"-V i IN WITNESS WHEREOF,the said Board of Trustees hereby causes its Corporate Seal to be affixed, and these presents to be subscribed by a majority of the said Board as of the 15th day of January,2020. 3 TERMS AND CONDITIONS The Permittee Santosha After 50, LLC residing at 56155 Route 48, Greenport, New York as part of the consideration for the issuance of the Permit does understand and prescribe to the following: 1. That the said Board of Trustees and the Town of Southold are released from any and all damages, or claims for damages, of suits arising directly or indirectly as a result of any operation performed pursuant to this permit, and the said Permittee will, at his or her own expense, defend any and all such suits initiated by third parties, and the said Permittee assumes full liability with respect thereto,to the complete exclusion of the Board of Trustees of the Town of Southold. 2. That this Permit is valid for a period of 24 months,which is considered to be the estimated time required to complete the work involved,but should circumstances warrant, request for an extension may be made to the Board at a later date. 3. That this Permit should be retained indefinitely, or as long as the said Permittee wishes to maintain the structure or project involved, to provide evidence to anyone concerned that authorization was originally obtained. 4. That the work involved will be subject to the inspection and approval of the Board or its agents, and non-compliance with the provisions of the originating application may be cause for revocation of this Permit by resolution of the said Board. 5. That there will be no unreasonable interference with navigation as a result of the work herein authorized. 6. That there shall be no interference with the right of the public to pass and repass along the beach between high and low water marks. 7. That if future operations of the Town of Southold require the removal and/or alterations in the location of the work herein authorized, or if, in the opinion of the Board of Trustees, the work shall cause unreasonable obstruction to free navigation, the said Permittee will be required, upon due notice,to remove or alter this work project herein stated without expenses to the Town of Southold. 8. That the said Board will be notified by the Permittee of the completion of the work authorized. 9. That the Permittee will obtain all other permits and consents that may be required supplemental to this permit, which may be subject to revoke upon failure to obtain same. 10. No right to trespass or interfere with riparian rights. This permit does not convey to the permittee any right to trespass upon the lands or interfere with the riparian rights of others in order to perform the permitted work nor does it authorize the impairment of any rights, title, or interest in real or personal property held or vested in a person not a party to the permit. Box 1047 Southold, NY 11971 RE: SANTOSHA AFTER 50, LLC 56155 ROUTE 48, GREENPORT _ SCTM# 1000-44-1-21 Dear Mr. Kimack: The Board of Town Trustees took the following action during its regular meeting held on Wednesday, January 15, 2020 regarding the above matter: WHEREAS, Michael Kimack on behalf of SANTOSHA AFTER 50, LLC applied to the Southold Town Trustees for a permit under the provisions of Chapter 275 of the Southold Town Code, the Wetland Ordinance of the Town of Southold, application dated October 3, 2019, and WHEREAS, said application was referred to the Southold Town Conservation Advisory Council and to the Local Waterfront Revitalization Program Coordinator for their findings and recommendations, and, WHEREAS, the LWRP Coordinator recommended that the proposed application be found Inconsistent with the LWRP, and, WHEREAS, the Board of Trustees has furthered Policy 6.3 of the Local Waterfront Revitalization Program to the greatest extent possible through the imposition of the following Best Management Practice requirements: the issuance of a permit for the structures; and WHEREAS, a Public Hearing was held by the Town Trustees with respect to said application on November 13, 2019 and January 15, 2020, at which time all interested persons were given an opportunity to be heard, and WHEREAS, the Board members have personally viewed and are familiar with the premises in question and the surrounding area, and, WHEREAS, the Board has considered all the testimony and documentation submitted concerning this application, and, WHEREAS, the structure complies with the standards set forth in Chapter 275 of the Southold Town Code, 2 WHEREAS, the Board has determined that the project as proposed will not affect the health, safety and general welfare of the people of the town, NOW THEREFORE BE IT, RESOLVED, that for the mitigating factors and based upon the Best Management Practice requirement imposed above, the Board of Trustees deems the action to be Consistent with the Local Waterfront Revitalization Program pursuant to Chapter 268-5 of the Southold Town Code, and, RESOLVED, that the Board of Trustees APPROVE the application of SANTOSHA AFTER 50, LLC to remove approximately 1-11sq.ft. of existing deck in order to construct a proposed 