Hughes Retirement Receiver of Taxes George Sullivan Opening Comments Supervisor Scott A.Russell SUPERVISOR RUSSELL: Will everyone please rise for the Pledge? Thank you. Before we get to the regular business of the agenda, we want to take a few minutes to recognize some colleagues of ours, who will no longer be working with us. It is actually a difficult time for all of us because we have gotten to know these people for so many years and who work so well together but I know that the contribution they have made to this community and commitment they have made will continue. I am going to ask each of the people to come up, Judge Brian Hughes, William Ruland. And I am going to ask Meghan Collins will be here and Bob. You know, we didn't know each other that well when you first started. My dad knew you well, he Southold Town Board Regular Meeting December 17, 2019 page 4 was in law enforcement. Everybody in that industry, that profession, thought so highly of you. And I know my dad and others, police organizations that endorsed you, in fact. It's been a pleasure working with you these last four years, I think you have done a wonderful job, I think I can speak on behalf of his whole staff, the law and order you brought to the profession. We did not put (inaudible) Judge Hang-em High Hughes (inaudible) but on behalf of the entire Town Board, we want to thank you and present you with a proclamation to say thanks for the dedication you showed not just to your profession but to the entire community of Southold town. JUDGE HUGHES: I appreciate it greatly but this isn't just for me because of the staff, would you guys mind standing up for a moment please, I get to embarrass you one more time. Missing is Diana but Kendra, Dania, Michelle and Leanne, I really could not have done this job without the five of you and you will always be in my heart. And also I would like to thank the Town Board for the support during the four years, there were some difficult times and there will be some difficult times going forward but you guys are up to it. Thank you very much. SUPERVISOR RUSSELL: This is an extra special proclamation I am going to present to your Dad. I know he was too ill to make it tonight. I actually started working with George, was elected about a year before I was, so I worked with George for virtually the entire time I have been working for Southold Town. There was a little bit of a break for about six years, he wanted to move on with other things but after six years and begging we finally convinced him to run again in 2001. George is a man of singular integrity, served his country, we all know he is a war hero, he is also a hero to this contributions in so many ways with so many organizations and certainly with the commitment he has made to his job on behalf of the people of Southold Town, the hard work he has put in for nearly 25 years I would say, it's immeasurable. We owe a debt of gratitude to George and please present this to George on behalf of the Town Board and please give him my wishes and say I hope I see him in the next few days. Thank you. Now, actually let me just say and I know a lot of people might think this sounds repetitive but I am going to tell all of you in case you don't know, well, I am sorry Bill, I graduated from Mattituck High School in 1982. The person who presented me with my diploma was the man standing to my left, William Ruland. He was president of the Board of Education there for 24 years and then he has served as Town Councilman for 12 years and he has served as my Deputy the last few years. Bill, I want to thank you so much for your mentorship, for your guidance and for your, I would say your solid advice that you have given all of us. You don't speak often but when you speak, you speak with authority and speak with the experience of someone who has worked so hard and dedicated himself to this community for so many years. I want to present this on behalf of the Southold Town Board. One other thing, Legislator Al Krupski could not make it tonight but he did want to make sure that I presented this proclamation on his behalf and on behalf of Suffolk County. COUNCILMAN RULAND: Thank you. There is no greater privilege than being honored by your peers. SUPERVISOR RUSSELL: Once again, thanks to all of your for your dedication and hard work. I would like to say as I have said in the past, you are all welcome to stay but it will not be, we will not consider it rude if you don't stay for all the resolutions. I would invite anybody that would like to comment on any issue to please feel free? COUNCILWOMAN DOHERTY: Can I just make a comment on that last resolution? I want to thank Judge Hughes for volunteering for this position that Eileen Powers stepped up to. Part of the way this court system was set up, this particular one, it counts on judges volunteering their time for this and Judge Hughes has done it for the past four years and now Judge Powers is stepping up for this very important issue. SUPERVISOR RUSSELL: Who else would like to address the Town Board on any issue? Nancy Bufkins, Southold NANCY BUFKINS: Nancy Bufkins, Southold. I have a question on the Comprehensive Plan. My question is assuming it's going to be adopted in 2020, how does it affect projects that are in the pipeline right now, specifically the Enclaves which I know have business before the Town but will the standards that are set out in that comprehensive plan apply retroactively to projects such as that one? SUPERVISOR RUSSELL: Any rezoning wouldn't apply... MS. BUFKINS: Not zoning, I am just talking about the general.... SUPERVISOR RUSSELL: Well, this is, the comprehensive master plan is a document, it's a guide, made up of 13 chapters. One of those components would be a land use component and that's where you'll take up the issue of zoning... MS. BUFKINS: Well, I guess specifically the part that I was reading this afternoon, the part I was most interested in was about character of the communities. SUPERVISOR RUSSELL: Right. Southold Town Board Regular Meeting December 17, 2019 page 30 MS. BUFKINS: And the desire to sort of maintain this small town, historic feel. And I guess the developer has gone with the 2005 plan which