Terry. 9:45 A.M. - Richard Israel, Herbert Mandel, and their attorney William D. Moore met with the Board to discuss the DBM Affordable Housing Project on Boisseau Avenue, Southold. They have received preliminary approval from the'I Planning Board and are now requesting final approval. They are unhappy with the Planning Board's request that they take four lots and create park land. Mr. Moo~e and his clients explained the history of the project to the Board, who then-adv!ised them that the Town Board may not interfere with the regulations or directives of the Planning Board. ; 10:25 A.M. - Judith Weiner, representative of the East End Arts Council met with the Board t° aSk that a Town Board member be designated to meet periodilcally with an East End Arts council rePresentative for arts liaison planning. Mrs. Wieiner also asked for $3,000 financial support for the Council. Councilwoman Larsen, chairman of the Parks & Beaches & Recreation Committee will schedule a meeting with Ms. Weiner to go into depth on the proposal and report back to the Town Board. EXECUTIVE SESSION i 11:00 A.M. - On motion of Councilwoman Oliva, seconded by Councilman ;Penny, it was Resolved to enter into Executive Session. Vote of the Town Board:-A~,es: All. The Board met with Special Counsel Frank Yakaboski and Frank Eissler, along with,-~ Principal Building Inspector Lessard and Senior Building Inspector Horton ~o discuss litigation. 11:40 A.M. - Merlon Wic~cjin, Consultant for Southold Villas, Inc., and oWner Isaac Saidmehr, and associate, met with the Board to discuss the recommendation of the Town's consultants Cramer, Voorhis & Associates, that Southold Villas inc!. preform additional subsurface investigation to determine the potential for irreversible loss of significant cbltural resources with respect to the Draft Environmental Impact State- ment flied on their property. Mr. Wiggin advised that the applicant is prepared to drop their affordable housing project if this is required, as there would be an additional cost of $3,000, and a survey has been conducted and is encompassed within the DEIS. The Board agreed to accept the DEIS deleting the requirement (see resolutions no. 28(a)&(b).----On another subject, Mr. Wiggin advised the Board that New York State has claimed ownership of the Bug Light lighthouse site and permits can now be sought to reconstruct the historic light. Funds are being sought for the reconstruction. EXECUTIVE SESSION 12:05 P.M. On motion of Councilman Penny, seconded by Councilwoman Larsen, it was Resolved to enter into Executive Session. Vote of the Board: Ayes: All. The Board met with t'heir'negotiator Charles Graves to discuss the status of the proposed 1990-91 CSEA contract. 12:40 P.M. - Recess for lunch. 2:10 P.M. - Town Planner Valerie Scopaz met with the Board to request time at one of their February meetings to meet with David Ross of the Suffolk County Water Authority. 2:20 P.M. - For Discussion Items:- (I) Resumes received for the vacancy on the Conservation Advisory Council caused by the resignation of Daniel Kujawski. Supervisor will schedule interviews. (2) Notification of a Recycling Conference sponsored by the NYS-DEC on March 22 & 23 at Liverpool, New York. Councilwoman Oliva will obtain further details and discuss again on January 23rd. (3) Discussion about hiring a Town Engineer (see resolution no. 26). (4) Receipt of bids for a 1990 vehicle for the Building Department. Due to the fact a provision in the specifications calls for service within 25 miles of Town Hall, which is objected to by the State Comptroller, the bids will be rejected (see resolution no. 24).---The Board JANUARY 9, 1990 2 6 also discuss hiring an Assist'ant Superintendent of Public Works (see resolution no. 25). {5) Southold Villas, Inc.--discussed at 11:40 A.M. with Merlon Wiggin (see resolutions 28(a) and 28(b). {6) Community Development Administrator James McMahon n~et with the Board-to recommend that they revise the Town Code with respect to the freshwater wetlands. He presented a packet of guidelines developed by the NYS-DEC for local legislation. He strongly believes the Town Code should reflect the Town's commitment to preserving our natural resources. This is referred to the Legislative Committee. (7) Receipt of a bill from H2M Group for professional engineering services performed in conjunction with an environmental site assessment of the Carey Tank Farms. These services were requested by Town Attorney Schondebare, but were not approved by resolution of the Town Board (see reso ution no. 29). (8) Appointment of a Building Department Clerk on F.lsl.(see reso.no.31). 