They simply submitted a letter in opposition and I think that's a little shortsighted because any viability, first of all, it's an exercise in futility if the portion on this side doesn't stay married to the island itself and they are given a pretty substantial asset to sell. There's no market for an island that's isolated with no access. Bob DeLuca,President Group for The East End BOB DELUCA: Good evening Supervisor Russell and members of the Board. Thank you for the opportunity to speak, my name is Bob DeLuca, I am an East Marion resident and speaking tonight as President of Group for the East End. I want to thank the Board very much for taking up this matter, as the Board is well aware (inaudible), looking at the future of Plum Island and it's possible sale, the Board has shown significant leadership and dedication in trying to make sure whatever happens to that island preservation is first and foremost in the mind of the Board as well as what I think you hear from the citizenry, and the issue with this piece of property, the landside parcel that this MIII would apply to is that it already has zoning on it, the MII zone. The MII zone could be fairly significantly developed if it were allowed to go into private hands. One of the things I can tell you, firsthand experience, is that our friends at General Services Administration, in one of the early meetings, the question arose as to whether Plum Island could be sold in parts. And the answer was absolutely if we can get a buyer. So you can see the potential for a buyer who may not even be interested in the main island and not wanting to deal with that, could set their sights on this parcel which is close to nine acres in a MII zone could really have significant development application come before the Board. So the Board is taking affirmative action, which I think is necessary here, to assure that that parcel continues on in the purpose that it currently has which is to get people to the island and to get materials to and from that island and that is it. so from our standpoint, it couldn't be a better decision for the future, no matter what happens out there and it assures that while the larger island is sort of being debated, that this piece of property doesn't kind of slip through the cracks and you end up with somebody coming in with a major development that first of all nobody would want but secondly, the infrastructure in that area could never support the amount of water consumption, the traffic generation, the electricity use and garbage you know, coming out from a property like that. I just think of like Danforth's in Port Jefferson, that's probably on a piece of property that's smaller than this and you can imagine if someone were to come in and say hey, we would love to do this out here and we know the adjacent property was recently purchased by somebody probably looking to do some expansion there. so, in any case, I just want to say thank you. on behalf of the Group we support you, as an East Marion resident, I support you and I wish you continued good work and I love your efforts to try to preserve and protect Plum Island. I am Louise Harrison, I am the New York Natural Areas coordinator for Save the Sound. Save the Sound with 19,000 members has been working for over 40 years to protect and improve endangered lands and waters of Long Island Sound. We lead the Preserve Plum Island Southold Town Board Regular Meeting December 3, 2019 page 31 coalition which has 109 organizational members. Thanks for holding this hearing tonight. We do endorse the creation of the new Marine III or MIII district in Southold's code. We support the dedication of a parcel within the town for the express purpose of providing a waterfront location in the portion of the town located on Long Island for ferry service to and from Plum Island. There's a document called `Alternatives for Final Disposition of Plum Island', here it is, it looks like this. It is written by the US Department of Homeland Security in 2016 and on page 25 there is a paragraph that I felt worth noting, the heading is Synergistic Relationship between Plum Island and the Orient Point facility, the title of the paragraph says it all, the close proximity and multiple amenities of the Orient Point facility make it an ideal gateway to Plum Island for the transport of personnel, vehicles, equipment and supplies. The ample parking, indoor and outdoor storage areas and administration building complement the harbor operation and can support a broad range of activity and uses on Plum Island. The continued relationship between Plum Island and the Orient Point facility would benefit any alternative for the final disposition of the property. And by the property they are referring to Plum Island itself and the personal property that is currently slated for public sale. And it's a vital link to those interested in the future reuse of the existing buildings and infrastructure on the property. There likely would be significant adverse impact on the value and utility of Plum Island if rights of access to and use of the Orient Point facility are not included in the future conveyance documents. AS you know, Save the Sound and the Nature Conservancy have been undertaking an envision file and process over the last year. We have engaged a broad array of stakeholders and are close to finalizing a vision and reuse strategy for Plum Island. In this upcoming document, we will be promoting the future conveyance of the current Orient Point ferry facility along with Plum Island R district, the research district, at the very least to assure future access to