of course it meets those standards but with a plan such as that(inaudible)put forth in that new plan... SUPERVISOR RUSSELL: Okay, community standard, first I don't, community standard is going to appear in any land use document. Community standard, to be honest, is subjective. What the Comprehensive Master Plan does is it outlines several different goals and objectives, so any one decision has to be weighed against those goals to make sure it's consistent with what was adopted as a comprehensive master plan. What were the wishes of the community that are included in that plan. Community character, we do have architectural standards and all those other things. The comp plan would give us an opportunity to consider whether architectural review should be voluntary or advisory or mandatory, all of those things are going to be part of public discussion as we move forward. MS. BUFKINS: Okay. So I just want to make sure, I am here representing some neighbors, I just want to make sure I go back and report this correctly, so I think what you said was no, that something in the pipeline will not, I mean, the comprehensive plan, assuming it's adopted in the next few months which I guess I can assume, that would not, in other words if the developer has to go back and has to revise his proposal, would it be held to those things that are set out in the comprehensive plan. And the answer is.... SUPERVISOR RUSSELL: Any pending applications are pending under the current code... MS. BUFKINS: The current. So it's not retroactive? SUPERVISOR RUSSELL: No, the Comprehensive Master Plan is not town code, it is simply a document that provides a guide for future decision making and future code amendments. Things like that. But let me just stress, that a pending application is just that, I can't speak on the specifics of that, this is before the Zoning Board of Appeals but ultimately things like community character, all those things as they exist in the code are things that the Zoning Board of Appeals can evaluate. There is no hard and fast rule as to whether something is determined to be consistent or inconsistent, the Zoning Board of Appeals and other Boards are going to determine what is the community standard meet, what is the community character? Is this plan that comes before us consistent with everybody's understanding of community character and community standards? MS. BUFKINS: Just one final bit, will the comprehensive master plan be adopted in 2020? Is that on the agenda to be done in the first half of the year? SUPERVISOR RUSSELL: The Comprehensive Master Plan itself we anticipate certainly adopting sometime in 2020 but remember, the Comprehensive Master Plan, once that's done, then we have a fixed document that was adopted, now we go out to the community and say this is the plan,this is the guide. How do we implement this guide? Southold Town Board Regular Meeting December 17, 2019 page 31 MS. BUFKINS: Right. But you would adopt it so that we would have that basic baseline, that's, those are the goals. SUPERVISOR RUSSELL: That's exactly right. Yes. But it would involve any future changes or any future considerations based on the comp plan, would require a substantial amount of public input and that certainly is our goal. MS. BUFKINS: Thank you. COUNCILWOMAN DOHERTY: Keep in mind, a lot of what's already in the comp plan we are practicing, is our best management practices. MS. BUFKINS: Inaudible. Having looked at the proposal by the developer, he was basing all his data on the 2005 and so,you know, I guess our group was wondering,that's pretty outdated and will that be allowed to stay... SUPERVISOR RUSSELL: It could very well be but data is empirical so there might be issues with regard to traffic that data would be considered.... MS. BUFKINS: A lot of the environmental impact stuff, especially water usage... SUPERVISOR RUSSELL: But those things, they can be evaluated by the Zoning Board of Appeals today, in other words, there is no 2005 threshold of standards they need to meet. We are hoping that the community character component gets judged as community character, it's just that. That is something for the Zoning Board of Appeals (inaudible). Is this consistent with what we have identified as community character. And don't forget, the hamlet stakeholders implementation plans were adopted some years ago. When they are presented to a Town Board, they have to be voted on to be accepted by a Town Board, those community character standards and all of those things, the wish list of the hamlet stakeholders is part of the decision making and has been for some time. MS. BUFKINS: Okay, thank you. SUPERVISOR RUSSELL: Sure. COUNCILMAN DINIZIO: You'll have plenty of time to comment on that... MS. BUFKINS: Oh, I know. No, no, this is a very specific question that one of our members wanted to know, because again, they were going off the 2005 standards it just seemed unacceptable, given that we have come so far and.... COUNCILMAN DINIZIO: Inaudible....that a decision is (inaudible). MS. BUFKINS: No, no, we've been down this, we are actually pretty well informed. Thank you. Southold Town Board Regular Meeting December 17, 2019 page 32 SUPERVISOR RUSSELL: I'm just a little confused because I am unaware of any type of code, 2005 code standard that they are applying because the Zoning Board of Appeals, this is 2019. MS. BUFKINS: I guess because the new code is more, sets out more standards, better standards and they were not addressed in your proposal. SUPERVISOR RUSSELL: But the Zoning Board of Appeals has the right to require those. They are under no obligation to follow the 2005 standard that appears in the Southold Town code. They can insist on 2019 standards, they have every right to do that as a quasi judicial body. MS. BUFKINS: Right. Especially considering all the information we have now about environmental changes going on, we are so vulnerable to. SUPERVISOR RUSSELL: Absolutely and they have every right to take this application, regardless of what data you present, they have the right to take that information and say, you know what? We want to look at this from a 2019 perspective not the 2005 perspective. MS. BUFKINS: Okay. Thanks a lot.