111sq.ft. mudroom to connect the existing 464sq.ft. cottage to the as-built 5'x4.3' deck with enclosed outdoor shower, 5.9'x14.1' (83.2sq.ft.) shed with washer/dryer and toilet room; as-built 10.5'x5' (62sq.ft.) deck on seaward side of cottage; and existing landward shed to be removed and not replaced; to legalize a wood landing (36.5 so, with a wood ramp to beach (19.5 so, and adjacent pavers on grade (32.1 so; two (2) as-built wood landings (13.2 so seaward of pavers on grade to be removed; and as depicted on the site plan prepared by Mark Schwartz & Associates, dated December 16, 2019, and stamped approved on January 15, 2020: Permit to construct and complete project will expire two years from the date the permit is signed. Michael Kimack on behalf of SANTOSHA AFTER 50, LLC requests a Wetland Permit to remove approximately 111 sq.ft. of existing deck in order to construct a proposed 111 sq.ft. mudroom to connect the existing 464sq.ft. cottage to the as-built as-built 5'x4.3' deck with enclosed outdoor shower, 5.9'x14.1' (83.2sq.ft.) shed with washer/dryer and toilet room; as-built 10.5'x5' (62sq.ft.) deck on seaward side of cottage; and existing landward shed to be removed and not replaced. SCTM# 1000-44-1-21 The existing, as-built structures are recommended as INCONSISTENT with the below policy and LWRP. 6.3 Protect and restore tidal and freshwater wetlands. A. Comply with statutory and regulatory requirements of the Southold Town Board of Trustees laws and regulations for all Andros Patent and other lands under their jurisdiction. 1. Comply with Trustee regulations and recommendations as set forth in Trustee permit conditions. A Wetland Permit was not located within Town records for the existing, as- built structures. The concern that the sanitary system was inadequate was raised when the application was under review by the ZBA. It is believed that the system in in excellent working condition. No further recommendation is made at this time regarding the sanitary system. SCTM#1000-44-1-21 SEORA DETERMINATION: The Zoning Board of Appeals has visited the property under consideration in this application and determines that this review falls under the Type II category of the State's List of Actions, without further steps under SEQRA. SUFFOLK COUNTY ADMINISTRATIVE CODE: This application was referred as required under the Suffolk County Administrative Code Sections A 14-14 thru A14-25 and the Suffolk County Department of Planning issued its reply dated February 28, 2019 stating that this application is considered a matter for local determination as there appears to be no significant county-wide or inter-community impact. LWRP DETERMINATION: This application was referred for review under Chapter 268, Waterfront Consistency review of the Town of Southold Town Code and the Local Waterfront Revitalization Program (LWRP) Policy Standards. The LWRP Coordinator issued a recommendation dated June 24, 2019. Based upon the information provided on the LWRP Consistency 'Assessment Form submitted to this department, as well as the records available, it is recommended that the proposed action is EXEMPT from Coastal Consistency Review. However, the LWRP coordinator did express concerns about the location and function of the existing sanitary system. PROPERTY FACTS/DESCRIPTION: The subject property measuring 20,536 square feet (.20 acres) is located in an R-40 Zoning District. The westerly property line measures 103.53 feet, the northerly property line which runs adjacent to the Long Island Sound measures 76.99 feet, the easterly property line measures 124.88 feet and the southerly property line runs adjacent to County Road 48 measures 75.00 feet. The property is improved with a seasonal-one story cottage with a deck that connects to existing outdoor shower stalls, washer and dryer and toilet. There is an existing shed and showers located south of the cottage that will be removed. The northerly portion of the property, beginning adjacent to the Coastal Erosion Hazard Line, is located in FEMA Flood Zone VE (ELI 6) There is also a rock revetment that runs from the westerly property line to the easterly property line separating the rear of the property from the beach on the Long Island Sound. There is a wood framed landing off the rear deck with a walkway and steps in the easterly rear yard that is located in the FEMA Flood Zone VE and on the Coastal Frosion Hazard Line as shown on the survey map submitted by John C Ehlers LS, dated June 30, 2017. BASIS OF APPLICATION: Request for Variances frorn Article XXIII, Sections 280-124 and the Building Inspector's February 1, 2019 Notice of Disapproval based on an application for a permit to make additions and Page 2, September 12,2019 47291, Santosha after 50 SCTM No. 1000-44-1-21 alterations to an existing seasonal dwelling; 1) less than the code required minimum front yard setback of 35 feet; 2) less than the code required minimum side yard setback of 15 feet; at: 56155 Route 48, (Adj. to the Long Island Sound) Greenport,NY. SCTM#1000-44-1-21. RELIEF REQUESTED: The applicant requests variances to make additions and alterations to an existing seasonal dwelling