3:05 P.M. - The Board discussed the New York State Clean Indoor Air Act which went into effect on January 1, 1990. The law calls for the prohibition of smoking in all indoor areas open to the general public, including lobbies, waiting areas and rest rooms. A separate room may be set aside for smoking, provided the public does not pass through it. The Town Board could not make a determination with respect to a designated smoking area in the Town Hall as the space is so limited, so they decided to ban smoking in the entire Town Hall, as well as all Town-owned buildings, until a site can be located. In the mean time Assistant T'own Attorney Kiernan will research the law for the purpose of drafting a written smoking policy for Town Board adoption.---Following an inspection of Justice Court addition, the Board added a resolution (no. 33,) to the agenda to engage the services of Samuels & Steelman to provide architectural services for the purpose of preparing a check- list of items needing correction before the Town Board will release the final payment to the contractor. EXECUTIVE SESSION 4:10 P.M. - On motion of Councilwoman Oliva, seconded by Councilman Penny, it was Resolved that the Town Board enter into Executive Session. Vote of the Board: Ayes: All. The Board met with Principal Account Clerk John Cushman to discuss personnel, and the possibility of hiring a part-time, temporary Clerk to do data entry in the Accounting Department. 5:15 P.M. - Board reviewed regular meeting resolutions. 5:25 P.M. - Board audited outstanding bills. 6:00 P.M. - Work Sesson adjourned. REGULAR MEETING 7:30 P.M. A Rec~ular Meetinc~ of the Southold Town Board was held on Tuesday, Janury 9, 1990, at the Southold Town Hall, Main Road, Southold, New York. Supervisor Harris opened the meeting at 7:30 P.M., with the Pledge of Allegiance to the Flag. Present: Supervisor Scott L. Harris Justice Raymond W. Edwards Councilman George L. Kiernan SUPERVISOR HARRIS: The first order of business, I'd like to bring up tonight, is the Southold Town Recycling Program. It was kicked off this morning, at the Southold Town Landfill. Basically, we have a three container system set up there, one for plastics, one for glass, one for metals. This will be a start, an intial start of the recycling program, that the Town of Southold, is embarking upon in the year 1990, and I have in front of me a flyer, which will be passed out, and I'll give that to some of the audience later, which will be handed out up at the landfill as people come in, and dispose of items, that those people that actually go to the landfill, and throw'~ away items. If you take your household garbage to the Town Landfill in Cutchogue, you can start to recycle immediately. Here's what to do: and it qoes on to say, recycle newspapers: We can continue 262 JANUARY 9, 1990 our efforts. As you know~ '~here are car:ts inside the Landfill Station for stacked, tied, clean newspapers. Here's some advice: Newsprint only, please. Drop off newspapers that are dry and clean. No 91ossy inserts. No magazines, and ~tie your newspapers, and no paper bags. Join us in three new items to recycle, plastics, tin cans and glass. After you enter the Landfill from Route 48, you can take a sharp right and the CollectiOn Station is on you left. With the Collection Station on your left, notice the recyclin9 bins immediately to your left. This is before you actual enter the building itself. These new bins are where you may leave your .plastics, tin cans and glass, which you have sorted at home. Recycled plastic. Here's what to do: Dump your plactics in the bin at the Landfill. Put-in such plastics as various jugs, non-returnable plastic bottles, plastic milk or juice or detergent containers and the like. If possible, please compress as much as possible. Recycin9 tin cans. Put your tin cans in aba9 or box; rinse out the cans before takin9 them to the Landfill, and on 9lass, put your' non- returnable bottles only in a bag or box, as with the tin cans, please remove the labels and rinse them out before takin9 them to the Land. Please note, leave off 91ass bottles only for recycling. Do not include stuff like light bulbs~ window 91ass, dishes or any ceremic materials, and on the back you'll see a number of items, that we can not recycle, paint removers, furniture polish, pesticides, over cleaners, paints, antifreeze, gasoline, motor oils, and the like. 1'11 'give some to the audience right now. PUBLIC HEARINGS. 1. 