporary moratorium and allowing issuance of a permit all in
accordance with the provisions of this Southold Town Code applicable to such use or
construction.
Section 7. SEVERABILITY
If any clause, sentence, paragraph, section, or part of this Local Law shall be adjudged by
any court of competent jurisdiction to be invalid, the judgment shall not impair or invalidate the
remainder of this Local Law.
Section 8. EFFECTIVE DATE
This Local Law shall take effect immediately upon filing with the Secretary of State.

County,New York, on the l It" day of February, 2020, a Local Law entitled "A Local Law to
Amend Chapter 245 Taxation,Article VI entitled "Exemption for War Veterans and Gold
Star Parents" to Provide Property Tax Exemption for Veterans Who are Tenant-
Stakeholders in Cooperative Apartment Corporations" now, therefore, be it
RESOLVED that the Town Board of the Town of Southold will hold a public hearing on the
aforesaid Local Law at Southold Town Hall, 53095 Main Road, Southold,New York, on the
25th day of February, 2020 at 4:30 p.m. at which time all interested persons will be given an
opportunity to be heard.
The proposed Local Law entitled, "A Local Law to Amend Chapter 245 Taxation,Article VI
entitled "Exemption for War Veterans and Gold Star Parents" to Provide Property Tax
Exemption for Veterans Who are Tenant-Stakeholders in Cooperative Apartment

BE IT ENACTED by the Town Board of the Town of Southold as follows:
I. Purpose.
To allow those eligible veterans who are tenant stakeholders in cooperative apartment
corporations to qualify for veteran's exemptions pursuant to New York Reap Property Tax law
section 458-a.
II. $245-17 Tenant-stockholders.
A. Title to that portion of real property owned by a cooperative apartment corporation in which
a tenant-stockholder of such corporation resides, and which is represented by his share or
shares of stock in such corporation as determined by its or their proportional relationship to
the total outstanding stock of the corporation, including that owned by the corporation shall
be deemed to be vested in such tenant-stockholder.
B. Provided that all other eligibility criteria of this chapter are met that proportion of the
assessment of such real property owned by a cooperative apartment corporation determined
by the relationship of such real property vested in such tenant-stockholder to such entire
Parcel and the buildings thereon owned by such cooperative apartment corporation in which
such tenant-stockholder resides shall be subject to exemption from taxation pursuant to
local law against the assessed valuation of such real property; the reduction in real property
taxes realized thereby shall be credited by the cooperative apartment corporation against the
amount of such taxes otherwise pa a�by or chargeable to such tenant-stockholder.
III. SEVERABILITY
If any clause, sentence, paragraph, section, or part of this Local Law shall be adjudged by any
court of competent jurisdiction to be invalid, the judgment shall not affect the validity of this law
as a whole or any part thereof other than the part so decided to be unconstitutional or invalid.
IV. EFFECTIVE DATE
This Local Law shall take effect immediately upon filing with the Secretary of State as provided
by law.

SUPERVISOR RUSSELL: That concludes the agenda. Would anyone like to address the Town
Board on any issue?
Nicholas Deegan
NICHOLAS DEEGAN: Nicholas Deegan, Mattituck. Good evening. I was referring back to
last weeks, months agenda when you issued the wage compilation. I was going to ask the
attorney, did you work full-time or part-time?
TOWN ATTORNEY DUFFY: Full-time.
MR. DEEGAN: Full time. And your two associates?
TOWN ATTORNEY DUFFY: Two Assistant Town Attorneys.
MR. DEEGAN: Are they full-time also?
TOWN ATTORNEY DUFFY: Yes.
MR. DEEGAN: Okay. And the same with the boards in the town, Trustees, Planning all that?
TOWN ATTORNEY DUFFY: Every board, every committee, every department, yes.
MR. DEEGAN: Okay and (inaudible) on bonding, you didn't put in there what the effect on the
tax rate would be for taxpayers once you are going to be paying for the bonds that you are
issuing.
SUPERVISOR RUSSELL: Yes, actually, since that would have appeared in the 2019 budget,
any allocations or costs would have been put in the 19 budget anticipating but you have to
remember, if you authorize a bond in 2020, you do not start paying on that bond until 2021.
MR. DEEGAN: Mmmhmm.
JUSTICE EVANS: If you spend the money.
SUPERVISOR RUSSELL: If you spend the money, this is an authorization, you can't spend the
money just by authorizing, it's just giving you the ability to spend it.