the island. That would be in the case if the federal government did parcel out pieces of Plum Island and only sold for instance, the research district. We agree with the Town's vision reflected in the proposed MIII district of accessory uses related to the primary permitted use as a ferry terminal for ferry service to and from Plum Island only. Now, through the envision process, we also developed a concept of a parcel zoned the proposed MIII that could provide a small Plum Island museum that could also serve as an assembly area or a visitors center for people going to Plum Island. We hope that you will pass the legislation creating this new district and then will apply this zoning to the parcel in Orient Point now serving as the Plum Island Center which as you know the federal government currently plans to sell at a public auction. We all are continuing our efforts to move Congress to pass legislation that will remove the current requirement to dispose of Plum Island at a public sale or auction. Our upcoming report will present a unified stakeholders vision for the future of Plum Island and a variety of options to convey Plum Island into beneficial reuse, assuming that the public sale requirement is lifted. Our vision for future reuse of the ferry parcel conforms with the Town's proposed MIII district. Thank you for your vigorous participation in the envision Plum Island process and your foresight in creating this new MIII category. I have copies, I will bring up but I also have a very short letter from the North Fork Environmental Council that I would like to read, they could not attend tonight. `The North Fork Environmental Council and its members support the creation of a Marine III district. The NFEC serves on the steering committee for the Plum Island Preservation Coalition and we commend Southold Town for proposing legislation that would restrict uses at the Plum Island Ferry Terminal in Orient Point to transportation related services specifically to and from Plum Island while allowing for several accessory uses such as administrative offices, a snack bar and visitor center/museum on the Southold Town Board Regular Meeting December 3, 2019 page 32 property. These efforts will certainly help in the preservation of Plum Island's diverse natural and historical resources along with critical wildlife habitat. The NFEC has been advocating for the conservation of natural resources on the North Fork since 1972.' Thank you. SUPERVISOR RUSSELL: Who else would like to address the Town Board on this particular local law? Albert Krupski, Cutchogue ALBERT KRUPSKI: Good evening, Albert Krupski, Cutchogue. I just want to thank the Supervisor and Town Board for taking these steps. These steps are going to ensure that the Town is protected, our quality of life is protected. That the island will always have access, reasonable access from Orient but we won't be able to develop there and there won't be a specter of over-development there. I read the code, I think it's very well written. It's simple, it's to the point, I think it's going to be very effective so thank you for considering this and working hard on it. Gwynn Schroeder GWYNN SCHROEDER: Hi, my name is Gwynn Schroeder representing the North Fork Audubon Society and the Board of Directors and I want to say that we are in full support of the MIII zoning district. It's a critical and proactive necessary first step to make sure that the access to the island is maintained and (inaudible) regardless of how Plum Island is ultimately, how the disposition of the island turns out. Venetia Hands, Orient Association VENETIA HANDS: Good evening, Supervisor Russell and Town Board members. I am here representing the Orient Association and its (inaudible) members and there are at least four other Board members in the room this evening and several others in spirit to echo what you are hearing, it must be wonderful to just be hearing support. But we are, you know, Orient is the area that you are talking about and it's very fragile down there, it's very small. We've had all sorts of issues around the parking of ferries and traffics as you know. And when you have the foresight to zone Plum Island itself the way that you have, I think this was originally in there and then it got cut out and separated and we have been concerned ever since that, that we need to do something here. So I am just going to echo what you have been hearing from the other speakers in saying that we support this Marine III law and very much hope it can be passed and then put into effect on that piece of property. Mark Wooley, District Director for Congressman Lee Zeldin MARK WOOLEY: Good evening members of the Town Board. I am Mark Wooley, district director for Congressman Lee Zeldin. It is a distinct honor to be here tonight before you as you continue on with your vision for Plum Island, you had that vision to recommend zoning for the Island and we see again you have taken appropriate steps to do so here. We wholeheartedly support local control, whether it's Southold or some other municipality but with Southold you seem to get it right and from what we have seen here, it looks like you are on the path to getting it right with Plum Island. We don't, at the congressional level, want this sold as you know. We don't intend to have this sold, we are going to continue fighting so it doesn't get sold and you are able to preserve this beautiful land. I was just there November 4, the day before Election Day, and I got to spend the day there outside with the security and again, I got to see just how beautiful Plum Island is. I live here on the