8:00 P.M., January 9, 1990, on a proposed "Local Law in Relation to Zoning: (deleting duplicate fee). V. RESOLUTIONS. SUPERVISOR HARRIS: At this time, I'd like to introduce the resolutions. As you can see on the agenda, resolved that the Southold Town hereby establishes the policy that, scheduled town board meetings, the public shall be allowed five (5) minutes to address the Town Board in relation to agenda resolution prior to the enactment. The public wilL also be given time, at the conclusion of the regularly scheduled business agenda, to address the Board at any given topic. This was passed, as you can see, on June 3, 1986. Is there anyone, who would like to address anything, at this time, for any resolution, that is on here? Mr. Carlin? FRANK CARLIN: 'Frank Carlin, from Laurel. I live on Route 25. For years I was alwaysagain.st why we needed a public works commission in the Town of Southold. To me, it's just a job that's not neccessary. I think, you talk about saving money. You cut down on the Supervisor's assistant salaries, and now you're looking for an assistant to the public works commissioner, which is Ray Jacobs. Riverhead doesn't have one. Southampton doesn't have one. I don't think Easthampton has one, because I checked. ! mean, when you look at it, what public works really means, it means like you have in the big city, for the works, the parks, and the waters, but not for a town like this. Let's face it, we're creating a job there, that we don't even need. That should be the responsi- bility of the Highway Superintendent. You're creating more money, which is around $3,000 to $4,000 more. Now .you're looking for more money for this position here. I say eliminate it. We don't need a public works commission in a town of this size. It doesn't warrant. You want to save money, then stop it. Thank you. SUPERVISOR HARRIS: Mr. Carlin, before you sit, maybe Mr. Wickham would like to address the need for this position, and exactly what it is. COUNCILMAN WICKHAM: I'd be happy to do that. I thought we might do it, in the course of our business. The purpose of this position is not to simply be an assistant to Ray Jacobs. It's to give the town strength and capacity to deal with an enormous problem, that's costing the town a great deal of money, and that's the total waste management and landfill management problem. The feeling on the part of those of us, who brought this resolution to the Board, is the landfill has not been adequately managed in the past. That the problems, that we are currently grappling with, dealing with the State mandates, has cost us a tremendous amount of money, and we need to have some capacity on the part Town government to deal with it. For that purpose, Ray Jacobs has actually asked for some help in this area, and those of us, who brought the proposal to the Board, feel that it would be in the Town's interest, and would save the Town money. FRANK CARLIN: Doesn't Ray Jacobs have an assistant, also? SUPERVISOR HARRIS: He has a deputy, Superintendent of Highways. COUNCILMAN PENNY: This postion was established about two years ago, and was vacated about six months ago. This position was held by a former Town employee, and it's been in the budget right along, so all we're doing is putting somebody back in a position, that already exits. 264 JANUARY 9, 1990 FRANK CARLIN: I still don't understand, what you need it for. Getting into this landfill, now.you're starting to add people already. You need an assistant there, because it's getting out of control. Pretty soon, you'll need more, and more, and more. You've only started with this recycling program. It's new now, and the landfill...now you're saying you need an assistant. I don't believe, you need a public works commission in a town this size. It's just another job. The Highway Superintendent gets paid enough, and he:s got an assistant. He should be able to handle it. COUNCILWOMAN LARSEN: Frank, the only thing I'd like to comment on, is the fact, that the landfill wasn't adequately managed in the past. As you know, the Town of Southold is one of the few towns, who have not been under the discretion and the criteria for fining for the New York State DEC. Southampton has been under extensive fines, and Riverhead has been under extensive fines, or they're pushing to fine them. Riverhead is fighting it, at the moment. The Town of Easthampton landfill practices have been extensively scrutinized. The Town of Southold, to this date, had managed to escape that, so the only thing I would like to say, is that, the comment that our landfill has been managed in the past, our. landfill has been addressed and managed in the past. It's up to this Town Board now, to continue the procedure of good management, that has been established by the prior Town Board. FRANK CARLIN: Wasn't it always, for the landfill? that the Highway Superintendent was responsible COUNCILWOMAN LARSEN: Yes, the Highway Superintendent is the commissioner of public works in the Town Southold. FRANK CARLIN: Somebody wasn't-doing their job. SUPERVISOR HARRIS: Is there anyone else, in the audience, who would like to address any of the resolutions? (No response.) If not, we'll proceed to the resolutions. Resolution number 1, we're appointing Sandra Berry as a part-time work/study clerk fo.r the Accounting Department. I move that. 1.-Moved by Supervisor Harris, seconded by Justice Edwards, it was RESOLVED that the Town Board of the Town of Southold hereby appoints Sandra Berry as a part-time Work/Study Clerk for the Accountin~ Department for the period January 3, 4, 5, 10, 11, 12, 1990, at a salary of $5.50 per hour. 1.