and to connect the seasonal frame dwelling to the existing decks and shower stalls by constructing and enclosing the area with a mudroom addition. The Town Code allows for lots measuring between 20,000 and 39,999 square feet in total size to have a minimum single side yard setback of 15 feet and a minimum front yard setback is 35 feet. The proposed side yard setback is 0 feet and front yard setback is 31.5 feet. ADDITIONAL INFORMATION: No letters or persons have come forward to oppose this project, however, on February 8, 2019 a Stop Work Order was issued by Southold Town for Construction without a Building Permit. The Board, at the advice of the LWRP Coordinator, requested information about the function of the existing sanitary system, and further asked that its location be placed on the site plan and certified as functional by a licensed professional. The applicant on August 6, 2019 submitted new drawings along with a letter from the architect, Mark Schwartz. Mr. Schwartz stated that Will Park from Coastline Cesspool and Drain Service has determined that the existing system is all precast, the septic tank is 900 gallons and the leaching pool is an 8' diameter x 6' deep precast unit. Mr. Schwartz indicated in his letter his belief that the system is in excellent condition, operational and sufficient for this project. FINDINGS OF FACT/REASONS FOR BOARD ACTION: The Zoning Board of Appeals held a public hearing on this application on July 3, 2019 at which time written and oral evidence were presented. Based upon all testimony, documentation, personal inspection of the property and surrounding neighborhood, and other evidence, the Zoning Board finds the following facts to be true and relevant and makes the following findings: 1. Town Law X267-b(3)(b)(I). Grant of the variances will not produce an undesirable change in the character of the neighborhood or a detriment to nearby properties. Many of the homes in the area were seasonal cottages and over the years have been improved. The subject cottage has been at this location for more than 55 years as a summer cottage. The footprint of the cottage will remain the same. The current open area between the cottage and the as built accessory structure (containing shower stalls, laundry and a toilet room) will be enclosed and used as a mudroom. The large shed in the: front yard will be removed, improving the appearance of the property. The accessory structure to be connected to the cottage has been to its current non-conforming location for many years and is screened from the adjoining neighbor by mature hedgerow. 2 Town Law &267-b(3)(b)(2). The benefit sought by the applicant cannot be achieved by some method, feasible for the applicant to pursue, other than an area variance. The cottage has been located on the property for more than 55 years. The existing accessory structure containing 'shower stalls, laundry and toilet room are right on the easterly property line and are on a foundation slab and cannot feasibly be moved to a more conforming location on this small property 3. Town Law $267-b(3)(b)(3). The variance granted herein for the single side yard setback is mathematically substantial, representing 100% relief from the code, and the front yard setback is less substantial representing 10% iclief fi-om the code. However, many of the neighboring cottages also have nonconforming front yard setbacks Page 3, September 12,2019 #7291, Santosha after 50 SCTM No. 1000-44-1-21 and the as built shower and toilet room are well screened along the side property line by mature hedgerow. Moreover, once attached to the cottage, the non-conforming accessory structure containing interior showers and toilet room, which are not permitted by code, will become a code conforming addition to the cottage. 4. Town Law X267-b(3)(b)(4). No evidence has been submitted to suggest that a variance in this residential community will have an adverse impact on the physical or environmental conditions in the neighborhood. The applicant must comply with Chapter 236 of the Town's Storm Water Management Code. 5. Town Law X267-b(3)(b)(Q. The difficulty has been self-created. The applicant purchased the parcel after the Zoning Code was in effect and it is presumed that the applicant had actual or constructive knowledge of the limitations on the use of the parcel under the Zoning Code in effect prior to or at the time of purchase. The addition of the shower stalls and bath pre dated this owner. 6. Town Law §267-b. Grant of the requested relief is the minimum action necessary and adequate to enable the applicant to enjoy the benefit of a connection enclosed mudroom to the stall shower, washer and dryer and bathroom while preserving and protecting the character of the neighborhood and the health, safety and welfare of the community. RESOLUTION OF THE BOARD: In considering all of the above factors and applying the balancing test under New York Town Law 267-13, motion was offered by Member Weisman (Chairperson), seconded by Member Acampora, and duly carried,to GRANT the variances as applied for, and shown on the site plan prepared by Mark Schwartz, Architect and last revised August 5, 2019.