North Fork, originally from Riverhead so it's not something that's strange to me but it's always when you go there, it's always like it's new and when you leave it's like you don't want to leave. I look forward to going there this spring to continue with that drill and hope we have better news to report as far as work being done on the lighthouse which we were able to get. So we aren't looking to have it sold. Whether GSA says they don't support this, it's no surprise. There's not much they do support regarding Plum Island. But the Congressman doesn't believe the GSA is right in what they are looking to do here. We are fortunate that we are working with members in the Senate, particularly Senator Gillibrand, she has got legislation that we have been able to get through in the house for the past five years. Hopefully we can get the Senator's legislation passed, so that we don't have to continue to come back and have this discussion, we can look forward with enjoying the uses that are being discussed with Envision Plum Island, as far as the future of Plum Island. So our word here from the Congressman is local control. We believe in local control and we believe you are right so far, so we support what you are trying to do here this evening. So,thank you. IV. EFFECTIVE DATE Southold Town Board Regular Meeting December 3, 2019 page 35 This Local Law shall take effect immediately upon filing with the Secretary of State as provided by law. I have a notarized affidavit that this hearing had been advertised by the Town Clerk's office and the same for the Suffolk Times. That's all I have. Supervisor Russell SUPERVISOR RUSSELL: Would anybody like to address the Town Board on this particular local law? COUNCILMAN GHOSIO: I was hoping for a dozen or so folks to step up. COUNCILMAN RULAND: I will take you up on your offer, Mr. Supervisor. This has been discussed off and on by the Transportation Commission on several occasions where it has been brought up and as you well know, the last, the final recommendation from the Transportation Commission to the Town Board was their unanimous support that it was time that this law be enacted. There have been several, in this year, there have been several near misses of pedestrians and vehicles mounting the sidewalk and making U-turns and people have had to dive out of the way. It's just not acceptable. I think that the Chief of Police will be satisfied now that there's something ironclad to enforce that he will cooperate and we will get people to understand that this is an activity that we will not tolerate on Love Lane or in any of our streets where they are marked. I also would like to say that as you know, the Superintendent of Highways will be in charge of putting up the signage and some very simple recommendations have come from the Transportation commission as well and that is that there is no reason or, I want to say that some people; have expressed concern that,.oh, no, more signs but I think that with a little bit of forethought one signpost can share more than one sign and they can be properly placed so they are plainly in view and enforceable and I would hope that you as my colleagues would support as I certainly do plan to. Steering Comm LOUISE HARRISON: First of all, thank you very much. That was wonderful and on behalf of the Preserve Plum Island Coalition Steering Committee that met today, we are very pleased and we are also excited that we will have a chance to meet with the Supervisor on Friday with our draft vision for Plum Island and reuse strategy. So I just wanted to let you know what's coming. we have gone over this strategy with our Preserve Plum Island Steering Committee today, they will have chances over the next 24 hours to give any further comments and we'll be getting it to some kind of readable shape and then get it to the Supervisor and then whatever staff you want to bring on this, hopefully by Thursday morning at the latest. And after we meet with you, we will be folding in comments from the town to a version that we will be presenting on the 10th to the Southold Town Board Regular Meeting December 3, 2019 page 36 executive chamber of the governor's office, at their request. So it is hopeful that New York State is showing interest in the future of Plum Island and is asking us to come forward with this reuse strategy and vision. As a reminder, this whole thing came out of congress pushing us to come up with something like this in order to present the rationale for them to move in the ways they need to, to repeal the legislation that is on the books, calling for a public sale of Plum Island assets. So we, that is our plan, to go back to congress now with this report and plan and to the general public. So everybody is going to get a chance to see this sequence that we are going through and probably next summertime, sometime we will have an Envision Plum Island update workshop for people. We have our consulting firm, has a lot of expertise in helping to move federal properties into other uses and they know the ins and outs of working with the GSA and the various agencies, so they have been guiding us and a good deal of the document that we will be producing is a strategy has their input and we (inaudible) at this point, depending on the feedback we get we will be revising and making something that's as viable as possible and as convincing as possible. So, I just wanted to bring you up to date on that and look forward to your further input but this was really the important part of the puzzle and it's already incorporated into our vision, so we are married on that one already.