-Vote of the Town Board: Ayes: Councilman Wickham, Councilwoman Larsen, Councilwoman Oliva, Councilman Penny, Justice Edwards, Supervisor Harris. This resolution was declared duly ADOPTED. 2.-Moved by Councilman Penny, seconded by Councilwoman Larsen, it was RESOLVED that the Town Board of the Town of Southold hereby allocates 1989 Special State Revenue Sharing Funds as follows: General Fund - Whole Town $ 9,835.91 General Fund - Part Town $ 4,131.09 2.-Vote of the Town Board: Ayes: Councilman Wickham, Councilwoman Larsen, Councilwoman Oliva, Councilman Penny, Justice Edwards, Supervisor Harris. This resolution was declared duly ADOPTED. 3.-Moved by Councilwoman Oliva, seconded by Councilwoman Larsen, it was RESOLVED that the Town Board of the Town of Southold hereby authorizes a reimbursement of $50.00 to John Wickham, which sum represents the difference between a lot line change and a minor subdivision application to the Planning Boa rd. 3.-Vote of the Town Board: Ayes: Councilwoman Larsen, Councilwoman Oliva, Councilman Penny, Justice Edwards, Superviso~ Harris. Abstain: Councilman Wickham. This resolutior~ was declared duly ADOPTED. 4.-Moved by Justice Edwards, seconded by Supervisor Harris, it was RESOLVED that the Town Board of the Town of Southold hereby cjrants permission to Director of Senior Services Venetia McKeighan, to place 28 hours of the EISEP Coordinator's salary at $4.50 per hour on the CSE (Home Aide) budget, while keeping 9 hours at $6.00 per hour on the EISEP budget; this will bring down the EISEP unit cost to be in compliance with Suffolk County's Medicaid rate for non-medical in-home personal care unit rate. 4.-Vote of the Town Board: Ayes: ,Councilman Wickham, Councilwoman 'Larsen, Councilwoman Oliva, Councilman Penny, Justice Edwards, Supervisor Harris. This resolution was declared duly ADOPTED. 5.-Moved by Councilman Wickham, seconded by Justice Edwards, it was RESOLVED that the Town Board of the Town of Southold hereby creates the position of Assessment Assistant in the Office of the Board of Assessors, sets a salary of ~21,991.45 (as exists in the 1989 CSEA contract salary schedule) for said position, and authorizes and directs Supervisor Scott L. Harris to request a Suffolk County Civil Service Certification of Eligibles List for said postition. COUNCILWOMAN LARSEN: I'm go. ing~to~.a-bstain on this, only because of prior practice of the Town Board to set the salary for the ~pcoming year at the previous year's rate, as applied to the creation of Vic Lessard position and also, Melissa Spiro's position as Town Planner. 5.-Vote of the Town Board: Ayes: Councilman Wickham, Councilwoman Oliva, Councilman Penny, Justice Edwards, Superviosr Harris. Abstain: Councilwoman Larsen. This resolution was declared duly ADOPTED. 6.-Moved by Supervisor Harris, seconded by Justice Edwards, it was RESOLVED that the Town Board of the Town of Southold hereby authorizes the encumberance of $45,764.23 from the Fishers Island Ferry District 1989 budget line item Operation Ferry to pay the balance due to MicroSystems Integration, Inc. for hardware and software for automating freight processinq and ticketing systems under a 1989 contract with the Fishers Island Ferry Dist~'ict. 6.-Vote of the Town Board: Ayes: Councilman Wickham, Councilwoman Larsen, Councilwoman Oliva, Councilman Penny, Justice Edwards, Supervisor Harris. This resolution was declared duly ADOPTED. 7.-Moved by Justice Edwards, seconded by Councilman Wickham, it was RESOLVED that the Town Board of the Town of Southold hereby authorizes Super- visor Scott L. Harris to attend the 40th Annual Winter Conference-School, sponsored by the New York State Supervisor' and County Legislators' Association, at Corning, New York, on January 21 through 24, 1990, and the necessary expenses for meals, lodging and travel shall be a legal charge against the Supervisor's 1990 Budget. 7.-Vote of the Town Board: Ayes: Councilman Wickham, Councilwoman Larsen, Councilwoman Oliva, Councilman Penny, Justice Edwards. Abstain: Supervisor Harris. " This resolution was declared duly ADOPTED. 8.-Moved by Councilman Penny, seconded Councilwoman Oliva, it was RESOLVED that the Town Board of the Town of Southold hereby authorizes the Town Clerk to advertise for bids for the purchase of a new 1990 four wheel drive vehicle for the Bay Constable, all in accordance with the bid specifications. 8.-Vote of the Town Board: Ayes: Councilman Wickham, Councilwoman Larsen, Councilwoman Oliva, Councilman Penny, Justice Edwards, Supervisor Harris. This resolution was declared duly ADOPTED. 9.