MR. DEEGAN: Sure. And do you get the cost analysis of these projects, did you get bids on
them already?
SUPERVISOR RUSSELL: No, you can't get bids, you can't do anything, sign contracts until
you already put money in place. It's a matter of state law.
MR. DEEGAN: Okay. And the thing with the fire house, what was that about? Was that a
settlement you made with the fire house? It's in here on tonight's agenda. The Mattituck fire
house.
SUPERVISOR RUSSELL: Yes, that was actually a spec tower company that had litigation
because the Planning Board had, Planning Board or Zoning Board? I think the Planning Board
had denied a request for the height they wanted and limited the height and I believe there was a
settlement as to what height they would permit through their grieving process. That was when
Mattituck Fire Department had the license which is what they joined in this litigation with the
spec tower company.
MR. DEEGAN: Was there then, you denied it, it was denied.....
TOWN ATTORNEY DUFFY: It wasn't denied, the Planning Board, they requested 120 foot
height, the Planning Board originally only approved 80 feet so they brought action challenging
that approval by the Planning Board and ultimately it was settled at the height of 110 feet and
they have a fire department antenna located on top of the tower.
MR. DEEGAN: And that is the one on Route 25?
TOWN ATTORNEY DUFFY: On Laurel Stone.
MR. DEEGAN: On Laurel Stone. Okay. So they had an interest in that.
TOWN ATTORNEY DUFFY: Because their equipment was going to be located on it, they
didn't have a monetary interest.
MR. DEEGAN: Alright. And another thing, going back to the wage scale, I think you ought to
put a cap on some of the wages, on some of the positions. Because (inaudible) maybe three or
four times what the average salary maybe is for people on fixed income in Mattituck and I don't
know if it's sustainable, you know, to keep adding three percent every year especially with these
higher ones and.......
SUPERVISOR RUSSELL: Are you talking about these exempt confidential? Or are you talking
about salaries that are covered under collective bargaining agreements?
MR. DEEGAN: Well, it depends, you know, is the Town Attorney under the collective
bargaining?

SUPERVISOR RUSSELL: No, he is exempt confidential.
MR. DEEGAN: Inaudible. So I think when you get to a certain stage you ought to look to put a
cap on it because otherwise it won't be sustainable for taxpayers in the town.
SUPERVISOR RUSSELL: Yes, I think you could look at that or you could look at the median
salaries that get established in other municipalities and decide what you are going to do to protect
your workable people, the skilled people with knowledge within that field. An example being
town comptroller, a very, very niche field, very difficult to find a comptroller or an accountant
with a background in municipal finance, so for certain things like that you have to stay
competitive in a competitive market. We are not the only town, the only jurisdiction, the only
agency, the only government that is in the marketfor a comptroller, for a municipal town
attorney and all of those things. You have to remember there's a market out there and there's
competition for talent and skill.
MR. DEEGAN: Well, yes, sure there is. So (inaudible)putting a cap on it and if that person
thinks, okay, this is not enough, with all that jobs out there that you were talking about and be
competitive for those positions (inaudible)
SUPERVISOR RUSSELL: And what do we do with the vacancy here? That's the problem.
The idea is to stop those vacancies, not to create them.
MR. DEEGAN: I think you would have a lot of people who were interested in a town job so you
wouldn't have the problem that you seem to think you would.
SUPERVISOR RUSSELL: Well, we advertise, we advertise and the people that are interested,
local individuals that are interested in those various positions are welcome to apply.
COUNCILMAN DINIZIO: We are in the process right now of looking for an engineer and
honestly, it's going to be a tough nut to replace, to get another engineer. We are going to have to
have a competitive wage and we are going up against the private sector as well. And like Scott
said,the town comptroller, we searched high and low and we found somebody who basically
liked it out here. You know, she chose this.
MR. DEEGAN: You hired a person who brought their own package to work out here.
COUNCILMAN DINIZIO: That is correct. But you know again, she came from a much bigger
municipality that could afford to pay her, we had to pay her accordingly. It's not any less
expensive to live out here than it is there.
MR. DEEGAN: No. That I am aware of, in the spirit of egalitarianism, maybe we bring the
bottom up and keep the top down. Anyway, thank you.