-Moved by Councilwoman Oliva, seconded by Supervisor Harris, it was RESOLVED that the Town Board of the Town of Southold hereby grants permission to Councilwoman Ellen M. Larsen and Local Waterfront Revitalization Advisory Committee member William H. Lieblein to attend the Bi-Annual Marine Planners conference, sponsored by the Empire State Marine Trades Association, at the Holi~tay Inn, Hauppauge, New York, on Wednesday, January 31, 1990, from 8:00 A.M. to 5:00 P.M., and the necessary expenses for registration and travel shall be a legal charge against the 1990 Budget. 9.-Vote of the Town Board: Ayes: Councilman Wickham, Councilwoman Larsen, Councilwoman Oliva, Councilman Penny, Justice Edwards, Supervisor Harris. This resolution was declared duly ADOPTED. 10.-Moved by Councilman Wickham, seconded by Supervisor Harris, it was RESOLVED that the application of Samuel G. Brown for renewal of his single family house trailer permit, for trailer located on the west side of Tuthill Road, Cutchogue, which permit expires on January 15, 1990, be and hereby is granted for a six (6) month period. 10.-Vote of the Town Board: Ayes: Councilman Wickham, Councilwoman Larsen, Councilwoman Oliva, Councilman Penny, Justice Edwards, Supervisor Harris. This resolution was declared duly ADOPTED. 11.-Moved by Justice Edwards, seconded by Councilwoman Larsen, it was RESOLVED that the Town Board of the Town of Southold hereby authorizes Senior Bay Constable Donald Dzenkowski, Bay Constable Kent McCarthy, and Police Officers Edward Grathwohl and Joseph Conway, Jr. to attend an Ice Rescue/ Recovery Seminar on February 7, 8, 9, 1990, at Warwick, Rhode Island, and the tuition cost of $135.00 per person, and necessary expenses for r~eals, lodging and use of two (2) Bay Constable vehicles shall be a !egal charge against the Bay Constable's 1990 Budget. 11.-Vote of the Town Board: Ayes: 'Councilman Wickham, Councilwoman Larsen, Councilwoman Oliva, Councilman Penny, Justice Edwards, Supervisor Harris. COUNCILWOMAN LARSEN: The reason, that I'm voting no, is because the Building Department is driving around in used, old Southold Town Police cars, that we have received $700.00 a month repair bills on. They're basically falling apart. The Building Department was not allocated money in the 1990 budget to replace the cars, but there was money in the 1989 budget to replace the cars, and we did receive two good bids, and if we were going out to rebid, based on the State mandate, I would vote yes, but evidently from what I understand we're not go out and rebid, correct? Isn't that what you said today? SUPERVISOR HARRIS: That determination, I think, it was made, but the reason we had to do this is because of the comptroller. COUNCILWOMAN LARSEN: We need an additional car, because of the expenses of paying repair the existing cars, when they're used. SUPERVISOR HARRIS: I voted, yes, with an explanation, that the reason that we had to go forth with this resolution, is that the 1988 comptroller's report criticized the Town of Southold for its good procedures, advertising within 25 miles of the Town of Southold, which they said was illegal for receiving bids, and that's why we had to go out after this resolution was passed. COUNCILWOMAN LARSEN: Thank you, Scott. First of all, I'd like to briefly comment on your commitment to upgrading the freshwater wetland leqislation within 270 JANUARY 9, 1990 the Town. It's something that I've been in favor of, since I've bee~q on the Town Board. We need it in a lot of environmental areas, as far as enforcement of the protection of our natural resources go. It's one thing to give it lip service, but when it comes down to the nitty-gritty of actually being able to enforce them through Town Code, the Town of Southold is really lacking in environmental and natural resource legislation, so I'm happy to see that. As far as the Gull Pond bulkhead goes, the only thing that I have to report to the Board, is that we have contacted Mr. Rosenberg, from the Long Island Parks Service. They have copies of the original specification. We verbally spoke with them, about two to three weeks ago. They said that the plans would be forthcoming to the Town, so that we can prepare the specs from that. Since they haven't arrived yet, and l've spoken with Betty Neville in the Town Clerk's Office, and she was sending a letter out, now, formally requesting the original specifications on behalf~-'~ of the Town. Regarding the recycling program, that we started this morning, I'm happy to see that this announcement with be going out, as to what should not be included in the recycling. When Councilwoman Oliva and I, first inspected it, this morning, we ~awsome hazardous waste mixed in with the recyclables. If glass is broken and crushed it's less valuable. It's harder to get rid of. if there are con"t.~"manents mixed in with the recycling, it's harder to get it marketed. They will eventually reject it. Our feeling was, that intially perhaps , we should incorporate some volunteer groups to manage the recycling, and we have started this very rapidly to get it on line, so it will warrant some review. That's all I have to say. Thank you. COUNCILWOMAN OLIVA: I agree with Ellen. I think to review our wetlands ordinances, especially for freshwater wetlands, is so important. They are so neccessary here in Southold to replenish our aquifers, Some of these areas, they're only wet at certain times of the year, but there're important to keep them, instead of trying to fill them in, and have everybody with their wet base- ments and what have you. It's important to keep the natural vegatation there, to keep our whole ego system viable, and I certainly, really, support us doing something about it. We have been busy, since last week, our organizational meeting, with many meetings on our garbage crisis, and getting the recycling program started, and hopefully within the next few weeks, we'll be getting a brochure together, to be able to hand out to people,with a big educational campaign going out to the schools, the civic organizations, service organizations, just every- body we can think of. We hope to make it an exciting type of program with -- contests, and prizes, and what have you, and it's something for everybody to look forward to. Ellen and I did see those contaminants in there, and they shoulc be taken just inside, to the STOP Program, and again, I would like to reiterate, we are the first landfill, that had a hazardous waste site in the state, and probably in the northeast. JUSTICE EDWARDS: After the people on Fishers Island have been paying into the Cutchogue landfill for all of these past years, for how long, and they never get any use of it, except myself emptying my ashtray once a month, and I don't smoke, we finally got some monetary value from Cutchogue. The last time, Superintendent Jacobs sent a truck over there last week with some sand for the roads, we filled it up with tires, and brought the tires back to the landfill, so that's a plus for Fishers Island. We're starting to get some return on our tax dollars into Cutchogue. Thank you, Scott. COUNCILMAN WICKHAM: I'd like to report very briefly, on the activities on the Task Force on Waste Management. You've heard Ruth Oliva speak breifly, about the recycling front. She's our Chairperson of our sub-committee dealing with that subject. She referred to the recycling programs, established at the landfill itself. We had a kickoff on that this morning. She didn't refer to the plan by which the carters, the haulers, will, also, be picking recycled materials curbside from those people who use the carters, and haulers. We'll have informa- tion on that very shortly. There is another committee of the Task Force, that we call a Technical Resources Committee, which is dealing with the longer term problems, of dealing with the residual materials, that cannot be recycled. That committee has established...is really doing two things. In the first instance, it's screening prospective engineering firms, which would like to provide consulting service to th.e Town of Southold, and we think that within several weeks, we should be able to make a recommendation from one of those firms. Second thing we've been doing, is exploring the possibility of working together with one or more other towns, so that Southold Town can solve it's waste management problems without having to build duplicating type facilities here, comparable to what other towns are building elsewhere. Rather we would piggyback, or make use of jointly some of those other firms. And we've been very pleased, that the New York State Department of Environmental Conservation has been encouraging, and encouraged us, and helped up to meet with those towns, in order to put these plans in effect. There's a I°ng way to go, but we're encouraged by the direction this is taking, and by the DEC's active areas of interest. There was a reference earlier, in the very beginning, about whether we need to engage the services JANUARY 9i 1990 2 7 ;L of a ~ssistant sup'erint-enclent of p~b?: works, and I've addressed that, but I would just like to say, that th~.pb~i~i~rl :0f ithe Task Force is, that the waste management area is becoming so exl~ensive, and so important to the Town, that we are in danger of spending considerably more money by not knowing exactly what we're doing, or managing affairs tightly. The reason to engage the services of such a person is not to spend more money, but to tighten up the management in the waste management area, and to discharge our responsibilities more efficiently. COUNCILMAN PENNY: I attended about the same amount of garbage meetings, as everybody else, and all the Task Force meetings, and the meeting, last weekend, with the DEC, and the East End Towns over in Quoque , and we're working. We're working, it's going to take awhile, but b~ar ~,ith us. As far as this morning went, I would just like to take a few moments to thank some of the people without whose efforts, this morning's photo sessions at the landfilt would not have happened, specifically Ray Jacobs, who was instrumental in having his departmer~t work out this area, that we carved out there, and make it useable, so the public has easy access to it. They cleaned up the area. They made provisions for moving equipment around, and they put in a new bed of stone blend in front of the facility, so people have easy public access to it. Also, Ray's department was instrumental in building the stairs, and the platform, that is between the recycling containers, and I'd like to thank Roy Schelin, and John DiVe[lo, who have made it possible through their contributions to think about recycling in Southold Town. They volunteered equipment, and their services, at no cost to the Town of Southold, to help us get started, and I'm sure we're going to rely very heavily on them, and, also, Bobby Pfluger, also, with his efforts has been most helpful, also. We'll rely on these people. We find that within the Town of Southold, we have a measurable resources, and the more we tap them, the more money we save for the public. Thank you. SUPERVISOR HARRIS: Tom, you have something you'd like to say? COUNCILMAN WICKHAM: One other point, I should make about the Task Force is, henceforth, we'll be meeting twice a week at 7:30 in the evening. That's on Monday evenings, and on Wednesday evenings, and the public is inqited to participate, and observe, and give us your counsel. Thank you. SUPERVISOR HARRIS: I would like this time to thank, personally, the Task Force for the job, that has been undertaken in the last seven weeks, actually eight weeks at this point. They put a tremendous amount of time in meeting twice a week, and I think the efforts are now becoming fruitful. As of today, start with recycling. In particular, I'd like to thank Tom, and Ruth, for the recycling end of it. for the day, and George, for your cooperation, with helping put the carters together, and particularly, our Superintendent of Highways Ray Jacobs for his efforts up there, making the ramp possible for people to actually dispose of these items. We, also, have another item, that I feel is important to mention today, and that goes back to our meeting of Saturday with the DEC, which Tom alluded to earlier. This meeting, I think, will be a very fruitful meeting, especially in the month's to come. Our next scheduled meeting is January 20th. We met with, regionally all five East End town supervisors, and Town Board members. Ruth attended. Tom attended, and George Penny attended. Ellen, I know, was disposed, but she would have been there otherwise, too. Last night, at the Kiawania's Club of Southold, Paul Roth came out for Harold Berger, who was supposed to speak, but was obviously detained by the weather. So Paul Roth, who is the engineers from the DEC, spoke in his stead, and he commended the Town of Southold,to the audience, for their participation in that meeting. This meeting will, hopefully, come forth, and as I said, the weeks to come, with a regional approach with the Towns all working together, and I hope that we can find this acceptable to our people of Southold, both fiscally and, also, palatable for the efforts, that the DEC has put forth trying to make a regional approach happen. This has been their approach for months and months, and I think the~,¥~happy, that the meeting went very well. The direction seems to be going well, and we have to report back to them now, as I said in about two more weeks, and we'll have another session on a weekend. 1~ was over at Quogue, beautiful Quogue Wildlife Santuary, which is a gorgeous place. For those of you, who haven't been there, I suggest you go over there, l'm sure you'd enjoy the day. I'd, also, like to thank the Town Board today. We had a very long session. We didn't break until well after six o'clock. We did have a lot on the agenda. Those of us, who have not been on board for. years, obviously had a lot of questions, that we asked, and I thank you for your indul- gence for today's meeting, and Judy, thank you for your time, because it does rush the clerk. I've asked to put resolutions on at the last minute, and Judy thank you for that, also. At this time I'd like to turn it over to the audience. In the January 4th issue of the Suffolk Times, page A12,.Southold Town Hall notes, it says in there, Town Assessor reappointed. I find this strange to find a Town Assessor~, that's reappointed. I always thought that position was ekected by the people, and not by the Super- visor, or the Town Board, or either John Nickles. The reason it was given, well, we need him there for a year, because we only have one experienced tax assessor. Well, let's face it. When we all start on a new job, we all go through a training period. That's normal. I have nothing against Bob Scott. I believe he'll do a good job. Suffolk Times, November 2nd. Campaign ad, I'll read it. I'll be a few minutes. Elect Robert Scott assessor. Robert Scott is a Greenport businessman, committed to serve as Town Assessor. He has already started classes for assessment certification. He has 17 years of real estate, competitive market analysis, experienced. Let's put Bob's know how to work. For me, sayin~c a man is that qualified, and why he kept Watt's I think the man is qualified here, and I don't believe that it's right to. Charlie Watts notified back in March, that he was going to retire. The party had sufficient time to select a candidate to run in November. Right? You were running for supervisor. Wasn't there an opening for Town assessor? He's term was up, wasn't it? SUPERVISOR HARRIS: No, it wasn't. FRANK CARLIN: It wasn't up? COUNCILMAN PENNY: Not until January 1st. FRANK CARLIN: Well, they're all up January 1st. I know that. TOWN CLERK TERRY: It wasn't up for two more years, Mr. Carlin. FRANK CARLIN: Okay, I'll go along with that point. But the Town Board, Super- visor or Mr. Nickles has no right to appoint somebody for that position, when it's determined by the people. It's elected office, and it's not to be, and I feel, not to be choosen by a group. I don't think it was right. COUNCILWOMAN LARSEN: I'll just comment on that, briefly, Frank. Ruth and I, immediately, when the position came up called for a special election. Actually Ruth did sa look what about a special election? However, to vote that night we both voted to reappoint Charlie Watts for one year, up until next November when there will be an election held for the vacancy. Now there's reasons surroun( lng that decision, that I would happy to discuss with you, personally after the meeting. Otherwise, I think it's always been the position of the Town Board to hold a special election. We held a special election with my vacancy. Actually it's usually detrimental to the party to put an appointment in. Historical, that's what's shown. That if you appoint, that it's detrimental, not to let the people decide who they want. I think the Town Board on a whole, is in favor of that. But I will discuss the circumstances surrounding it afterwards. You may even take exception to that, but you'll see why the Town Board did this. FRANK CARLIN: That's all I know... COUNCILWOMAN LARSEN: What you read in the paper, which is what anyone knows. FRANK CARLIN: Is what I know is, if officers are elected by the people, that's who goes in that office, and nobody else. If you have to have an election, special election now, or wait until November. November is a long way off yet. It's nine months off yet. SUPERVISOR HARRIS: Anyone else in the audience? CHARLES ZAHRA: Charles Zahra, from Mattituck. Once again, I'm before you, and requesting a answer as to whether or not, this letter of mine, October 16, 1989, was or will be answered? As of this morning, I asked Judy Terry, she said it had not been responded to. COUNCILMAN PENNY: I'll just comment on that, Charlie, because [ was one of the people, that requested that this be attended to by the Town Attorney for comments back to us on that. Right now we have an interium situation, and I did look on the file, which is sitting on the Attorney's desk, and I'm sure that Matt will have a chance to go through that file. But that is one of the letters, that was referred, that has not been responded yet, to the Town Board. But I did 9o through the file on his desk, and it is there for review. CHARLES ZAHRA: This will be the third time, l've asked. JANUARY 9, 1990 273 COUNCILMAN PENNY: Well, Charlie, you have to understand, there's a transi- tion period. You 'have to understand. CHARLES ZAHRA: That's why I brought it up December 27th to that administra- tion, and now, I'm starting. TOWN CLERK TERRY: Another letter was written, because I was in Supervisor Murphy's office, when we went over the agenda, and another letter was written to the Town Attorney to respond, as a result of that question you asked on the 27th. CHARLES ZAHRA: Just to reinterate. The first time Frank responded, that the Town Attorney was handling it, and on December 27th, he said it was turned over to the Building Department, and I didn't say anything at that time, but I'd like to say a couple of things now. I served it under Section 268 of the Town Code, and it Provides you people with the power to deal with it directly, and I would expect that ,you would do so, for it is, in fact, the Building Department that I'r.~ questioning here, not necessarily the individual property owner. COUNCILMAN PENNY: As soon as this meeting over, I'll go back and we'll spend a few more minutes, and I'll personally bring it to his attention. CHARLES ZAHRA: Thank you very much.
